"`� $ 8 A RESOLUTION AUTHORIZING AN INCREASE, IN AN AMOUNT NOT TO EXCEED $5,300.00, IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA, AND LEWIS GREEN CONSTRUCTION, INC., DATED OCTOBER 16, 1991, FROM $89,700.00 TO $95,000.00, FOR THE SCATTERED SITE HOUSING - COCONUT GROVE PHASE I (THIRD BIDDING) B-3241-A, CAPITAL IMPROVEMENT PROJECT NO. 321034; AUTHORIZING AN INCREASE, IN AN AMOUNT NOT TO EXCEED $540.00, IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA, AND LEWIS GREEN CONSTRUCTION, INC., DATED OCTOBER 23, 1991, FROM $94,460.00 TO $95,000.00, FOR THE SCATTERED SITE HOUSING -MODEL CITY PHASE IV, B-3242-A, CAPITAL IMPROVEMENT PROJECT NO. 321034; AUTHORIZING AN INCREASE, IN AN AMOUNT NOT TO EXCEED $3,000.00, IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA, AND LEWIS GREEN CONSTRUCTION, INC., DATED FEBRUARY 12, 1992, FROM $92,000.00 TO $95,000.00, FOR THE SCATTERED SITE HOUSING HOME OWNERSHIP DEVELOPMENT PROGRAM-WYNWOOD, PHASE II, B-3245, CAPITAL IMPROVEMENT PROJECT NO. 321034; AUTHORIZING SAID FUNDS TO BE PROVIDED FROM CAPITAL IMPROVEMENT ORDINANCE NO. 10938 FUNDS ALREADY APPROPRIATED TO SAID PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING, BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF THE CITY COMMISSION, THAT THE HEREIN INCREASES RESULTED FROM EMERGENCY CIRCUMSTANCES. WHEREAS, there exists a contract dated October 16, 1991, between the City of Miami, Florida, and Lewis Green Construction, Inc., for Scattered Site Housing, Coconut Grove Phase I (Third Bidding), B-3241-A, Capital. Improvement Project No. 321034; and CM comnssion wEi'mTG OF { Resolution No. '�' �i x WHEREAS, there exists a contract dated October 23, 1991, between the City of Miami, Florida and Lewis Green Construction, i Inc., for Scattered Site Housing, Model City, Phase IV, B-3242-A, Capital Improvement Project No. 321034; and WHEREAS, there exists a contract dated February 12, 1992, between the City of Miami, Florida and Lewis Green Construction, Inc. for Scattered Site Housing, S ousi g, Homeownership Development Program, Wynwood Phase II, B-3248, Capital Improvement Project No. 321034; and WHEREAS, increases, in an amount not to exceed the combined total of $8,840, for all three of the aforesaid contracts are required to cover the cost of necessary extra work involving unforeseen theft, vandalism and other security problems; replacement of deteriorated sidewalk, curb and gutters not included in the original contracts; revisions to window specifications to satisfy building code requirements; clearing 1 and hauling illegally dumped debris from the project sites; S revisions to the architect's original plans for electrical service to the sites; and an increase in building material costs since the acceptance of bids by the City Commission; and 3 WHEREAS, the Director of Public Works, the Director of the i Development & Housing Conservation Department, and the City J Manager recommend the increases in said contracts to cover the additional costs; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to continue to protect the health, safety and welfare of the citizens of the City; and -2- 93- 548 WHEREAS, funs to cover the contract increases are available from monies already appropriated to the said projects; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised Public Hearing, the findings of the City Manager set forth in the Preamble to this Resolution are hereby ratified by an affirmative vote of 4/5ths of the City Commission, and are hereby incorporated by reference thereto and adopted as if fully set forth in this Section. Section 2. The contract between the City of Miami and Lewis Green Construction, Inc., dated October 16, 1991, for Scattered Site Housing, Coconut Grove, Phase I (Third Bidding), B-3241-A, Capital Improvement Project No. 321034, is hereby increased in an amount not to exceed $5,300.00 from $89,700.00 to $95,000.00, with funds for the increase to be provided from monies already appropriated to said project. Section 3. The contract between the City of Miami and Lewis Green Construction, Inc., dated October 23, 1991, for Scattered Site Housing, Model City, Phase IV, B-3242-A, Capital Improvement Project No. 321034, is hereby increased in an amount not to exceed $540.00, from $94,460.00 to $95,000.00, with funds for the increase to be provided from monies already appropriated to said project. Section 4. The contract between the City of Miami and Lewis Green Construction, Inc., dated February 12, 1992, for Scattered Site Housing, Homeownership Development Program Wynwood -3- 9 3 - � :!g Phase II, B-3245, Capital Improvement Project No. 321034, is hereby increased in an amount not to exceed $3,000.00, from $92,000.00 to $95,000.00, with