A RESOLUTION, WITH ATTACHMENTS, APPROVING THE
FUNDING OF FIVE NOT -FOR -PROFIT ORGANIZATIONS
("SERVICE PROVIDERS"), AS HEREIN SPECIFIED,
FOR THE PURPOSE OF PROVIDING ASSISTANCE TO
PERSONS WITH HIV/AIDS OR RELATED DISEASES;
ALLOCATING FUNDS THEREFOR FROM THE HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA")
PROGRAM GRANT; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE THE AGREEMENTS, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH
METROPOLITAN DADE COUNTY AND SAID SERVICE
PROVIDERS TO IMPLEMENT SAID PROGRAM.
WHEREAS, the Housing Opportunities for Persons With AIDS
(HOPWA) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
of 1992; and
WHEREAS, in February, 1993, the City responded to U.S.
Department of Housing and Urban Development (HUD) Notice of
Funding Availability for fiscal year 1993 HOPWA Program funding,
on behalf of, and in conjunction with Dade County and the cities
of Hialeah and Miami Beach, and local area AIDS service
providers; and
WHEREAS, in April, 1993, the City received notice of funding
approval from HUD under the HOPWA Program in the amount of
$4,697,000; and

WHEREAS, pursuant to Resolution No. 93-287, ad.opted May 13,
1993, the City Commission authorized the City Manager to accept
the HOPWA Program Grant in the amount of $4,697,000 and to enter
into agreements for the implementation of the HOPWA Program,
subject to City Commission approval; and
WHEREAS, on June 28, 1993, the City advertised in local area
newspapers soliciting applications from not -far -profit sponsors
for the purpose of providing housing related assistance to
persons with HIV/AIDS or related diseases in connection with the
HOPWA Program; and
WHEREAS, on August 16, 1993, funding request proposals under
the HOPWA Program were received by the City; and
WHEREAS, on August 18, 1993, the HOPWA Working Advisory
Group, consisting of representatives of Dade County, the cities
of Hialeah, Miami, Miami Beach, and various local area Service
Providers to persons affected by AIDS, reviewed the proposals and
made recommendations for funding the various organizations in the
amounts as stated in Section 2 of this Resolution; and
WHEREAS, on September 27, 1993, the Miami City Commission
designated an additional service provider to receive said funding
and increased the funding allocation for Christian Community
Service Agency by $45,400 as indicated in Section 2 of this
Resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby approves the
following Service Providers for funding, in the amounts listed
below, for the provision of housing related services to persons
with HIV/AIDS, or related diseases:

Section 3. The City Manager is hereby authorized to
execute agreements, in substantially the attached form, with
Metropolitan Dade County and the hereinabove Service Providers to
implement said program, with funds therefor hereby allocated from
the HOPWA Program Grant.
Section 4. This Resolution shall become effective
immediately upon its adoption.

THIS MEMORANDUM OF AGREEMENT ("Agreement") is entered into
this day of , 1993, by and between the City
i
of Miami, a municipal corporation of the State of Florida (the
"City"), and
a
Florida not for profit corporation, whose address is
and whose
telephone number is (hereinafter "Sponsor"), both
of which understand and agree as follows:
WITNESSETH:
WHEREAS, the Housing Opportunities for Persons With AIDS
(HOPWA) Program was created under the AIDS Housing Opportunity
Act, and revised under the Housing and Community Development Act
of 1992; and
WHEREAS, the United States Department of Housing and Urban
Development (USHUD) published its Notice of Funding Availability
for the HOPWA Program,. for fiscal year 1993, in the Federal
Register on December 28, 1992; and
WHEREAS, the interim rule (24 CFR Part 574.100 Subpart B)
stipulates that the most populous unit of general local
government in an Eligible Metropolitan Statistical Area (EMSA),
not including county government, be the applicant for this

formula allocation grant; and
WHEREAS, in Dade County, the City is the most populous city,
and thereby the designated applicant for the 1993 HOPWA Program
funds for the EMSA; and
WHEREAS, the City's Department of Development and Housing
Conservation, on behalf of the cities of Hialeah, Miami, Miami
Beach, and Dade County applied for and received notice of an
award of $4,697,000 in HOPWA Program funds for fiscal year 1993;
and
WHEREAS, through Resolution No. 93-287, the City Commission
authorized the City Manager to accept the HOPWA Grant from USHUD
and to execute the necessary agreements with housing related
service providers, subject to City Commission approval and
applicable City Code provisions; and
WHEREAS, on July 22, 1993, the City Commission adopted
Ordinance Number 11075, which established and appropriated the
$4,697,000 in 1993 HOPWA Program funds; and
WHEREAS, on , 1993, the City Commission
through Resolution No. 93- authorized the City Manager to
execute all necessary documents, and amendments thereto, in order
to implement an agreement with the Sponsor for the provision of
services to persons with HIV/AIDS or related diseases, in an
amount not to exceed

