A RESOLUTION, WAIVING BY 4/5THS AFFIRMATIVE
VOTE OF THE MEMBERS OF THE CITY COMMISSION,
AFTER A DULY ADVERTISED PUBLIC HEARING, THE
PROHIBITION CONTAINED IN CITY CODE
SECTIONS 2-301 THROUGH 2-304 AS SUCH
PROHIBITION APPLIES TO RICHARD J.
HEISENBOTTLE, WHO SERVES ON THE CITY OF MIAMI
HISTORIC AND ENVIRONMENTAL PRESERVATION
BOARD, IN RELATION TO HIS FIRM BEING THE
SUCCESSFUL PROPOSER IN RESPONSE TO A REQUEST
FOR PROPOSALS ("RFP") TO PROVIDE
ARCHITECTURAL CONSULTANT SERVICES TO THE
DOWNTOWN DEVELOPMENT AUTHORITY FOR THE
I IMPLEMENTATION OF THE $2.5 MILLION EDA GRANT
FOR AN INTERNATIONAL MERCHANDISING MART
PROJECT.
WHEREAS, Richard J. Heisenbottle is currently serving as a
member of the Miami Historic and Environmental Preservation Board
and is President of the architectural consulting firm of R. J.
Heisenbottle Architects, P.A.; and
WHEREAS, the firm of Richard J. Heisenbottle (R. J.
Heisenbottle, Architect, P.A.) was the successful Proposer in the
Competitive Bidding process which was initiated by a Request for
Proposals ("R.F.P.") for architectural services relative to
implementation of the $2.5 EDA Grant for an International
Merchandising Mart; and
WHEREAS, the firm of R. J. Heisenbottle, Architect, P.A. is
seeking to provide architectural consulting services to the
Downtown Development Authority (DDA) on the International
Merchandising Mart Project;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The waiver set forth in Section 3 hereof is
based upon the recitals and findings contained in Section 1
hereof and upon the following findings:
(a) The DDA desires to retain the consulting firm of
R. J. Heisenbottle, Architects, P.A., as such firm
is qualified to provide architectural services to
-the DDA for the International Merchandising Mart
project, which relationship would be in violation
of City Code Sections 2-301 through 2-304 were
there not a waiver of the prohibition contained in
said Sections.
(b) The herein proposed transaction will be in the
best interest of the City of Miami and the DDA in
completing the International Merchandising Mart
project.
Section 3. The prohibition contained in Sections 2-301
through 2-304 of the City Code is hereby waived by a 4/5ths
affirmative vote of the City Commission, after a duly advertised
public hearing.

Section 4. This Resolution shall become effective
immediately upon its adoption.

Recommendation
It is respectfully requested that the City Commission approve the
attached Resolution waiving the prohibition contained in City
Code Sections 2-301 through 2-304 as it applies to Richard J.
Heisenbottle, who serves on the Historic and Environmental
Preservation Board, in relation to his providing architectural
consultant services for the International Merchandising Mart.
Background
The DDA has received a $2.5 Million Grant for development of an
International Merchandising Mart from the U.S. Department of
Commerce Economic Development Administration.
To undertake architectural design, engineering and construction
management services, the DDA issued a Request For Proposals for
consultant services according to competitive bidding requirements
of the'City of Miami.
The successful Proposer, Richard J. Heisenbottle (R. J.
Heisenbottle, Architects, P.A.) presently serves on the City of
Miami Historic and Environmental Preservation Board. As such, he
is precluded by Sections 2-301 through 2-304 of the City Code
from entering into any contract with the DDA or any other board
or agency of the City of Miami until such time as he obtains a
waiver of this conflict from the City Commission pursuant to
Section 2-304.
It is respectfully requested that the City Commission approve the
attached Resolution waiving the prohibition contained in City
Code Sections 2-301 through 2-304 and thereby permit the DDA to
contract with Richard J. Heisenbottle for architectural
consulting services on the International Merchandising Mart
project.
