"'� A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI AND THE EMPLOYEE ORGANIZATION KNOWN AS THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, AFL-CIO, LOCAL 587 FOR THE PERIOD OF OCTOBER 1, 1993 THRdUGH SEPTEMBER 30, 1995. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorizedl/ to enter into a Collective Bargaining Agreement, in a form acceptable to the City Attorney, between the City of Miami and the employee organization known as the International Association of Firefighters, AFL-CIO, Local 5871, for the period of October 1, 1993 through September 30, 1995. Section 2. This Resolution shall become effective immediately upon its adoption. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. BACKGROUND: Under Florida Statutes, Chapter 447, the City is required to bargain collectively with the certified bargaining representatives of the fire bargaining unit, the International Association of Firefighters, Local 587. The City and the International Association of Firefighters, Local 587 representatives have been meeting since April, 1993 in an effort to reach an agreement acceptable to both sides. As a result of those negotiations, the City and the International Association of Firefighters, Local 587 have agreed to a two year labor agreement. This agreement provides for in FY 93-94 -a'-%- wage increase, and a one year retroactive 5% pay increase upon retirement. In FY 94-95, the agreement provides for a 1% across- the-board increase October 1, 1994, a 1% across-the-board Increase April 1, 1995, and a 2 1/2% longevity step increase on the employee's sixteenth and twenty-first year of service. Employees who are certified and assigned to the Hazardous Materials team, the SWAT team, the Dive team, the Fire Training Center as an Instructor, or the Fire Prevention Bureau as a Fire Inspector will receive a 1.5% salary increase. Employees who are certified as an EMT will receive a 1.5% salary increase and an additional 5% salary increase if assigned to Rescue. Employees assigned as a Station Commander will receive a 1% salary increase. Contingent upon the Gates modification being approved by the Court, projected for January 1, 1994, the employee pension contribution will be increased from 8.5% to 10% and the pension lH Honorable Mayor and Members of the City Commission Page 2 of 2 multiplier will be Increased from 2.75% to 3% for each year of service in excess of 15 service years. Other items negotiated include the requirement of residency for new hires at time of hire; the application of the Family and Medical Leave Act; agreement for the City to take reasonable steps to comply with the provisions of the Americans with Disabilities Act; replacement of sick leave payoff caps with 100% payment up to 1,200 hours and 50% payment of remaining hours; the application of supplementary salary for a line of duty injury for a period of 150 consecutive days which may be extended for an additional 60 days; reducing the number of hours from 6 hours to 4 hours an employee must work to receive Working Out of Classification pay; providing for promotional registers to remain In effect for two years and retroactive pay upon promotion beginning 31 days from the effective date of the vacancy; and specified staffing of Rescue and Fire Apparatus if less than six employees are on sick leave during a tour of duty. The Group Insurance Article remains open while the parties continue to negotiate premium increases and plan design change. The City has also agreed to continue negotiations on a plan to allow retiring employees to place their severance pay in a City account for the purpose of paying health premiums with pretax dollars. With regard to two articles of major concern to the IAFF, Local 587 and the City of Miami, Discrimination and Prevailing Benefits, the parties have brought closure to a section in each Article which remained open in previous contracts. in accordance with Article 4 - Discrimination, Section 4.4, "The City and Union agree to support Affirmative Action programs and any mandates of a court of proper jurisdiction that are designed to bring minority candidates up to the standard required for the Fire service or other such programs which are consistent with applicable law." Under Article 5 - Prevailing Benefit, Section 5.4, the City and the Union agreed that "nothing in this Article shall prevent the City from implementing the terms of the current Consent Decree..."