WHEREAS, both parties are agreeable to the terms and
conditions set forth herein;

NOW, THEREFORE, in consideration of the promises and the
mutual covenants and obligations herein contained, and subject to
the terms and conditions hereinafter stated, the City and the
Sponsor do mutually agree as follows:
Section 1: Definitions
For the purposes of this Agreement the following names shall
be abbreviated and terms shall be defined as follows:
CFR - Code of Federal Regulations.
DDHC - the City's Department of Develoment and Housing
Conservation.
EMSA - Eligible Metropolitan Statistical Area, encompassing
the cities of Hialeah, Miami, Miami Beach, and Dade County
(i.e., all of Dade County).
HOPWA - the Housing Opportunities for Persons With AIDS
Program.
HOPWA Regulations - regulations promulgated by USHUD for the
HOPWA Program 24 CFR Part 574; Interim Rule, and any
subsequent changes thereto.
Low Income - Individuals and families whose gross income
does not exceed 80% of the area median income for the PMSA,
as determined by USHUD, as of a specific effective date.
Section 2: Time of. Performance
The term of this Agreement shall begin on the above date;
and, will end approximately 365 days thereafter, or on the
date on which the final disbursement from the City to the
Sponsor occurs, the later thereof.

Section 3s Scope of Serviceg
3.1 Sponsor agrees to perform services as delineated in
its application to the City for HOPWA funding. Said
application is attached hereto and is hereby made a part of
this Agreement as Addendum 1. Sponsor agrees to fulfill its
obligations within 365 days of the above date.
3.2 City agrees to disburse HOPWA funds to the Sponsor on
a basis and in accordance with the budget included
in Addendum of this Agreement; provided the Sponsor has
complied with all terms and conditions of this Agreement
applicable to the specific services and time period for
which the disbursement is requested. The total disbursed
pursuant to this Agreement shall not exceed

3.3 Any adjustments or modifications to Addendum must be
agreed to in writing by the Sponsor and the City Manager, or
his designee.
Section 4s General Conditions
4.1 All notices or other communications which shall or may
be given pursuant to this Agreement shall be in writing and
shall be delivered by personal service, or by registered
mail, addressed to the other party at the address indicated

herein, or as the same may be changed from time to time.

Such notice shall be deemed given on the day on which
personally served; or, if by mail, on the fifth (5th) day
after being posted or the date of actual receipt, whichever
is earlier.

j 4.2 Title and paragraph headings are for convenient
reference and are not a part of this Agreement.
4.3 In the event of any conflict between the terms of this
Agreement and any terms or conditions contained in any
attached documents, the terms in this Agreement shall rule.
4.4 No waiver or a breach of any provision of this
Agreement shall constitute a waiver of any subsequent breach

of the same or any other provision hereof, and no waiver
shall be effective unless made in writing.
4.5 Should any provision, paragraphs, sentences, words or
phrases contained in this Agreement be determined by a court

of competent jurisdiction to be invalid, illegal, or

otherwise unenforceable under the laws of the State of
Florida or the City of Miami, such provisions, paragraphs,
sentences, words or phrases shall be deemed modified to the
extent necessary in order to conform with such laws, or if
not modifiable to conform with such laws, then same shall be
deemed severable, and in either event, the remaining terms
and provisions of this Agreement shall remain unmodified and
in full force and effect.
( 4.6 City Manager hereby authorizes the Director of the
DDHC to act as his designee in connection with this
Agreement.