funds for the increase to be provided from monies already appropriated to said project. Q TN 0 S, III CITY ATT R Y -4- 93- 548 n CITY OF MIAMI, FLORIDA 29 INTER -OFFICE MEMORANDUM To Honorable Mayor and Members of the City Commission PATE AUG 2 61993 FILE SU&IECT Scattered Site Housing -- Coconut Grove Phase I (Third Bidding), Model City Phase IV and Wynwood Phase II FROM REFERENCES Increase In Contracts Cesar io City g e r ENCLOSURES RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution authorizing increases in the contracts between Lewis Greer, Construction, Inc. and the City of Miami for Scattered Site Housing --Coconut Grove Phase I (Third Bidding), not to exceed $5,300; for Scattered Site Housing -Model City Phase IV, riot to exceed $540; and for Scattered Site Housing Homeownership Development Program--Wyndwood Phase II not to exceed $3,000; and further ratifying the City Manager's written finding that the increases resulted from emergency circumstances. BACKGROUND The Department of Public Works, in an effort to serve all residents of the City of Miami, has determined that it is now appropriate and in order for the City Commission to ratify the City Manager's decision to increase three existing contracts dated October 16, 1991, October 23, 1991, and February 12, 1992, between the City and Lewis Green Construction, Inc, for construction of Scattered Site Housing --Coconut Grove Phase I (Third Bidding), Model City Phase IV and Wynwood Phase II, in the total amount not to exceed $8,840 for all three contracts for necessary extra work, and to ratify the City Manager's emergency finding that allowed the extra work to continue on all three projects. The City Commission awarded contracts to Lewis Green Construction, Inc. for the construction of Scattered Site Housing -Coconut Grove Phase I (Third Bidding) on July 11, 1991 in the amount of $89,700; for Scattered Site Housing --Model City Phase IV on July 11, 1991 in the amount of $94,460; and for Scattered Site Housing Homeownership Development Program--Wynwood Phase II on November 14, 1991 in the amount of $92,000. Generally, the projects consisted of the construction of two, three --bedroom, two --bathroom, single-family residences in each project, for a total of six residences, on City owned scattered housing sites. As the construction progressed, some unexpected conditions developed for the small --firm contractor which affected the construction costs. These conditions are outlined below: 07 93 - 548 1. The scattered site locations had unforeseen, security problems which in many instances required the contractor to replace and redo phases of the work due to vandalism and theft. 2. Several locations required sidewalk and curb and gutter replacement work that was not anticipated by the contractor. 3. Window specifications were revised to satisfy building code requirements which resulted in extra costs for the houses. 4. Site clearing and haul. -off of illegally dumped debris were required for some of the locations. 5. Building material. costs escalated and increased for the contractor since being awarded the contracts. 6. Electric service to the houses had to be revised from that originally shown on the architect's plans. 7. Several locations required a zoning variance which delayed the start of construction. This resulted in an additional building permit review of plans and specifications. The above items caused delays in the scheduled completion of the houses. The City was allocated specific surtax mortgage financing for the prospective home buyers. Work on the subject houses was underway, and in several cases, prospective buyers were identified when the contractor requested additional monies to complete the houses. Further delays in construction would impact the prospective buyers and place the City at risk of having Dade County's Documentary Surtax Advisory Board rescinding mortgage funds. It was decided that the most cost effective and expeditious manner to address all of the above problems was to allow Lewis Green Construction, Inc. to proceed with the extra work and complete the construction of the houses as soon as possible. Funds are available for the aforesaid contract increases totalling $8,840 from monies already appropriated to the project in the City's Capital Improvement Appropriate Ordinance No. 10938, Project No. 321034. All interested persons are invited to appear and may be heard concerning these items. Should any person desire to appeal any decision of the City Commission with respect to any matter considered at this hearing, that person shall ensure that a verbatim record of the proceedings is made, including all testimony and evidence upon which any appeal may be based.
