RESOLUTION NO.93- 746
A RESOLUTION AUTHORIZING AN INCREASE IN THE
CONTRACT AMOUNT NOT TO EXCEED $209,173.50, IN
THE CONTRACT BETWEEN THE CITY OF MIAMI,
FLORIDA AND CONE CONSTRUCTORS, INC., DATED
JUNE 2, 1993 FROM $2,850,430.00 TO
$3,059,603.50, FOR DINNER KEY MARINA
RESTORATION PHASE II H-1008, CAPITAL
IMPROVEMENT PROJECT NOS. 414501 AND 414005,
WITH SAID FUNDS TO BE PROVIDED FROM THE
FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA)
FROM FUNDS ALREADY APPROPRIATED TO THE
PROJECT; FURTHER RATIFYING THE CITY MANAGER'S
WRITTEN FINDING THAT THE HEREIN INCREASE
RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE
MEMBERS OF THE CITY COMMISSION.
WHEREAS, there exists a contract dated June 2, 1993 between
the City of Miami, Florida and Cone Constructors, Inc. for
construction of Dinner Key Marina Restoration Phase II, H-1008
Capital Improvement Project Nos. 414501 and 414005; and
the
WHEREAS, an increase in/contract not to exceed $209,173.50
is required to cover the cost of necessary extra work involving
the replacement of pier mounted electrical transformers; and
WHEREAS, the Director of Public Works, the Director for
Parks and Recreation and the City Manager recommend the increase
in contract to cover the additional costs; and
WHEREAS, the City Manager has made a written finding that a.
valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and

WHEREAS, funds to cover the increase have been requested
through a supplemental Damage Survey Report (DSR) from the
Federal Emergency Management Agency (FEMA);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. After a properly advertised Public Hearing, the
findings of the City Manager set forth in the .:reamble to this
Resolution are hereby ratified by an affirmative vote of four -
fifths of the City Commission, and are hereby incorporated by
reference thereto and adopted as if fully set forth in this
Section.
Section 2. The contract between the City of Miami, Florida,
and Cone Constructors, Inc. dated June 2, 1993, for Dinner Key
Marina Restoration Phase II, H-1008, Capital Improvement Project
Nos. 414501 and 414005, is hereby increased in an amount not to
exceed $209,173.50 from $2,850,430.00 to $3,059,603.50 with funds
for the increase have been requested through a supplemental
Damage Survey Report (DSR) from the Federal Emergency Management
Agency (FEMA).
Section 3. This Resolution shall become effective
immediately upon its adoption.
PASSED AND ADOPTED THIS 23rd DAY OF November 1993.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an increase in the contract
between Cone Constructors, Inc. and the City of Miami for Dinner
Key Marina Restoration Phase.II in the amount of $209,173.50; and
further ratifying the City Manager's written finding that the
increase resulted from emergency circumstances.
BACKGROUND
The Department of Public Works, in an effort to serve all
residents of the City of Miami, has determined that it is now
appropriate and in order for the City Commission to ratify the
City Manager's decision to increase the contract dated June 2,
1993 between the City of Miami and Cone Constructors, Inca for
construction of Dinner Key Marina Restoration - Phase II H-1008
in the amount of $209,173.50 for necessary extra work, and to
ratify the City Manager's emergency finding that allowed the
extra work to continue.
The City Commission awarded a contract to Cone Constructors, Inc.
for the construction of Dinner Key Marina Restoration - Phase II
under Project Nos. 414501 and 414005, in the amount of
$2,850,430.00 on May 13, 1993. Generally, the project consisted
of a complete repair of Pier #3 through Pier #8 and the landside
facilities including the Baywalk, Vacuum Sewer Building and
related equipment, along with the final repairs to Piers #1, #2,
and #9, located at Dinner Key Marina 3400 Pan American Drive.
As a result of Hurricane Andrew, the 25-KVA pier mounted
transformers at Dinner Key Marina were subjected to salt water
damage from the storm surge. Under the National Electrical Code
which is incorporated in the South Florida Building Code, all
salt water damaged equipment must be certified or replaced.
The manufacturer, ACME Transformer Co., can not re -certify the
transformers since their submersion in salt water voided any, and
all warranties and also voided the testing laboratory listing.
Therefore the transformers must be replaced.

In the original approved estimate, it was anticipated 25% of the
existing transformers (75 each) would need replacement. After
the city started using Piers #1 and #2 on a temporary basis, some
transformers started failing. The City's electrical inspector
determined that the failures were caused by salt water and that
all transformers would need to be replaced with National
Electrical Code Approved Equipment. The total replacement will
require an additional 215 transformers to complete the repairs in
accordance with electrical code requirements. The increase in
cost will be $209,173.50 which also includes proper disposal of
the existing transformers.
It was decided that the most cost effective and expeditious
manner to address all of the above problems was to allow Cone
Constructors, Inc. to proceed with the extra work and continue
with replacement of the transformers as soon as possible.
Failure to expeditiously correct the aforementioned problems,
could have endangered the health, safety and welfare of our
citizens.
Funds for this additional scope of work have been req.uested
through a supplemental Damage Survey Report (DSR) from the
Federal Emergency Management Agency (FEMA). The total increase
in contract amount is $209,173.50.
