HomeMy WebLinkAboutR-93-0537J-93-592 8/19/93 RESOLUTION NO. 9 3 - � '43 d A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S ACTION IN AWARDING THE BID TO ACTION LAND DEVELOPMENT CORPORATION, IN THE AMOUNT OF $396,213.29, FOR THE REMOVAL OF MIXED, CONTAMINATED HURRICANE DEBRIS STORED AT VIRGINIA KEY AND TRANSPORTED TO THE POMPANO LANDFILL; ALLOCATING FUNDS THEREFOR FROM F.E.M.A. DSR #37849. WHEREAS, on September 10, 1992, the City Commission passed Resolution No. 92-551 waiving formal competitive bids for the acquisition of services, equipment, goods arid/or materials as required in the aftermath of Hurricane Andrew; and WHEREAS, said Resolution allowed the City Manager to proceed to make necessary purchases without express City Commission approval, where contracts or awards do not exceed $150,000.00; and WHEREAS, pursuant to Section 18.56.6 of the Code of the City of Miami, Florida, as amended, the City Manager waived formal bidding procedures on June 16, 1993 and authorized the use of informal bids to perform this service due to the deadlines for clean-up imposed by the State of Florida's Department of Environmental Regulations; and CITY COTY: ,,°AmSl() Rertolution No. a3 �.r WHEREAS, on June 2, 1993, Department of General Services Administration and Solid Waste issued Informal Quote No. 92-93-130 and received responses from nine vendors; and WHEREAS, Action Land Development Corporation submitted the lowest, most responsible and responsive quotation and was awarded the contract to transport the mixed contaminated debris at a total lump sum of $396,213.29; and WHEREAS, funds for said service are available from F.E.M.A. DSR #37849; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, F'LORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's action in awarding the bid to Action Land Development Corporation, in the amount of $396,213.29, for the removal of mixed, contaminated hurricane debris stored at Virginia Key and transporting same to the Pompano Landfill is hereby ratified, approved and confirmed, with funds therefor hereby allocated from F.E.M.A. DSR #37849. -2- 93- 53'7 I Section 2. Funds are allocated from F.E.M.A., D.S.R. #37849. BACKGROUND The Department of General Services Administration and Solid Waste followed the Federal Emergency Management Agency (F.E.M.A.) recommendation that the use of emergency procedures be implemented, for the hauling of mixed, contaminated hurricane debris from the Virginia Key Composting Facility to the Pompano Landfill. The State of Florida's Department of Environmental Regulations (DER) has given the City of Miami until August 24, 1993, to clear and return the Virginia Key site to pre -hurricane condition or the City will face fines and other actions provided under the Florida Statutes. Therefore, the City Manager designated this service as an emergency and waived the formal bidding procedure. Informal Bids were obtained and a purchase order was issued to the lowest most responsive and responsible bidder. It is, therefore, recommended that the Resolution waiving competitive sealed bids and ratifying the contract for the hauling of mixed, contaminated hurricane debris from Virginia Key Composting Facility to the Pompano Landfill, be approved. 9 - I y Attachments CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO : DATE FILE I Cesar H.