4.7 Sponsor hereby designates
to act on its part in connection with this Agreement.
Section 5: Ownership of Documents.
5.1 All documents developed by the Sponsor under this
Agreement shall be delivered to the City by the Sponsor upon
completion of the activities required pursuant to Addendum
hereof and shall become the property of the City, without
restriction or limitation on its use. Sponsor agrees that
all documents maintained and generated pursuant to this
contractual relationship between the City and the Sponsor
shall be subject to all provisions of the Public Records
i Law, Chapter 119, Florida Statutes.
5.2 It is further understood by and between the parties
that any information, writings, maps, contract documents,
reports or any other matter whatsoever which is given by the

City to the Sponsor pursuant to this Agreement shall at all
times remain the property of the City and shall not be used
by the Sponsor for any other purposes whatsoever without the
written consent of the City.
Section 6: Non-peleaability
The obligations undertaken by the Sponsor pursuant to this
Agreement shall not be delegated or assigned to any other
person or firm unless the City shall first consent in
writing to the performance or assignment of such service or
any part thereof by another person or firm.
Section 7: Audit Rights and Inspections
At any time during normal business hours and as often as the
City, USHUD and/or the Comptroller General of the United
States may deem necessary, there shall be made available to
the City, USHUD and/or representatives of the USHUD or
Comptroller General for examination all the Sponsor's
records with respect to all matters covered by this
Agreement and the Sponsor shall permit the City, USHUD
and/or representatives of the Comptroller General to audit,
examine and make audits of all contracts, invoices,
material, payroll, records of personnel conditions of
employment and other data relating to all matters covered by
this Agreement. City reserves the right to audit the
records of the Sponsor at any time during the performance of
this Agreement and for a period of one year after final
payment is made under this Agreement. The cost of said

audit shall be borne by the City. Said documents and
records shall be maintained by the Sponsor no less than
three (3) years after the termination of this Agreement. In
addition, the Sponsor shall comply with audit requirements
of 24 CFR Part 574.650.
Section 8: Award of Agreement
Sponsor warrants that it has not employed or retained any
person employed by the City to solicit or secure this
Agreement and that it has not offered to pay, paid, or
agreed to pay any person employed by the City any fee,
commission percentage, brokerage fee, or gift of any kind
contingent upon or resulting from the award of this
Agreement.
Section 9: Construction of Agreement
This Agreement shall be construed and enforced according to
the laws of the State of Florida.
Section 10: Compliance With Federal, State and Local Laws
Both parties shall comply with all applicable laws,
ordinances and codes of federal, state and local
governments.
Section 11: Successors and Assigns
This Agreement shall be binding upon the parties herein,
their successors and assigns.
Section 12: Indemnification
Sponsor and the City shall indemnify and save each other
harmless from and against any and all claims, liabilities,

losses, and causes of action which may arise out of the
Sponsor or the City activities under this Agreement,
including all other acts or omissions to act on the part of
the Sponsor, or on the part of the City, including any
person acting for or in their behalf, and, from and against
orders, judgements, or decrees which may be entered and from
against all costs, attorneys' fees, expenses, and
liabilities incurred in the defense of any such claims, or
in the investigation thereof.
I Section 13: Conflict of Interest
13.1 Sponsor convenants that no person under its employ who
presently exercises any functions or responsibilities in
connection with HOPWA funded activities, has any personal
financial interest, direct or indirect, in this Agreement.
The Sponsor further covenants that, in the performance of
this Agreement, no person having such conflicting interest
shall be employed. Any such interest on the part of the
Sponsor or its employees, must be disclosed in writing to
the City.
13.2 Sponsor is aware of the conflict of interest laws of
the City (City of Miami Code Chapter 2, Article V), Dade
County, Florida (Dade County Code Section 2-11-.1) and the
State of Florida, and agrees that it shall fully comply in
all respects with the terms of said laws.
Section 14: Independent Contractor
Sponsor, its employees and agents shall be deemed to be
independent contractors, and not agents or employees of the
City, and shall not attain any rights or benefits under the
Civil Service or pension Ordinances of the City, or any
rights generally afforded classified or unclassified
employees; further they shall not be deemed entitled to the
Florida Workers' Compensation benefits as an employee of the
City.
Section 15: Termination of Contract
15.1 This Agreement may be terminated for cause by either
party at any time upon submission of thirty (30) days
written notice.
15.2 City Manager and the Sponsor's designee for the
Sponsor, shall make the determination whether there is
sufficient cause to terminate this Agreement.
Section 16: Non -Discrimination
16.1 Sponsor agrees that it shall not discriminate as to
race, sex, color, creed, national origin, or handicap in
connection with its performance under this Agreement.
16.2 Furthermore that no otherwise qualified individual
shall, solely by reason of his/her race, sex, color, creed,
national origin, or handicap, be excluded from the
participation in, be denied benefits of, or be subjected to
discrimination under any program or activity receiving
federal financial assistance.
Section 17: Contingency Clause
Funding for this Agreement is contingent on the availability

