HomeMy WebLinkAboutR-93-0514J-93-608 8/13/93 RESOLUTION NO. 9 3— 5 T 4 A RESOLUTION APPROVING, THE SELECTION BY THE COMPETITIVE SELECTION COMMITTEE OF THE MOST QUALIFIED FIRMS TO PROVIDE LAND SURVEY SERVICES FOR CITY OF MIAMI PROJECTS 1994-95; AUTHORIZING THE CITY MANAGER TO NEGOTIATE PROFESSIONAL SERVICES AGREEMENTS WITH THE FIVE TOP RATED FIRMS, TO PROVIDE SURVEY SERVICES; DIRECTING THE CITY MANAGER TO PRESENT NEGOTIATED AGREEMENTS TO THE CITY COMMISSION FOR APPROVAL PRIOR TO EXECUTION THEREOF; FURTHER AUTHORIZING THE CITY MANAGER, IN THE EVENT ANY EXECUTED AGREEMENT IS TERMINATED PRIOR TO COMPLETION THEREOF, TO NEGOTIATE WITH THE ONE REMAINING LISTED FIRM FOR AN AGREEMENT TO REPLACE THE ORIGINAL FIRM WITH NO INCREASE IN COMPENSATION OR IN THE TERM OF SAID NEW AGREEMENT WHICH AGREEMENT MAY BE EXECUTED BY THE CITY MANAGER WITHOUT ANY FURTHER APPROVAL BY THE CITY COMMISSION. WHEREAS, a substantial amount of City of Miami contracted construction projects and departmental projects are scheduled for the immediate future; and WHEREAS, the City of Miami Public Works Department is insufficiently staffed to accomplish all land survey work necessary for said projects; and WHEREAS, Agreements with five private Survey firms negotiated in 1991 will expire in January 1994; and WHEREAS, it is necessary for the City to again engage Land Survey firms to render professional and technical services for the Calendar Years 1994-95; and WHEREAS, funds for said professional and technical services can be allocated as a project expense from the individual project funding; and CITY C0_M, v7T ;SION R - ' ���� ppResolution No.. 1. eb Ci -1 4 WHEREAS, by Resolution No. 93-304 passed and adopted on May 13, 1993, the City Commission approved the designation of Land Survey Services for City of Miami Projects - 1994-95 as a Category "B" project and appointed Daniel C. Brenner, P.E., as Chairman of the Competitive Selection Committee; and WHEREAS, in the implementation of the said projects, the City Manager, through the Competitive Selection Committee, solicited expressions of interest from qualified consultants and evaluated the qualifications of those firms which responded to his inquiry; and WHEREAS, the most qualified firms for providing professional Land Survey services for City of Miami projects were selected in accordance with the State of Florida Consultants' Competitive Negotiation Act, enacted by the Florida Legislature on July 1, 1973 and by Ci ty of Miami Ordinance No. 8965 on July 23, 1979; and WHEREAS, it is in the best interest of the City of Miami to negotiate professional services contracts with five firms for City of Miami projects as soon as possible; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby approves the selection of the Competitive Selection Committee of the following firms as the most qualified to provide professional Land Survey services for City of Miami projects in the rank order listed: —2— 93-- 514 1. Biscayne Engineering Company, Inc. 2. Manuel G. Vera & Associates, Inc. 3. Metric Engineering, Inc. 4. Campanile & Associates, Inc. 5. Fernando Z. Gatell, P.L.S., Inc. 6. Crowder --Mahoney, Inc. Section 2. The City Commission hereby authorizes the City Manager or his designee to negotiate five professional service agreements on behalf of the City of Miami with the rank ordered firms listed in Section 1 hereinabove for Land Survey services for City of Miami projects, for such professional Land Survey services as may be required. During the negotiations procedure, in the event that the City Manager or his designee cannot negotiate an agreement which, in his opinion, is fair, competitive and reasonable, with any one of the rank ordered firms, then he is hereby authorized to terminate such negotiations and to proceed to negotiate with the remaining firm until fair, competitive and reasonable agreements have been reached with the required number of firms. Section 3. The City Manager is directed to present to the City Commission the negotiated agreements at the earliest scheduled meeting of the City Commission immediately following the negotiation of the contracts for approval by the City Commission prior to execution. Section 4. a) The City Commission also hereby authorizes the City Manager or his designee to negotiate with the remaining firm in the event that any authorized executed agreement with one —3- 93- 514 of the above top rated firms is terminated prior to completion thereof with the maximum compensation allowed to the new firm being the amount remaining in the terminated agreement. b) The expiration date of any terminated agreement as described in Subsection (a) above shall also be the termination date of new agreement which may be executed by the City Manager without further City Commission approval. ENCLOSURES Ci ty Man RECOMMENDATION: It is respectfully recommended that the City Commission accept the recommendations of the Competitive Selection Committee by adopting the attached resolution approving the selection of the most qualified firms to provide "Land Survey Services for City of Miami Projects - 1994-95"; and authorizing the City Manager to negotiate Professional Service Agreements with the top five rated firms, and submit the negotiated agreements to the Commission for approval. BACKGROUND: The City is proposing to contract for a substantial amount of Highway, Sewer and Park construction projects in the immediate future. The Public Works Department is insufficiently staffed to accomplish the survey work required for these projects and other miscellaneous projects initiated by various departments. The agreements with five private survey firms negotiated in 1991 expire in January 1994. It is necessary, therefore, to again engage private firms to provide land survey services for the 1994-95 calendar years. In accordance with City of Miami Ordinance No. 8965, and as authorized by Resolution No. 93-304, dated May 13, 1993, a Competitive Selection Committee, comprised of five city employees and one member of the private sector, personally interviewed and evaluated six certified firms that responded to the City's public advertisement for Request for Proposals. The six firms were ranked in the following order: I. Biscayne Engineering Company, Inc. 2. Manuel G. Vera & Associates, Inc. 3. Metric Engineering, Inc. 4. Campanile & Associates, Inc. 5. Fernando Z. Gatell, P.L.S., Inc. 6. Crowder -Mahoney, Inc. 93- 514 The resolution provides for the City Manager to negotiate agreements with the firms rated 1, 2, 3, 4, and 5 and also negotiate with the one remaining firm in the event that any of the original agreements is terminated before its expiration date. The total compensation of the new agreement is to be what is left from the original one and the expiration date will remain the same. Funds for these services can be allocated as a project expense from the individual project funding. Attachment: Proposed Resolution
