RESOLUTION NO. 9 3 6 3 2
A RESOLUTION ESTABLISHING SPECIAL CHARGES,
TERMS AND CONDITIONS FOR THE USE OF CURTIS
PARK SPORTS COMPLEX AND ITS FACILITIES BY
MIAMI SENIOR HIGH SCHOOL AND/OR ANY OTHER
DADE COUNTY PUBLIC HIGH SCHOOL LOCATED WITHIN
CITY OF MIAMI CORPORATE LIMITS FOR HOME -BASED
FOOTBALL GAMES; AUTHORIZING A GRANT(S),
EFFECTIVE ONLY THROUGH OCTOBER 14, 1993, IN
AN AMOUNT NOT TO EXCEED $4,000, TO COVER
TICKET SURCHARGE COSTS FOR THE FIRST FOUR
FOOTBALL GAMES, CONTINGENT UPON SAID GRANT(S)
NOT EXCEEDING $1,000 FOR EACH OF THE FOUR
GAMES; ALLOCATING FUNDS THEREFOR FOR SAID
GRANT, IN AN AMOUNT NOT TO EXCEED $4,000,
FROM FY '93-94 SPECIAL PROGRAMS AND ACCOUNTS,
CONTINGENT FUND; AND AUTHORIZING THE CITY
MANAGER TO ISSUE PARK PERMIT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PURPOSE(S).
WHEREAS, the Parks and Recreation Department is responsible
for the operation of the Curtis Park Sports Complex and
facilities, and to secure the presentation of athletic events for
the community; and
WHEREAS, Miami Senior High School ("School") requested use
of the Curtis Park Sports Complex for the upcoming football
season, for a total of six (6) football games to be held on
September 3 and 10, October 1, 8, 15 and 22, 1993; and
WHEREAS, the Administration recommends that special charges,
terms and conditions for the use of said stadium would be
appropriate for said request; and

WHEREAS, the School shall be required to pay fees as
follows: stadium use fee of $450, press box rental of $50,
lights at $30 per hour, and all costs for personnel as determined
by the City's Parks and Recreation Department; and
WHEREAS, the School shall pay a flat $150 fee per game for
concession rights for the first three (3) scheduled games; and
WHEREAS, the City shall review revenues from said concession
rights after the third game, and at the discretion of the City
Manager, the concession fees for the remaining three games may be
adjusted; and
WHEREAS, the School shall provide all necessary personnel
and security to facilitate parking and traffic for each event, at
its sole cost and expense and, should the School elect to charge
the public for parking in designated City parking lots, said
charge shall be $2 per car of which the City shall receive a
return of $0.75 for each vehicle; and
WHEREAS, the School shall be responsible for providing
personnel, stadium security, and field equipment required in
relation to its events, including, but not be limited to City of
Miami police, ticket sellers and takers, public address
announcer, concession personnel and parking personnel; and
WHEREAS, the School shall be responsible for providing all
required insurance, naming the City as an additional insured; and
WHEREAS, the City Commission has authorized a grant, in an
amount not to exceed $4,000, to cover ticket sucharge costs for
the first four football games, contingent upon said grant not
exceeding $1,000 for each of the four games ($0.50 ticket
surcharge for the first 2,000 tickets sold), and the School

agrees to be responsible for payment of ticket surcharge costs on
all tickets sold beyond the first 2,000; and
WHEREAS, the City Commission directed that said grant to
cover ticket surcharge costs be effective only through
October 14, 1993, and that the School be notified that as of
October 14, 1993, the School shall be responsible for paying all
applicable charges for the use of the Curtis Park Sports Complex
and all other City facilities; and
WHEREAS, the City Manager is authorized to extend the same
special charges, terms and conditions to other Dade County Public
High Schools located within the City of Miami corporate limits;
and
WHEREAS, the use arrangement described herein is recommended
by the Administration for its benefit to the community and its.
financial return to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Special charges, terms and conditions, as
more particularly set forth in Sections 1 and 3 herein, for the
use of the Curtis Park Sports Complex and its facilities by Miami
Senior High School and/or any other Dade County Public High
School located within the City of Miami corporate limits for
home -based football games are hereby authorized.