of funds and continued authorization for Program activities
and is subject to amendment or termination due to lack of
funds, or authorization, reduction of funds, and/or changes
in regulations.
Section 18: Default Provision
In the event that the Sponsor shall fail to comply with each
and every term and condition of this Agreement or fails to
perform any of the terms and conditions contained herein,
then the City, and its sole option, upon written notice to
the Sponsor may cancel and terminate this Agreement, and all
payments, advances, or other compensation paid to the
Sponsor by the City while the Sponsor was in default of the
provisions herein contained, shall be forthwith returned to
the City.
Section 19: Entire Agreement
This instrument constitute the sole and only Agreement of
the parties hereto relating to said grant and correctly sets
forth the rights, duties, and obligations of each to the
other as of its date. Any prior agreements, promises,
negotiations, or representations not expressly set forth in
this Agreement are of no force or effect.
Section 20: Assurances, Certifications and Regulations
20.1 No person in -the United States shall, on the grounds
of race, color, creed, national origin, sex, marital status
or physical handicap, be excluded from participation in, be
denied the benefits of, or be otherwise subjected to

discrimination under this Agreement and the Sponsor shall
immediately take any measure necessary to correct any such
discrimination and to insure that such discrimination cannot
occur in the future.
20.2 The parties shall comply with the AIDS Housing
Opportunity Act of 1990, as amended, and 24 CFR Part 574;
Interim Rule, and any subsequent changes thereto.
20.3 The parties shall comply with the provisions of the
Hatch Act, as amended, January 1, 1985, which limit the
political activity of employees.
20.4 The parties shall establish safeguards to prohibit
employees from using their positions for a purpose that is
or gives the appearance of being motivated by desire for
private gain for themselves or others, particularly those
with whom they have families, business or other ties.
20.5 The parties shall comply with the following federal
regulations as they may apply to this project. The
regulations are incorporated herein and made a part of
hereof by reference:
a. Guidelines for applicants on Equal Employment
Opportunity; and
b. Office of Management and Budget (OMB) Circular A-87
"Principles for Determining Costs Applicable to Grants
and Contracts with State, Local, and Federally
recognized Indian Tribal Governments." (OMB) Circular
A-110, Attachments "A" (Cash Depositories), "B"

(Bonding and Insurance), "C" (Retention and Custodial
Requirements for Records), "F" (Standards for
Financial Management Systems), "H" (Monitoring and
Reporting Progress Performance), "N" (Property
Management Standards), and "O" (Procurement
Standards), (OMB) Circular A-122 and A-21 "Cost
Principles for Non -Profit Organizations and Cost
Principles for Educational Institutions, as modified
by 24 CFR Part 574.650.
Section 21: Amendments
No amendments to this Agreement shall be binding on either
party unless in writing and signed by both parties.
Section 22: Bonding and Insurance
22.1 Sponsor shall maintain insurance and bonding coverages
acceptable to the City's Department of Risk Management.
Prior to commencing any activity under this Agreement, the
Sponsor shall furnish to the City original certificates of
insurance and bonding indicating that the Sponsor is in
compliance with the provisions of this article.
22.2 Sponsor shall provide the following coverages:
a. Insurance coverage that reflects sound business
practices acceptable to the City's Department of Risk
Management.
b. Fidelity bonding for all persons handling funds
received or disbursed under this Agreement in an
amount equal to or greater than the amount of the City

grant. City shall be named as Loss Payee.
c. Current liability .insurance shall be in amount of not
less than $500,000 General Aggregate which shall
include Fire liability. City shall be named as
Primary Additional Insured and there shall be no
exclusions in such policies to override the City
coverage.
d. Sponsor shall provide the City with proof of
Automobile Liability Coverage in an amount of not less
than $300,000 for each driver Bodily Injury and
Property Damage combined, if the Sponsor is to be
reimbursed for mileage by the City.
e. The Sponsor shall obtain Workers' Compensation and
Employers' Liability coverage as per statutory
requirements.
22.3 Compliance with the foregoing requirements shall not
relieve the Sponsor of its liability and obligations under
this section or under any other section of this Agreement.
IT WITNESS WHEREOF, the parties hereto have caused this
instrument to be executed by the respective officials thereunto

