A RESOLUTION DESIGNATING AS A "CATEGORY B
PROJECT, THE ACQUISITION OF PROFESSIONAL
PLANNING SERVICES FOR THE COCONUT GROVE
PLANNING STUDY AS DESCRIBED GEOGRAPHICALLY;
AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR
THE REQUIRED PROFESSIONAL SERVICES THROUGH A
REQUEST FOR QUALIFICATIONS; APPOINTING A
CERTIFICATION COMMITTEE OF NOT LESS THAN
THREE QUALIFIED PROFESSIONALS FROM THE STAFFS
OF THE CITY OF MIAMI AND METROPOLITAN DADE
COUNTY; IDENTIFYING $100,000 IN THE GENERAL
FUND SPECIAL PROGRAM AND ACCOUNTS AS THE
SOURCE OF FUNDING, AND APPOINTING SERGIO
RODRIGUEZ, ASSISTANT CITY MANAGER AND
DIRECTOR, PLANNING, BUILDING AND ZONING
DEPARTMENT, (OR HIS DESIGNEE), AS CHAIRPERSON
OF THE COMPETITIVE SELECTION COMMITTEE;
PROVIDING FOR A FINAL REPORT TO THE CITY
MANAGER FOR FINAL DECISION BY THE CITY
COMMISSION; PROVIDING FOR CONTRACTUAL
APPROVAL BY THE CITY COMMISSION ON
RECOMMENDATION OF THE CITY MANAGER; AND
ESTABLISHING NEGOTIATION REQUIREMENTS WITH
REGARD TO THE FURNISHING OF SUCH SERVICES.
WHEREAS, the representatives of the Cocoanut Grove Village
Council appeared before the Commission on March 25, 1993, to
request a planning study and moratorium; and
WHEREAS, pursuant to Motion 93-211, adopted March 25, 1993,
the City Commission directed the City Manager to begin the
process of preparing the plan, and identifying funds, determining
the need for a moratorium; and

WHEREAS, on May 27, 1993, the City Commission continued both
items, directing the City Manager to retain City control of the
consultant selection process and funds, and to return to the City
Commission on June 29th, but no later than July 22; and
WHEREAS, the City Manager recommends that the acquisition of
planning services for the Coconut Grove Planning Study be
designated a "Category B Project" ("Project") in accordance with
the provisions of City Code Section 18-52.3; and
WHEREAS, said City Code Section 18-52.3 also requires, inter
alia, the establishment of a Certification Committee of not less
than three professionals qualified in the fields of endeavor or
practices involved in the Project, to review the qualifications,
performance data and related information provided by those
responding to the City's Request for Professional Services; and
WHEREAS, the City Manager recommends that Sergio Rodriguez,
Director, Planning, Building and Zoning Department, be appointed
Chairperson of the Competitive Selection Committee, in accordance
with the provisions of City of Miami Code Section 18-52.3; and
WHEREAS, Florida Statutes and the City Code establish

procedures for contracting for such professional services and
also establish negotiation requirements with regard to the
furnishing of such services;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. The acquisition of planning services for the t
Coconut Grove Planning Study is hereby designated a "Category B
Project," in accordance with the provisions of the City of Miami
Code Section 18-52.3, which established procedures for
contracting for certain professional services and also
established competitive negotiation requirements with regard to
the furnishing of such services.
Section 3. The Coconut Grove study area is to be
conducted for the area bounded by Biscayne Bay, Rickenbacker
Causeway, Federal Highway (U.S. 1/South Dixie Highway) and the
City limits.
Section 4. The City Manager is hereby authorized to
advertise for the aforementioned professional services, and to
issue a Request for Qualifications document related to the
procurement of such services, in accordance with the City Code.
Section 5. A Certification Committee is hereby appointed
consisting of the following City staff; Joseph W. McManus,
Architect -Planner, Department of Planning, Building and Zoning;
John Jackson, Engineer, Department of Public Works, and Margot
Ammidown, Preservationist, Metropolitan ODade County Historic
Preservation Division.
Section 6. Sergio Rodriguez, Assistant City Manager and
Director of the Department of Planning, Building and Zoning (or
his designee) is hereby appointed as Chairperson of the
Competitive Selection Committee, in accordance with the
provisions of City of Miami Code Section 18-52.3.

