WHEREAS, a vacancy currently exists on the Miami Waterfront Advisory Board, to fill an unexpired term of office, as the result of a member's resignation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ces io Cit ager ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution appointing one (1) regular member to the Miami Waterfront Advisory Board. BACKGROUND: The Law Department, with the Department of Parks and Recreation, has prepared the attached legislation. The purpose of this resolution is to fill an existing vacancy by appointing (1) regular member to the Waterfront Advisory Board. This vacancy exists as a result of the resignation of Mr. John Brennan from the Board, effective May 30, 1993. The new appointee would serve the balance of Mr. Brennan's unexpired term until September 8, 1993. The above -mentioned vacancy corresponds to the following category: CATEGORY A: One (1) position, expiring September 8, 1993. (To be appointed by Vice Mayor De Yurre) The Board consists of a total of ten (10) regular members and one (1) alternate. Reserved. ARTICLE IV. WATERFRONT ADVISORY BOARD* Sec. 29661. Creation. The Miami Waterfront Advisory Board is hereby created and may be referred to by that term or "city waterfront board" or "board." (Ord. No.10459, 4 1(b), 7-14-88) Sec. 29.62. Scope. (a) The board shall have responsibility to re- view and evaluate issues related to the use and development of city -owned waterfront property and shall provide advice to the city commission con- cerning those issues and only such other matters as are referred to it by the city commission in regard to city or public land abutting water. The city commission shall not be bound by any recom- mendation or advice received from the board. The board is expected to be aware of city policy con- cerning development and coordinate its endeavors with the city's planning advisory board and any other committees or boards which will be affected by the board's recommendations. (b) The Miami Waterfront Advisory Board shall be informed of all issues concerning the major de- velopment and/or disposition of city -owned water- front property for its input and advice at the same time or before other city committees or boards are *Editor's note —Ord. Nothing herein is intended to interfere or conflict with any existing provisions in the City of Miami Charter and Code setting forth proce- dures concerning the development and/or disposi- tion of city -owned waterfront property. (Ord. No. 10459, $ 3, 7-14-88; Ord. No. 10638, § 1, 9-14-89) Sec. 2943. Composition; terms; appointment; removal. (a) The board shall consist of ten (10) members and one (1) alternate, all of whom are appointed by the city commission. (b) All members shall serve without compensa- tion for terms of office as indicated hereunder and shall be subject to removal by the commission for any cause. A member's absence from one-half of the cumulative meetings within any one-year pe- riod or from three (3) consecutive meetings of the board within a member's term of office shall, un- less excused by the board, result in the member's removal from the board upon the chairperson's filing of a certificate of such unexcused absences with the city clerk. Any vacancy occurring during such term shall be filled for the remainder of the term in the same manner as the original appoint- ment. The terms will run from the effective date of this Ordinance No. 10459. (c) Category A: Five (5) members shall be ap- pointed initially to serve two-year terms and there- after shall be appointed to serve three-year terms. The mayor and each commissioner shall make one (1) nomination of an individual to serve as a member in this category. (d) Category B: Five (5) members shall be ap- pointed to serve three-year terms. The mayor and each commissioner shall make one (1) nomination of an individual to serve as a member in this category. (e) The alternate member shall serve a term of three (3) years commencing on the effective date Supp. No. 35 129.64 of Ordinance No. 10459 and shall be appointed from among individuals nominated by the mayor or any commissioner. (f) Members shall reside in the city, maintain a place of business or office in the city or own real property in the city at the time of their appoint- ment. (Ord. No. 10459, 4 2, 7.14.88) Sec. 2044. Officers; meetings; quorum; reports; support. (a) The board shall select one (1) of its mem- bers as chairperson. No chairperson shall serve more than three (3) years in that office. A vice- -chairperson may also be designated by the board from among its members to serve as chairperson at any meeting if the chairperson is absent from the meeting. (b) A quorum shall consist of six (6) members. A decision of the board shall be made only upon an affirmative vote of the majority of those mem- bers in attendance. (c) Meetings shall be scheduled by the board at least once each month and if there is no business pending before the board, the meeting may be dispensed with. The time and place of the meet- ings shall be fixed by the board. Special meetings may be called by the chairperson or by any six (6) members of the board upon reasonable notice being given to all board members. Meetings shall be open to the public and the board shall adopt its own order of business and rules of parliamentary procedure. (d) The board shall report in writing to the city commission at least once each three (3) months and shall file a copy of the report with the city clerk. The board shall provide such additional reports as from time to time may be necessary to discharge its responsibility: (e) It shall be the duty of the city manager to provide administrative support to the board which shall include the services of an individual to keep minutes of meetings, maintain board correspon- dence, post meeting notices, file reports, and per- form all other necessary support functions.