It Is respectfully recommended that the City Commice9i.on adopt the
attached resolution authorizing the City Manager to execute
individual contractual Agreements, in substantially the form
attached, with Metropolitan Made County (Department of Human
Resources), Lock Towns Community Mental Health Center, Inc.,
Miami Coalition For The Homeless, and Christian Conmunit:y Service
Agency in connection with the provision of housing related
activities and services for individuals with HIV/AIDS or related
diseases. The attached resolution further directs the City
Manager to disburse funding in the amounts stated .in Section 2 of
the attached resolution. Funding for these services contractea is
being provided by the U.S. Department of Housing and Urban
Development in connection with the Housing Opportunities for
Persons With AIDS (HOPWA) Program (FY' 1993).
The Department of Development and Housing Conservation recommends
that the City Commission adopt the attached resolution
authorizing the City Manager to execute individual contractual
Agreements, in substantially the form attached, with Metropolitan
Dade County (Department of Human Resources), Look Towns Community
Mental Health Contort Inc., the Miami Coalition For The Homeless,
and the Christian Community Service Agency in connection with the
pprovision of housin related activities and services For
individuals with HIVJAIDS or related diseases. The attached
resolution further directs the City Manager to disburee funding
in the amounts stated in section 2 of the attached resolution.
In February of 19930 the City of Miami, on behalf of Metropolitan
Dade County and the cities of Hialeah and Miami Beach, applied
for $4,697,000 in Housing Opportunities for Persons With AIDS
(HOPWA) Program funding from U.S. HUD. In April of 1993, the
City was notified by U.S. HUD that its application for $4,697t000
in HOPWA program funding had been approved.
At the may 13, 1993 City Commission meeting, the City Commission
through Resolution No. 934287, authorized the City Manager to
accept the $4,697t000 HOPWA Grant from U.S. HUD and to execute
-the appropriate agreements with U.S. HUD in connection with the
implementation of the Housing Opportunities for Persons With AIDS
(HOPWA) Program, subject to City Commission a>Dvrovai.

In June of 1993, the Department of Development and Housing
Conservation advertised for proposals from local area AIDS
service providers/sponsors for the purpose of roviding housing
related assistance to individuals with HIVAIDS or related
diseases in connection with the HOPWA Program. 4n August. 18,
1993, the proposals submitted in response to the City's
advertisement were reviewed by the HOPWA Working IvIvisory Group,
consisting of representatives from Metropolitan Dade County, the
cities of Miami, Miami Beach, Hialeah, the Miami Coalition For
The Homeless, Cure AIDS Now, the Health Council of South Florida,
and the Dade Partnership for Community and Economic: Development.
Based on the proposals which were received and the
recommendations of the HOIPViA working Advisory Group, the
Department of Development and housing Conservation reconuaende the
following local area AIDS service providers for funding in the
amounts listed below, for the purpose of iding housing
related assistance to individuals with HIVAIDS or related

HOUSING OPPORTUNITIES FOR PERSONS
WITH AIDS (HOPWA) PROGRAM
Goal: Metropolitan Dade County's Department of Human Resources
through its Office of Community Services will provide
countywide short-term emergency housing, financial,
rental and utility assistance and supportive services to
prevent homelessness to all eligible HIV/AIDS clients.
Objective:
1.
To provide short term emergency housing (60 day max.
in a 6
month period) in apartments, ACLF's, and boarding
homes for
338 individuals with HIV/AIDS that meet eligibility
requirements.
2.
To provide rent and mortgage financial assistance (max. 21
weeks) to 236 eligible individuals as a homeless
prevention
activity.
3.
To provide temporary emergency shelter services
at Beckham

SCOPE OF SERVICES

Goal: To reduce hopelessness in the population of persons with
HIV/AIDS by providing information about available housing
options to persons with HIV/AIDS who are homeless or at risk
of becoming homeless.
Objectives:
1. Hire and train two Housing Information Specialists.
2. Develop and maintain an up to date catalogue of housing
options in Dade County.
3. Establish and publicize a 24 hour a day toll free hot line
to provide information on housing opportunities.
4. Recruit and train volunteers to assist with the housing
effort.
5. Provide housing related information to at least 4,000 per-
sons within the first year of operation.
Goal: To ensure person with HIV/AIDS are afforded equal access
to housing opportunities.
Objectives:
1. Train Housing Information Specialists in the laws related to
housing discrimination.
2. Publicize the availability of fair housing counselling and
assistance.
3. Identify sources of legal assistance for persons who have
been discriminated against because of their HIV related
condition.
4. Provide fair housing information and advocacy for at least
5,000 persons during the first year of operation.

