J-93-338 8/6/93 RESOLUTION No. 9 3- 2 9 7 A RESOLUTION APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT THE PROTEST OF INTERCONTINENTAL LEASING, INC., D/B/A INTERCONTINENTAL RENT A CAR ("INTERCONTINENTAL"), IN CONNECTION WITH BIDS FOR THE FURNISHING OF AUTOMOBILE RENTAL SERVICE ON A CONTRACT BASIS, AS IT HAS BEEN DETERMINED TO BE WITHOUT MERIT. WHEREAS, pursuant to public notice, sealed bids were received April 13, 1993, for the furnishing of automobile rental service on a contract basis for the Department of Police; and WHEREAS, invitations were mailed to twenty-seven (27) potential bidders and three (3) bids were received; and WHEREAS, the City Nam gar and the Chief of Police recommended that the bid received from Royal Rent-A-Car ("Royal") be accepted as the lowest, most responsible and responsive bid; and WHEREAS, on April 18, 1993, Intercontinental filed a written protested in connection with the City's decision to award the bid to Royal; and WHEREAS, the Chief Procurement Officer, pursuant to Section 18-58.1 of the City Code, in her role as arbiter, investigated the matter, reviewed pertinent documents and determined that Intercontinental's protest was without merit and has rejected the protest; and Cff C41—$�TCN ifETING OF MAY 13IM 93— 297 MAW, the City Manager and the City Attorney concur with and approve the finding of the Chief Procurement Officer and recommend rejection of the protest filed by Interoontinental; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Chief Procurement Offioer•s decision to reject the protest of Intercontinental in connection with bids for the furnishing of automobile rental service on a contract basis, is hereby approved. FILE SUBJECT ResolutionofProtest in Connection with Bid No. 92-93-083R for Police Lease/Rental Cars REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution approving the Chief Procurement Officer's decision to reject protest of Intercontinental Leasing, Inc., d/b/a Intercontinental Rent a Car (Intercontinental), in connection with Bid No. 92-93-083R, to furnish lease/rental cars for the Police Department. On March 30, 1993, the City's General Services/Solid Waste Department solicited bids for the provision of the above noted services, on behalf of the Police Department and received three (3) bids on April 13, 1993. The bid's Special Conditions required that all bidders respond to each Insurance Options, Option A and Option B. of the bid and further stated that an award would be based, in part, upon the most advantageous insurance coverage offered. The bid from Intercontinental was deemed non -responsive because it did not bid Option A. in compliance with requirements in the bid's Special Conditions. In addition, Intercontinental required that the firm be indemnified up to $1,000,000, by the City. Finally, Intercontinental's bid, under Option B, provided for limited free mileage. Royal Rent a Car, the recommended vendor, met all the bid's Specifications, including Insurance and Indemnification requirements, submitted the lowest bid under Option A, and provided unlimited free mileage. Pursuant to Section 18-56.1 of the City Code, the Chief Procurement Officer investigated the matter and determined that the protest lacked merit, as detailed in the attached letter. CITY OF MIAMI. Pursuant to my duties under Sec. 18-56.1, City of Miami Code, I have reviewed pertinent documents, talked with employees and determined that your protest is without merit. In your protest letter of April 16, 1993, you contend that Intercontinental Rent A Carts ("Intercontinental") bid was the lowest and "should have been awarded the bid accordingly." . The bid received from In rcontinental was deemed non -responsive because it did not comply with paragraph 2, Section 7, of the bid's special Conditions, InsurAnce, which stipulated, "td]etermination of award will be based, in part, upon the lease/rental rate having Insurance Coverage that is most advantageous to the City. The City determined that Option A is the most Advantageous offer for the City since it provides the lowest physical damage deductible - $100. Intercontinental did not bid this option, rather it only bid Option e, which requires a $250 physical damage deductible payable by the City. Caroline Weiss Intercontinental teasing, Inc. pago 2 Furthermore, although intercontinental signed the Insurance and Indemnification forms contained in the bid documents and thus agroad to comply with these requiremente, your firm negated this compliance in the bid sheet and in a separate letter. (See copy attached). The letter clearly stipulated that your firm had to be indemnified up to $1,000,000, by the City. This condition nullified your agreement to comply with the City'$ Indemnification requirements. Finally, your bid under Option a provided four limited free mileage and required that the City pay $0.20 per mile for any excess mileage. Royal Rent A Car (Royal) met all the bid's Specifications, including Insurance and Indemnification requirements, submitted the lowest bid under Option A, and provided unlimited free Mileage. Accordingly, the City Manager recommended to the City Commission that the bid received from Royal ba accepted as the lowest, most responsible and responsive bid. Based on the foregoing, I am rejecting your protest.
