A RESOLUTION WAIVING BY 4/6THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, THE PROHIBITION CONTAINED IN CITY CODE SECTION 2-302 AS SUCH PROHIBITION APPLIES TO T. WILLARD FAIR, WHO LAST SERVED AS A MEMBER OF THE GENERAL EMPLOYEES' AND SANITATION EMPLOYEES' RETIREMENT TRUST ON SEPTEMBER 1, 1993, IN RELATION TO THE URBAN LEAGUE OF GREATER MIAMI, INC., OF WHICH T. WILLARD FAIR, IS PRESIDENT, PROVIDING RECREATIONAL PROGRAMMING, AFFORDABLE DAY CARE SERVICES, MAINTENANCE AND OPERATION OF THE CITY -OWNED PROPERTY KNOWN AS AFRICAN SQUARE PARK LOCATED AT 1400 MARTIN LUTHER KING, JR. BOULEVARD (NORTHWEST 62ND STREET), MIAMI, FLORIDA. WHEREAS, T. Willard Fair last served as a member of the General Employees' and Sanitation Employees' Retirement Trust on September 1, 1993, and is President of the Urban League of Greater Miami, Inc.; and WHEREAS, the Urban League of Greater Miami, Inc. is seeking to provide programmed activities and affordable day care services to residents in and around the Orange Heights neighborhood and throughout the City of Miami through recreational programming, maintenance and operation of the City -owned property known as African Square Park, located at 1400 Martin Luther King, Jr. Boulevard (Northwest 62nd Street), Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COI MSSION MEETING Op ACT 14 1993 11"Wutlon 140. 93- caps. Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The waiver set forth in Section 3 hereof is based upon the recitals and findings contained in Section 1 hereof and upon the following findings: (a) The City of Miami desires to enter into a Revocable Permit with the Urban League of Greater Miami, Inc., T. Willard Fair, President, to provide program activities and affordable day care services to the residents in and around the Orange Heights neighborhood and throughout the City of Miami through recreational programming, maintenance and operation of the City - owned property known as African Square Park, located at 1400 Martin Luther King, Jr. Boulevard (Northwest 62nd Street), Miami, Florida, which relationship would be in violation of City Code Section 2-302 were there not a waiver of the prohibition contained in said Section 2-302. (b) The herein proposed transaction will be in the best interest of the City of Miami in providing program activities to the surrounding neighborhood of Afrioan Square Park. 93- Gel -2- Section 3. The prohibition oontained in Seotion 2-302 of the City Code is hereby waived by a 4/5ths affirmative vote of the City Commission, after a duly advertised publio hearing. Section 4. Willard Fair, who last served as a member on the General Employees' and Sanitation Employees' Retirement Trust on September 1, 1993, in relation to his providing recreational programming, affordable day care, maintenance and operation of the City -owned property known as African Square Park located at 1400 Martin Luther King, Jr. Boulevard (NW 62 Street). BACKGROUND: The Office of Asset and Grant Management in cooperation with the Department of Parks and Recreation have negotiated with the Urban League of Greater Miami, Inc, T. Willard Fair, President, an arrangement whereby the Urban League would provide programmed activities and affordable day care services to residents in and around the Orange Heights neighborhood and throughout the City of Miami through recreational programming, maintenance and operation of the City -owned property known as African Square Park. City Code Section 2-302 prohibits the transaction of business with a board member; such prohibition shall remain in effect for a period of two years following the expiration or termination of a member's term.
