HomeMy WebLinkAboutR-93-0695J-93-764 10/21/93 RESOLUTION NO. 93-- 695 A RESOLUTION OF THE MIAMI CITY COMMISSION NOTIFYING THE DADE COUNTY SCHOOL BOARD ("SCHOOL BOARD") OF THE CITY'S STRONG OBJECTION TO THE SCHOOL BOARD'S INTENT TO CONDEMN AND RAZE NINETEEN (19) HOMES IN THE CORAL GATE RESIDENTIAL NEIGHBORHOOD OF THE CITY TO CONSTRUCT A NEW ELEMENTARY SCHOOL (STATE SCHOOL "H"), WITHOUT HAVING: 1) GIVEN THE CORAL GATE NEIGHBORHOOD AN OPPORTUNITY, PURSUANT TO A PUBLIC HEARING, WITH SPECIAL NOTICE, TO GIVE INPUT; 2) THE PARTICIPATION OF THE CITY'S PROFESSIONAL PLANNING AND ZONING STAFF IN DETERMINING COMPATIBILITY WITH THE RESIDENTIAL AREA AND CONSISTENCY WITH THE CITY'S COMPREHENSIVE PLAN; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN SPECIFIED OFFICIALS. WHEREAS, the Dade County School Board has indicated its intention to construct a new elementary school in the Coral Gate area to relieve crowding at Shenandoah, Kensington Park and Citrus Grove elementary schools; and WHEREAS, the neighborhood in the affected area between S.W. 31st and 32nd Avenues and S.W. 14th and 16th Streets, is in opposition to said new construction without the opportunity to discuss this matter at a specially called public hearing; and WHEREAS, the subject new school construction would result in the demolition of 19 homes in the Coral Gate neighborhood; and CrrY Cormssiox MEETTHC OF OCT 2 1 1993 R®aolution No. 93- 695 WHEREAS, the School Board has not met with officials of the City to certify compliance with the City's Comprehensive Plan or the impact such an action might have on the surrounding residentially zoned area; and WHEREAS, the City desires to avail itself of all statutory and procedural remedies to ensure compliance by the School Board with procedural mandates, and a determination of whether a "balancing of competing interest test" would justify said construction activity at the subject site; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The School Board of Dade County ("School Board") is hereby placed on notice that the City of Miami strongly objects to any action by the School Board to initiate eminent domain action against residents of the Coral Gate area for purposes of constructing a new elementary school (a.k.a. State School "H") in the Coral Gate area, without the School Board having given the affected neighbors an opportunity, with reasonable notice, to discuss this matter at a specially called public hearing. Section 3. The City further objects to the School Board not obtaining official input from the City's professional Planning and Zoning staff in reaching conclusions, implioit in the School Board's Resolution No. 93-39, regarding the -2- 93- 695 compatibility of such a facility with the surrounding residential area, and the consistency of the School Board's plans with the City's Comprehensive Plan. Section 4. The City Clerk is hereby directed to forward copies of this Resolution to the Chairman of the Dade County School Board and Superintendent of the Dade County Public School System. Section 5. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 21st day of October, 1993.
