RESOLUTION No. 9 3 - 314
A RESOLUTION ACCEPTING THE BID OF COMB
CONSTRUCTORS, INC., ("CONE") IN THE PROPOSED
AMOUNT NOT TO EXCEED $2,873,430.00, TOTAL BID
OF THE PROPOSAL, BASE BID PLUS ADDITIVE ITEM
NO. 1, FOR DINNER KEY MARINA RESTORATION -
PHASE II REHABILITATION OF PIERS AND BAYWALK
H-1008, DAMAGED OR DESTROYED BY HURRICANE
ANDREW; FUNDS THEREFOR TO BE REIMBURSED FROM
PENDING INSURANCE CLAIMS, THE FEDERAL
EMERGENCY MANAGEMENT AGENCY (PENA) AND TO BE
ALLOCATED FROM CAPITAL IMPROVEMENT PROJECT
NOS. 414801 AND 414005, IN THE AMOUNT OF
$2,875,430.00 TO COVER THE CONTRACT COST PLUS
ANY ACTUAL REIMBURSABLE DESIGN AND
ENGINEERING EXPENSES AND AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM.
WHEREAS, pursuant to publio notioe, sealed bids were
reoeived on Maroh 8, 1993, for the Dinner Key Marina
Restoration - Phase II Rehabilitation of Piers and Baywalk H-1008
("Projeot"); and
WHEREAS, only two (2) firms submitted bids for said Projeot
by the Maroh 8, 1993 deadline: Hayden Enterprises, Ino.
("Hayden") and Cone Construotors, Ino. ("Cone"); and
WHEREAS, of the bids submitted, Cone's was the lowest prioe
-� but Hayden filed a written protest olaiming that Cone's bid was
not responsive beoause Cone did not obtain a Dade County
Certifioate of Competenoy, whioh was a prerequisite to the
submission of a bid; and

=; WHEREAS, the City Manager recommended that Cone's bid be
accepted, despite the purported irregularity of its bid as noted
by Hayden's protest; and

l WHEREAS, the City Commission at its meeting of
April 15, 1993, considered Hayden's protest and the City

WHEREAS, the City Commission adopted Resolution No. 93-252
on April 15, 1993, thereby rejeoting all bids received in
connection with the Project; and
WHEREAS, at the time of the rejeotion of all bids for said
Project, several members of the City Commission were under the
impression that Hayden was a looal company; and
WHEREAS, at a subsequent meeting, the City Commission voted
to reconsider the issue oonoerning the bidding of the Project;
and
WHEREAS, the City Commission pursuant to Resolution
No. 93-313, adopted May 13, 1993, thereby rescinding the decision
to rejeot ali bids reoeived in oonneotion with the Projeot; and
WHEREAS, the City Manager and the Director of the Ifepartment
of Public Works reoommend that the bid from Cone be aooepted as
the lowest responsible and responsive bid; and
WHEREAS, funds for said project shall be reimbursed to the
City by pending insurance olaims, the Federal Emergency
Management Agency (FEMA) and Capital Improvement Funds under
Projeot Nos. 414501 and 414005;
NOW, THEREFORE, HE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Seotion 1. The reoitals and findings oontained in the
Preamble to this Resolution are hereby adopted by referenoe
thereto and inoorporated herein as if fully set forth in this
Seotion.
Seotion 2. The Maroh S, 1993 bid of Cone Construotors,
Ino. ("CONE"), in the proposed amount of $2,875,430.00, for the
Projeot entitled Dinner Key Marina Restoration - Phase II
Rehabilitation of Piers and Baywalk 5-1008, for the total bid of
the proposal, base bid plus additive Item No. 1, is hereby
aooepted at the prioe stated herein, oonditioned upon Cone
dismissing with prejudice the legal aotion of Cone CoDStruotose.

Seotion 3. The total estimated projeot oosts of
$2,875,430.00 are to be reimbursed from pending insuranoe olaims,
the Federal Emergenoy Management Agenoy (FEMA) and to be
allooated from Capital Improvement Projeot Nos. 414801 and
414005.
Seotion 4. The City Manager is hereby authorized" to
enter into a oontraot, in a form aooeptable to the City Attorney,

Seotion 8. This Resolution shall beoome effeotive
immediately upon its adoption.
The herein authorization is further subjeot to oomplianoe with
all requirements that may be imposed by the City Attorney,
inoluding but not limited to those presoribed by applioable ,
City Charter and Code provisions.

ENCLOSURES: ( 1 )
The attached proposed resolution, prepared pursuant to your
direction at the April 15, 19931 City Commission Meeting, calls
for a Special Election to be held on November 2, 1993 and submits
to the qualified electors the question as to whether (a) the City
of Miami shall be authorized to exceed the constitutional ten
(10) mills limitation by the levy of an additional ad valorem tax
of not more than two ( 2 ) mills, for a period not to exceed two
years, for the provision of additional sworn police officers and
related equipment for the benefit of the citizens of the City of
Miami, (b) to require that all City personnel newly hired and
paid from the funds generated by the subject millage increase
shall be residents of the City of Miami, and said new personnel
shall maintain such residency at all times during their
employment by the City of Miami or shall have such employment
immediately terminated upon an administrative finding that said
employment condition has been violated, and (c) to establish a
Homeowner - Associations Advisory Board, consisting of
representatives from various associations, which shall make
recommendations to the City Commission as to how the monies
generated by said additional levy shall be expended on said
police related matters.
By copy of this memorandum, this Resolution is being
submitted to the City Manager to be scheduled as a public hearing
at the May 13, 1993, City Commission meeting.
