A RESOLUTION REVERSING THE DECISION OF THE
ZONING BOARD AND DENYING A VARIANCE FROM
ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA,
ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT
REGULATIONS, R-1 SINGLE FAMILY RESIDENTIAL,
PERMITTED PRINCIPAL USES, TO ALLOW A FRONT
YARD SETBACK OF 11.2' (20--0" REQUIRED) FOR
THE ADDITION OF A PROPOSED CAR GARAGE TO AN
EXISTING RESIDENCE FOR THE PROPERTY LOCATED
AT 2025 SOUTHWEST 5 AVENUE, MIAMI, FLORIDA,
ALSO DESCRIBED AS LOT 18, BLOCK 5, HOLLEMAN
PARK, AS RECORDED IN PLAT BOOK 8 AT PAGE 28
OF THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA.
WHEREAS, the Miami Zoning Board at its meeting of June 7,
1993, Item No. 5, duly adopted Resolution ZB 64-93 by a six to
three (6-3) vote, granting a variance requested as hereinafter
set forth; and
WHEREAS, the Miami -Roads Neighborhood Civic Association,
Inc., through its president, Mike Keraty, Jr., has taken an
appeal to the City Commission from the grant of the variance; and
WHEREAS, the City Commission, after careful consideration of
this matter, and notwithstanding the decision of the Zoning'��
Board, finds that there are no peculiar circumstances affecting
this parcel of land nor any practical difficulties and
unnecessary hardships which would impair the owner's right to the
reasonable use of this property without the grant of the herein
requested variance;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Zoning Board in this
matter is hereby reversed and the request for a variance from
Ordinance No. 11000, as amended, the Zoning Ordinance of the City
of Miami, Florida, Article 4, Section 401, Schedule of District
Regulations, R-1 Single Family Residential, Permitted Principal
Uses, to allow a front yard setback of 11.2' (20'-0" required)
for the addition of a proposed car garage to an existing
residence for the property located at 2025 Southwest 5 Avenue,
Miami, Florida, also described as Lot 18, Block 5, Holleman Park,
as recorded in Plat Book 8 at Page 28 of the Public Records of
Dade County, Florida, is hereby denied.
Section 3. This Resolution shall become effective
immediately upon its adoption.

HISTORY At its meeting of 6/7/93 the ZB granted the requested Variance by Res. ZB 64-93 by a vote of 6
to 3.
ANALYSIS Although the proposed improvements will be an overall enhancement to the neighborhood, there is
no hardship to justify the requested front yard setback for the addition to a single family
residence. Reasonable use of the property is currently being achieved without the proposed
encroachment into the required yard. The proposed garage could be redesigned and reduced in
size to meet all zoning requirements. The grant of this variance would confer on the petitioner
a privilege that is denied by the zoning ordinance to other property owners in the same
district.

A variance is relaxation of the terms of the ordinance where such
action will not be contrary to the public interest and where,
owing to conditions peculiar to the property and not the result
of actions of the applicant, a literal enforcement of this
ordinance would result in unnecessary and undue hardship on the
property. As used in this ordinance, a variance is authorized
only for height, area, size of structure, dimensions of yards
and other open spaces and off-street parking or loading require-
ments. (Section 1901)

RE: Zoning Variance request regarding 2025 SW 5 Avenue
Dear Sirs:
I own/rent the property at the address I listed above. I live within
350 feet of the property that has requested a variance: 202.5 SW 5
Avenue. I strongly urge the city government to deny the application
of this zoning variance. I am concerned because the area of Miami in
which we live, The "Roads", is a lovely area with pioneer homes,
beautiful trees, lovely boulevards, and neighbors who have a sincere
desire to keep their homes and streets protected from overbuilding
and violations of the law.
it is my understanding that the Petitioner has failed to meet the
requirements necessary to obtain such a variance.
1. There is no hardship to the Petitioner. In fact, the
Petitioner had a perfectly good garage located on the opposite side
of the property, but he voluntarily decided to demolish it.
2. The Petitioner or his contractors have illegally dumped
the debris from the demolished garage.
3. There is ample room on the east side of the property.
(where the garage originally stood) to rebuild another garage.
4. When you look down the "Roads" streets, you see houses
which are in uniform alignment. It is easy to walk outside the house
to see another's neighbor's front yard and to check on a neighbor or
a potential crime going on in the neighborhood with the uniform set
backs which are now in existence.
5. The "Roads" are similar to Coconut Grove or Coral Gables.
There is a distinct character to the area which should be upheld by
zoning regulations and the people (YOU) who rule on variances.
Please deny the variance. Please allow the Roads and our neighbor-
hood to maintain its unique quality and be a place where we can be
proud to live.
