A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI AND THE EMPLOYEE ORGANIZATION KNOWN AS THE FRATERNAL ORDER OF POLICE, WALTER E. HEADLEY, JR. MIAMI LODGE NO. 20, FOR THE PERIOD OF OCTOBER 1, 1993 THROUGH SEPTEMBER 30, 1995. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized-/ to enter into a Collective Bargaining Agreement, in a form acceptable to the City Attorney, between the City of Miami and the employee organization known as the Fraternal Order of Police, Walter E. Headley, Jr. Miami Lodge No. 20, for the period of October 1, 1993 through September 30, 1995. Section 2. Headley, Jr., Miami Lodge No. 20 for the period of October 1, 1993 through September 30, 1995 per the attached resolution. BACKGROUND: Under Florida Statutes, Chapter 447, the City is required to bargain collectively with the certified bargaining representatives of the police bargaining unit, the Fraternal Order of Police, Lodge No. 20. The City and the Fraternal Order of Police, Lodge No. 20 representatives have been meeting since May, 1993 in an effort to reach an agreement acceptable to both sides. As a result of those negotiations, the City and the Fraternal Order of Police, Lodge No. 20 have agreed to a two year labor agreement. This agreement provides for In FY 93-94 a 0% wage Increase, a one year retroactive 5% pay increase upon retirement and the assignment of a 24 hour take home vehicle to all bargaining unit members over a 3 year period. In FY 94-95, the agreement provides for a 0% wage Increase and a 2 1/2% longevity step increase on the employee's sixteenth and twenty --first year of service. Contingent upon the Gates modification being approved by the Court, projected for January 1, 1994, the employee pension contribution will be Increased from 8.5% to 10% and the pension multiplier will be increased from 2.75% to 3% for each year of service in excess of 15 service years. Other items negotiated include the requirement of residency for new hires at time of hire; the application of the Family and Medical Leave Act; agreement for the City to take all actions necessary to comply with the provisions of the Americans with C79O!/ 93— 607 4 Honorable Mayor and Members of the City Commission Page 2 of 2 Disabilities Act; replacement of sick leave payoff caps with 10096 payment up to 750 hours and 60% payment of remaining hours; and the application of supplementary salary for a line of duty Injury for a period of 120 days which may be extended for an additional 60 days. The Group Insurance Article remains open while the parties continue to negotiate premium Increases and plan design change. 1 The City has also agreed to continue negotiations on a plan to allow retiring employees to place their severance pay in a City account for the purpose of paying health premiums with pretax i dollars.
