HomeMy WebLinkAboutR-93-0533d-93-646 8/31/93 a] cr� r:`�3 RESOLUTION NO. `' `' `'' iD A RESOLUTION DIRECTING AND AUTHORIZING THE CITY MANAGER AND THE CITY CLERK TO TAKE ANY AND ALL ACTIONS NECESSARY TO INITIATE A PROPOSED BOUNDARY CHANGE OF THE CITY OF MIAMI, FLORIDA; FURTHER, SETTING A PUBLIC HEARING BEFORE THE MIAMI CITY COMMISSION CONCERNING SAID PROPOSED BOUNDARY CHANGE FOR SEPTEMBER 21, 1993 AT 3:00 P.M. WHEREAS, pursuant to Section 5.04 of the Dade County Home Rule Charter and Section 20-3 of the Code of Metropolitan Dade County, Florida, the City may by resolution of its governing body, initiate a proposed boundary change; and WHEREAS, the City desires to initiate a proposed change to the boundary of the City to include two separate tracts of land situated at Virginia Key, specifically the southern end of Virginia Key Beach and the parcel of land wherein the Miami Marine Stadium, the parking lot adjacent thereto, and adjacent boat club facilities are located; and WHEREAS, the City owns the aforementioned tracts of land and is desirous of annexing the same for purposes of improving said properties to provide a full range of public recreational uses; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COA!CMIsSTON MEET LNG OF Resolution No. � a � � QJ ky, Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager and City Clerk are hereby directed and authorized to take any and all actions necessary to initiate the hereinabove described proposed boundary change of the City of Miami, Florida. Section 3. A public hearing concerning said proposed boundary changes is hereby set before the Miami City Commission on September 21, 1993 at 3:00 P.M. Section 4. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 7th day of September 1993. SVAREZ, MAYOR 33- 533 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM 1 TO Honorable Mayor and Members DATE j�UFILE of the City Commission Virginia Key' SUBJECT Annexation Process Initiation and Public Hearing FROM : CesaVager io REFEREiJCES Fo.r September 7, 1993 City Commission Meeting, ENCLOSURES COMMEN It is respectfully recommended that the City Commission adopt the attached Resolution directing and authorizing the City Manager and the City Clerk to take any and all actions necessary to initiate a proposed boundary change of the City of Miami, Florida; further, setting a public hearing before the Miami City Commission concerning said boundary change for September 21, 1993 at 3:00 P.M.. BACKGROUND: i The City of Miami owns property located on Virginia Key that is not within the City Borders and therefore not within the jurisdiction of the CityCommission. This property includes the parcel of land wherein the Miami Marine Stadium, the parking lot adjacent thereto, and the adjacent boat club facilities as well as the parcel of land situated at the southerly end of Virginia j Key Beach. In order to implement the proposed boundary change the City must initiate a process involving Metropolitan Dade County. A Public Hearing must be held to effectuate public notice of this process. FILE August 31, 1993 SUBJECT Marine Stadium UDP Agenda Item - Sept. 7th REFERENCES Commission Meeting ENCLOSURES Annexation Resolution for Virginia Key parcels At the June 29th Commission Meeting, in the context of a commission discussion item concerning the future of Marine Stadium, the Commission deferred a decision on demolition of the stadium and directed the administration to take all necessary steps toward preparation of a request for proposals for a Unified Development Project for the Marine Stadium property. The intention is to solicit private sector development proposals for the property to determine if private funding of the stadium reconstruction and operation is feasible. Before a UDP for the Marine Stadium property can be appropriately prepared the City of. Miami must gain control of land use/zoning and master plan policies for the site. The entire stadium property is outside the City's corporate limits and is currently zoned by Metropolitan Dade County for government/park use ( GU ) which is a highly restrictive district that would prevent ancillary commercial or private recreational developments. It is to the project's (UDP) benefit to have as wide a mix of possible recreational uses and services that can be permitted together with the stadium use as an inducement to private investors and developers to bid on the project. The best way to achieve this flexibility is to annex the stadium property into the City limits and apply City zoning and master plan policies to the site. The attached resolution initiates the annexation process. Since the same issues apply to the City's plans to develop a campground on Virginia Key Beach, the southerly half of which is outside the City limits, the annexation resolution also addresses the Virginia Key Beach site. 3 93-- 533