Section 7. The sum of one hundred thousand dollars
($100,000) has been identified in the General Fund Special
Program and Accounts to fund this study.
Section 8. Following its review in accordance with
provisions of the City Code, the Competitive Selection Committee
shall provide a final report of its findings, together with
supporting information, to the City Manager, file a copy of its
findings with the City Clerk and present said report to the City
Commission for its approval.
Section 9. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached
resolution designating as a Category "B" Project the acquisition of planning
services for the Coconut Grove Planning Study, authorizing the City Manager to
advertise for the required professional planning services through a Request for
Qualifications; appointing a Certification Committee of not less than three
professionals qualified in the fields of endeavor or practice involved in the
project from the City's staff; identifying $100,000 from Special Programs and
Accounts, General Fund, as the source of funding; appointing Sergio Rodriguez,
Assistant City Manager, as Chairman of the Competitive Selection Committee, all
in accordance with City of Miami Ordinance No. 9572 adopted February 10, 1993,
and City of Miami Code Section 18-52.3 which established procedures for
contracting for such professional services and also established negotiation
requirements with regard to the furnishing of such services.
BACKGROUND:
The chronology of events has been as follows:
March 25, 1993: A representative of the Cocoanut Grove Village Council
requested a planning study and development moratorium during the study. The
Commission directed the Administration to prepare a moratorium and study
which could serve as the basis for a possible moratorium and by Motion 93-
211 instructed the City Manager to identify sources of funds for a planning
study to be conducted by consultants while keeping the Commission in control
of the funds.
May 27, 1993: The Administration presented a Resolution of Intent for the
Coconut Grove Planning Study and a Moratorium Ordinance.
The Commission continued both items to June 29th or no later than July 22nd;
but the general direction given the Administration was to retain City
control of both the study and the funds.

June 29, 1993: Representatives of the Cocoanut Grove Village Council again
requested a planning study along the lines of the Resolution of Intent
presented on May 27th. (See attached)
July 22, 1993: the Commission re -affirmed its position that the City should
retain control of consultant selection, the study itself, and the funding
and further, that no formal agreement would be executed with the Cocoanut
Grove Village Council --as contemplated in Item 7-B of the July 22nd agenda.
For these reasons, Item 7-B has not been carried forward and Item 7-A of the
July 22nd agenda has been used as the vehicle for the Planning Study.
The Planning, Building and Zoning Department (PBZ) Department will solicit
professional planning services by means of a Request for Qualifications (RFQ) to
firms and individuals in Florida, utilizing planning consultant directories.
The RFQ will include a proposed scope of services responsive to Chapter 163,
Florida Statutes specifically to include the substantive Section 163.3161 et seta
and Florida Administrative Rule 9J-5. The RFQ will also specify the minimum
graphic material to be included by the Consultant.
To hold costs down, the Planning, Building and Zoning Department will make
available readily available maps and data and will undertake all procedural work
leading to City and State approval. As a part of this process, the Consultant
will be expected to make a minimum number of presentations.
The Certification Committee will be comprised of two professionals from the City
Staff tentatively identified as Joseph W. McManus, Deputy Director, PBZ
Department, John Jackson, Assistant Director, Department of Public Works and one
professional from County staff: Margot Ammidown, Metro -Dade County Historic
Preservation Division.
The Competitive Selection Committee will be constituted of Sergio Rodriguez,
Assistant City Manager/Director, PBZ Department, (or his designee), Chairman John
Jackson, Margot Ammidown, Santiago Jorge -Ventura, Deputy Director, PBZ Department
(or his designee), and Carlos Garcia, Finance Director (or his designee), and the
following members from Coconut Grove: Mike Samuels, Denise Wallace, Nancy
Benouaich, Bob Fitzsimmons, Tucker Gibbs, David Gell, Joyce Nelson, Elizabeth
Guyton, Jim McMaster, Yaromir Steiner, Pan Courtelis, Yvonne McDonald, John
Riordan, Esther M. Armbrister and Richard Curry.
The Competitive Selection Committee will present its recommendation, in rank
order, to the City Commission in November.
A contract will be negotiated with the selected consulting firm or if
negotiations are unsuccessful, with the second and third ranked firm
respectively. The contract will they be brought back to the Commission for
approval.

Re: Coconut Grove Planning Study
Dear Mayor, Vice Mayor and members of the Commission:
We, the undersigned members of the Coconut Grove Planning Study
Committee strongly urge you to place on the June 29 agenda and to pass the
attached amended resolution which by City of Miami Motion 93-211 (and in
accordance with the City Managers' memo dated May 13, 1993) expresses the
fallowing intent:
" - expresses the Commission's desire to enter into a contract with the
Cocoanut Grove Village Council by which the Village Council will
be in charge of consultant selection, approval of payments to
consultants and making a final recommendation;
- states that the study should include the entire Grove and meet State
requirements;
Identifies $100,000 from the General Fund -Special Programs and
Accounts as the source of funding for the study, and
- retains to the Commission (and City Administration) the control of
funds, approval of all invoices for payments and approval of the
final report far final payment (not for context). "
A broad spectrum of the entire Coconut Grove Community, led by the
Cocoanut Grove Village Council and The Coconut Grove Chamber of
Commerce as well as other groups and individuals (evidenced below) have
joined forces in order to work together toward this important goal.
We urge you to support this tong needed study, and we look forward to
working with you and City At*don to design a better Coconut Grove.

