WHEREAS, the Miami Zoning Board at its meeting of September 20, 1993, Item No. 8, adopted Resolution ZB 89-93 by a nine to zero (9-0) vote, granting a special exception, as CZTy connzr.ssraN SFP 7 t09 Resolution No. hereinafter set forth, subject to the approval of the City Commission; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Zoning Board's decision to grant a special exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, Schedule of District Regulations, C-1 Restricted Commercial, Conditional Accessory Uses, to allow a drive -through facility for a financial institution, subject to reservoir requirements established in Section 931.2 of said Zoning Ordinance, for the property located at 5800 Northwest 7th Avenue, Miami, Florida, also described as Tract 1, Dade Federal Edison Center, as recorded in Plat Book 66 at Page 7 of the Public Records of Dade County, Florida, and Tract 3, Dade Federal Edison Center, as recorded in Plat Book 67 at Page 15 of the Public Records of Dade County, Florida, as per plans on file; zoned C-1 Restricted Commercial for the east portion and zoned R-3 Multifamily Medium - Density Residential for the west portion of the subject property, is hereby affirmed and the special exception .is hereby granted, subject to the following conditions: 1) clear and adequate signage, approved by the City, must be provided indicating direction of traffic circulation for the drive -through and parking areas within the site; and 2) applicant must construct the portion of the "Edison Gateway Street Improvements", specifically prepared by the City of Miami Department of Public Works, along the Northwest 7th Avenue frontage of the subject property; said special exception having a time limitation of twelve (12) months in which a building permit must be obtained. Therefore, I respectfully requested of Mr. Sergio Rodriguez that a clarifying memorandum be sent to us outlining the rationale behind the inclusion of said conditions in the final version of the adopted Resolution. 4 The above -cited memorandum from Mr. Rodriguez is hereby made a part of the official backup paperwork covering said agenda item. The strongest point to be made is that, during the writer's career in the City of Miami, a period of ten years, the Commission has always included Planning, Building and Zoning Department conditions, unless a Commissioner specifically modifies or rejects a condition. 2. The agenda page for this item states "RECOMMENDATIONS: PLANNING, BUILDING AND ZONING: Approval with Conditions". The Zoning Fact Sheet (1st page) for Item PZ-1 repeats the same recommendation and in the ANALYSIS states the two conditions. (Please refer to attachments) 3. The minutes show that the Commission was fa,ii1iar with the item. The Mayor considered it to be non -controversial and without opposition. Representatives of Great Western were present, they expressed no opposition. (See attachments) 4. The draft City Commission resolution was prepared in blank on August 30tn to meet the 30 day advertising deadline; the Zoning Board then made the recommendation at their night meeting of September Z0, too late to modify the draft legislation in the agenda package which had to be ready for printing and distribution to the Commission to meet the "5-day rule".