Section 3. A grant, effeotive only through October 14,
1993, in an amount not to exceed $4,000, is hereby authorized to
cover ticket surcharge costs for the first four football games,
contingent upon said grant(s) not exceeding $1,000 for each of
the four football games, with funds therefor for said grant
hereby allocated from FY 193-94 Special Programs and Accounts,
Contingent Fund.
Section 4. The City Manager is hereby authorized to
issue a park permit(s)-`/, in a form acceptable to the City
Attorney, to Miami Senior High School and/or any other Dade
County Public High School located within the City of Miami
corporate limits, for said purpose(s).
Section 5. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached
Resolution ratifying the City's Manager's actions establishing special terms
and conditions for games to be played during the 1993 football season at
Curtis Park Sports Complex by Miami Senior High School or any other Dade
County Public High School within City of Miami corporate limits, and
authorizing the execution of the necessary permits for this purpose.

Recently, the Parks and Recreation Department concluded discussions with
representatives of Miami Senior High School regarding appropriate fees and
charges for the use of the Curtis Park Sports Complex for its 1993 football
season. The school has requested a total of six (6) dates for its football
games: September 3 and 10, October 1, 8, 15 and 22, 1993. As your are
aware, in past years, the school's games were played at the Orange Bowl.
Due to the fact that this is a brand new facility with amenities completely
unlike those at any other City park, we made the necessary modifications to
the customary teams, conditions and fees applicable to events held in City
parks. At the time of this writing, the latest revenue projection to the
city from this activity is $800 per game consisting of $450 in stadium usage
fee, $150 flat concession fee, $50 press box rental charge, and an estimated
$150 in parking revenues. It should be noted that this resolution provides
for the concession fee to be reviewed after the third football game and
authorizes the city manager to renegotiate it should we determine the
potential revenue from this source to be more lucrative for the city.
Additionally, the parking fee above is an estimate based on the city
receiving $0.75 per car for an average of 200 cars per game.
As it has in prior years, the school is requesting that funds be allocated
from Special Programs and Accounts Contingent Fund in an amount not to exceed
$1,000 per game to cover the $0.50 ticket surcharge due for the first 2,000
tickets sold. It would then be responsible for paying the surcharge on the
tickets sold beyond the first 2,000. In prior years when the school played
at the Orange Bowl, city funds in an amount not to exceed $2,500 per game
were allocated to cover surcharge and other event related costs. Although
the city funds required to cover the applicable ticket surcharge for Miami
High School games will not exceed $6,000 ($1,000 per game), an amount not to
exceed $10,000 is being requested in case any other high school within the
city's corporate limits choose to play at this facility. This resolution
authorizes us to offer the same terms and conditions to any such high school.

In the attached August 31, 1993 memorandum, I advised you of my intent to
authorize said activities at Curtis Park Sports Ccmmplex under the above
mentioned fees and conditions. Sufficient time did not exist for us to
complete the required negotiations and to prepare the necessary legislation
for City Commission approval prior to the first scheduled game on September
3, 1993.
This proposal is recommended because it offers a much needed revenue source
for the City without exposure to risk. Additionally, since these games
usually attract from 2,000 to 3,000 people it makes a lot more economic sense
to have them played at a smaller stadium than to have to open up a major
facility such as the Orange Bowl. Finally, the games will increase the
public's exposure to the newly renovated Curtis Park, providing a "hone"
stadium for one of the local high schools located within the City of Miami
corporate limits.

