A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT NOT TO EXCEED $7,500 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND SERVICE STATION AID, INC., DATED NOVEMBER 15, 1990 FROM $88,921.40 TO AN AMOUNT NOT TO EXCEED $96,421.40 FOR THE HEAVY EQUIPMENT FACILITY ENVIRONMENTAL CONSULTING/CONSTRUCTION SERVICES PROJECT B-5579, CAPITAL IMPROVEMENT PROJECT NO. 311009, WITH SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10938, AS AMENDED, FROM FUNDS ALREADY APPROPRIATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES 'BY AN AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION. WHEREAS, there exists a contract dated November 15, 1990, between the City of Miami, Florida and Service Station Aid, Inc., for Heavy Equipment Facility Environmental Consulting/Construction Services B-5579, Capital Improvement Project No. 311009; and WHEREA�, an Increase in contract not to exceed $7,500.00 is k required to cover the cost of necessary extra work involving the additional testing and sampling of soils and grour.:water to finalize the contamination assessment report relating to underground contamination at the City's Heavy Equipment Site; and WHEREAS, the Director of Public Works, the Director of General Services Administration and Solid Waste and the City Manager recommend the Increase in contract to cover the additional costs; and CITY COMMISSION MEETU,IC OF NOV 2 3 1993 WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to continue to protect the health, safety and welfare of the citizens of the City; and WHEREAS, funds to cover the Increase are available from monies alreadly appropriated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and Incorporated herein as if fully set forth In this Section. Section 2. After a properly advertised Public Hearing the findings of the City Manager set forth In the Preamble of this Resolution are hereby ratified by an affirmative vote of four - fifths of the City Commission. Section 3. The contrAct between Service Station Aid, Inc. and the City of Miami, Florida, dated November 15, 1990, for Heavy Equipment Facility Environmental Consulting/Construction Services B-5579, Capital Improvement Project No. 311009, Is hereby Increased In an amount not to exceed $7,500.00; from $88,921.40 to an amount not to exceed $96,421.40, with funds for the increase to be provided from monies already appropriated to the project. It Is respectfully recommended that the City Commission adopt the attached Resolution ratifying the City Manager's written finding that a valid emergency exists and increasing the Heavy Equipment Facility Environmental Consulting/Construction B-5579 contract In the amount of $7,500.00 for an estimated total contract cost of $96,421.40. BACKGROUND: The Department of Public Works, In an effort to serve all residents of the City of Miami , has determined that it Is now In order for the City Commission to ratify the City Manager's emergency finding Justifying an Increase in the contract In the amount of $7,500.00. the reasons for the emergency finding are as' fo I I ows : A contract was executed with Service Station Aid, Inc. (S.S.A.) for the Heavy Equipment Environmental Consulting/Construction Services on November 15, 1990. A primary task of this contract was the delineation and quantification of undergrou►id soll and water contamination. During the course of the contract It became apparent that contamination was present to a greater degree than anticipated and In locations not predicted. Dade County's Department of Environmental Resources Management (D.E.R.M.) has required additional monitoring wells, soli borings, sampling, laboratory testing, and reports to finalize the assessment phase of this project with specific time frames. These tasks will complete the existing contract with S.S.A. This additional work will require an Increase In contract not to exceed $7,500.00. Funds for the Increase are available from monies already appropriated in the City's Capital Improvement Appropriation Ordinance 10938, as amended, Project No. 311009. 1>- )el •93— 747 4C5, I