SCOPE OF SERVICES

Goal: To increase funding resources and housing availability for
low and very low income persons with HIV/AIDS in Pade County,
Objectives:
1. Investigate other HOPWA entitlement localities to ascertain
what local, state, federal, and private funding and/or fi-
nancial leveraging techniques they have been able to develop
and channel into the provision of permanent housing for
HOPWA-eligible individuals and families. A report outlining
and evaluating the findings will be prepared and distributed
to relevant government and provider agencies.
2. Research existing literature to determine the availability
and application of non-HOPWA funds for the creation of per-
manent housing and accessing rental assistance for HOPTAA-
eligible populations. A report of the findings will be pre-
pared and distributed.
3. Technical assistance via individual consultations to Dade
County area service providers and their housing partners.
Identifying and applying for HOPWA and other grants and
resources for developing housing for the HOPWA eligible
population.
4. Detailed monitoring of resource availability, and reporting
these results to government and service provider agencies
in the Dade County area via a monthly grant alert publica-
tion. Monitoring will consist of reviewing subscriptions
and other publications, periodic special research, and at-
tendance at relevant conferences, workshops, and meetings.
5. Expansion of a resource library containing materials
relating to funding and housing models for persons with
HIV/AIDS, located at the office of the Miami Coalition For
The Homeless.
6. Monthly reports to the Housing and AIDS Workgroup on funding
opportunities, housing models, and other information rele-
vant to housing for the HOPWA-eligible population.
7. Expansion of design, implementation, and evaluation of
periodic funding and resource technical assistance workshops
and seminars for government bodies and service providers

Research and surveys will be conducted of the Resolution
Trust Corporation (RTC) and HUD foreclosed housing stock to
determine whether any such properties may be appropriate for
developing permanent housing for the HIV/AIDS population.

If appropriate, the Miami Coalition For The Homeless will
facilitate discussion and negotiations between the RTC, HUD,
the Miami Supportive Housing Corporation (a Community Hous-
ing Development Organization) and interested service pro-
viders and their housing partners to acquire such properties
10.
The Miami Coalition For The Homeless will incorporate
HIV/AIDS service providers in Project Link Up, a computer-
ized informamation/referral network currently beginning
operation for homeless service providers. HIV/AIDS service
providers interested in participating will be able to access
existing shelter and housing resources via this system. This
initiative will work closely with the HOPWA grantee for the
provision of housing information and referral services.
11.
An updated annual needs assessment of housing for persons
with HIV/AIDS will be prepared in coordination with related
agencies and distributed. This HOPWA Grant will pay for the
third annual needs assessment.
12.
Development of a five year plan, which will forecast needs,
identify, integrate, and present viable models for housing,
and their linkages to social and medical services, and re-
sources available for the accomplishment thereof.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt
the attached resolution approving the Department of General
Services Administration and Solid Waste's change from the
backyard method of collecting garbage from single and duplex
residences to a curbside collection method.
BACKGROUND
In November, 1982 the City Commission conducted a straw ballot
asking its residents if they would support curbside garbage
collection. The issue passed, however no administrative action
was ever taken to effectuate a change in the manner in which
the Solid Waste Division collected garbage from its single
and duplex residences. Resultantly, we are now, eleven years
later bringing this issue back to you to receive policy guidance
regarding this matter in light of the many changes in staffing,
tipping fees and neighborhood sentiment that have concurrently
occurred.
By changing the method of collecting garbage from the backyards
of single and duplex residences in the City, we will be able
to redirect approximately seventy-six (76) Waste Collectors
to other much needed cleaning functions such as sweeping behind
trash cranes, cleaning of litter from neighborhood streets
as White Wings and the maintenance of public rights -of -way
and swai.ls. Additionally, we anticipate a reduction in
on-the-job injuries, absences due to illness, and citizen
complaints regarding both the regularity of their garbage
collection and the manner in which their neighborhoods are
being left after garbage has been set -out by workers because
of the constant shortages in staff which have resulted from
these factors.

It is requested that you discuss the issue of residential
curbside recycling in the City of Miami.
As you will recall, on May 1, the Sanitation Employees
Association began to provide this service as an amendment to
their labor agreement. Since that time, there continue to be
major complaints from the citizens regarding this service.
There is a need to discuss a resolution to this issue.