A RESOLUTION RATIFYING MOTION 93-211, PASSED MARCH 25,I9931
AND AGREEING TO ENTER INTO AN AGREEMENT WITH THE COCOANUT
GROVE VILLAGE COUNCIL, INC. FOR THE PREPARATION OF THE
COCONUT GROVE PLANNING STUDY; DIRECTING THE PREPARATION
OF SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY; AND SETTING FORTH CERTAIN PROVISIONS TO BE
INCLUDED IN THE AGREEMENT, WHICH SHALL BE SUBJECT TO CITY
COMMISSION REVIEW AND APPROVAL PRIOR TO SUBMISSION TO THE
COCOANUT GROVE VILLAGE COUNCIL, INC.
WHEREAS, BY MOTION 93-211, PASSED MARCH 23, 1993, THE
CITY COMMISSION AUTHORIZED AND DIRECTED THE CITY MANAGER TO
IDENTIFY $100,000 FOR PURPOSES OF HIRING OUTSIDE
CONSULTANT(S)TO CONDUCT A PLANNING STUDY FOR THE COCONUT
GROVE AREA; AND
WHEREAS, THE CITY COMMISSION FURTHER STIPULATED THAT
THE CITY COMMISSION SHALL HAVE CONTROL OF SAID MONIES; AND
WHEREAS, THE CITY MANAGER WAS DIRECTED TO WORK JOINTLY
WITH THE COCONUT GROVE VILLAGE COUNCIL, INC., REGARDING SAID
STUDY, AND TO COME BACK WITH A PROPOSED AGREEMENT FOR CITY
COMMISSION CONSIDERATION; AND
WHEREAS THE CITY COMMISSION WISHES TO DESCRIBE THE
TERMS OF SAID AGREEMENT;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAM1, FLORIDA;
SECTION 1. THE RECITALS AND FINDINGS CONTAINED IN THE
PREAMBLE TO THE RESOLUTION ARE HEREBY ADOPTED BY REFERENCE
THERETO AND INCORPORATED HEREIN AS IF FULLY SET FORTH IN
THIS SECTION.
SECTION 2. MOTION 93-211, PASSED MARCH 25, 1993, BY
THE CITY COMMISSION IS HEREBY RATIFIED AND RECONFIRMED, WITH
MODIFICATIONS AS MAY APPEAR HEREIN.
SECTION 3. IT IS THE INTENT OF THE CITY COMMISSION TO
PROVIDE FOR THE RETAINING OF OUTSIDE CONSULTANTS TO CONDUCT
A PLANNING STUDY FOR THE COCONUT GROVE AREA OF THE CITY OF
MIAMI ("STUDY").
SECTION 4. TO EFFECTUATE THE AFOREMENTIONED STUDY, THE
CITY COMMISSION HEREBY AGREES�TO ENTER INTO AN AGREEMENT
WITH THE COCOANUT CROVE VILLAGE COUNCIL, INC. RELATIVE TO
THE RETENTION OF SAID CONSULTANTS AND THE INTENDED STUDY
("AGREEMENT").
SAID AGREEMENT SHOULD CONTAIN, BUT IS NOT LIMITED TO,
THE FOLLOWING PROVISIONS:
(A) SHOULD PROVIDE THAT THE COCOANUT GROVE VILLAGE
COUNCIL,INC. SHALL BE RESPONSIBLE FOR THE SELECTION OF
CONSULTANTS, EXECUTION OF A COCOANUT GROVE VILLAGE COUNCIL,
INC./CONSULTANT CONTRACT, APPROVAL OF CONSULTANT INVOICES,
AND A FINAL RECOMMENDATION TO THE CITY COMMISSION ON THE
COMPLETED STUDY.
(B) SHOULD PROVIDE THAT THE PROPOSED STUDY SHALL
INCLUDE ALL OF COCONUT GROVE, AS BOUNDED BY RICKENBACKER
CAUSEWAY, FEDERAL HIGHWAY, US 01-SOUTH DIXIE HIGHWAY, THE
CITY LIMITS ON THE SOUTH AND WEST, AND BISCAYNE BAY, AND

THAT SAID STUDY SHALL BE INTENDED TO SATISFY THE
REQUIREMENTS OF COMPREHENSIVE PLANS AS DESCRIBED IN CHAPTER
163, FLORIDA STATUTES.
(C) SHOULD INDICATE A TIME FRAME OF EICNTEEN (I8)
MONTHS: TWELVE (12) MONTHS FOR THE STUDY AND SIX (6) MONTHS
TO ALLOW TIME FOR ANY PROPOSED AMENDMENTS TO THE MIAMI
COMPREHENSIVE NEIGHBORHOOD PLAN 1999-2000 TO BE PROCESSED
PER THE TERMS OF CHAPTER 163, FLORIDA'STATUTES.
(0) SHALL RETAIN TO THE CITY COMMISSION (AND CITY
ADMINISTRATION) FULL CONTROL OF FUNDS, PAYMENTS TO THE
CONSULTANT(S), AND APPROVAL OF THE FINAL REPORT GENERATED BY
THE STUDY ONLY FOR FINAL PAYMENT, AND NOT FOR CONTEXT.