The Parks and Recreation Department has recently concluded
discussions with representatives of Miami Senior High School
regarding appropriate fees and charges for the use of the Curtis
Park Sports Stadium for the upcoming football season. The
school has requested a total of six (6) dates for its football
games: September 3 and 10, October 1, 81 15 and 22, 1993. As you
are aware, in past years, these games have been played at the
Orange Bowl.
Due to the fact that this is a brand new facility with amenities
completely unlike those at any other City park, we have negotiated
the fee schedule stipulated below and summarized in the attachment.
It should be noted that in past years, Miami High School paid up to
$2,000 per game played at the Orange Bowl. At the same time, a
City grant in an amount not to exceed $2,500 per game was provided
to cover expenses and ticket surcharge in excess of the amount paid
by the school. For the upcoming season, Miami High Schuol would be
requesting a city grant not to exceed $1,000 per game to cover the
$0.50 ticket surcharge due for the first 2,000 tickets sold. It
would then be responsible for paying the ticket surcharge on all
tickets sold beyond the first 2,000.

,otherwise from your respective offices, by 12:00 Noon on Thursday,
Hegt@mber 2, 1993, I will assume your initial approval and
proceed with this action accordingly, including the execution of
required permits/ agreements. I will then proceed to place this
item on the next available commission agenda for formal "after
the fact" approval by the City Commission. Miami High School has
been advised that all of these terms are subject to the final
approval of the City Commission.

Pre-Recauisites
APPLICATION: Schools must complete permit application form
in its entirety.
2.
LIABILITY INSURANCE: School must submit comprehensive
liability insurance in the amount of $1,000,000. The City

of Miami must be named as an additional insured. Said
insurance must meet the City's guidelines as to type of

coverage and rating of insurance. company. If concession
stand is used, Products Liability must be included.
3.
POLICE: School must hire police for each game, arrangements
to be made at least one week in advance. Payment of Police
personnel is Schools' responsibility.
4.
PAYMENT: School must pay all specified required fees and
charges prior to the issuance of any permit, and not later
than one week prior to each game.
Special Conditions
1. USE FEE: School shall pay a flat use fee of $450 per game.
Attendance is estimated at 2,000 to 3,000 for Miami High
football games.
2. ADMISSION: School shall have right to charge customary
admission to each game, at $4 per person.

TICKET SURCHARGE: Section 53-1 of the City Code requires a
$0.50 ticket surcharge on each paid admission. (Section
30-1 requires, in addition to a use fee, payment equal to
10% of ticket sales for recreational facilities.) Miami

High School has requested a grant to cover the required
'
surcharge for up to 2,000 paid admissions which would amount
to $1,000 per game. The grant request is for an amount not
to exceed $1,000 for each of the six (6) games for a total
of $6,000.
4.
EQUIPMENT PROVIDED BY SCHOOL: School is responsible for
providing all field equipment including but not limited to:
down markers, yard sticks, and water coolers.
5.
PERSONNEL PROVIDED BY SCHOOL: School is responsible for
providing ticket takers and sellers, public address
announcer, scoreboard operator and any other personnel which
they may require, at school's own cost and expense.
6.
PERSONNEL PROVIDED BY CITY: City shall assign one facility
supervisor/technician, one or more facility attendants,
and/or other staff as deemed necessary by the Parks and
Recreation Department, with all fees to be paid by School.
7.
CLEAN-UP: School must reimburse City all staff expenses for
the complete clean-up of the facility after each game. This
shall be paid within ten (10) days after each game.
8.
CONCESSIONS: School must pay a flat $150 fee per game for
concession rights for the first three (3) scheduled games.
Gross revenue from concessions shall be reviewed by City and
the concession fee may be adjusted by the City Manager.
9.
PRESS BOX: School shall pay a $50 per game fee for use of
the press box.
10.
LIGHTING/ELECTRICITY: School shall pay for stadium electric
consumption at a rate of $30 per hour when field lights are
used.

11. SECURITY: School shall be responsible for paying costs for
required City of Miami Police Department off -duty officers.

12. PARKING: School shall provide all necessary personnel and
