A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING
THE CITY MANAGER TO ACCEPT A HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA)
PROGRAM GRANT IN THE AMOUNT OF $4,697,000
FROM THE UNITED STATES DEPARTMENT OF HOUSING
AND URBAN DEVELOPMENT; AUTHORIZING THE CITY
MANAGER TO EXECUTE THE NECESSARY CONTRACTS
AND AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED
FORK, FOR IMPLEMENTATION OF SAID PROGRAM;
FURTHER AUTHORIZING THE CITY MANAGER TO
ALLOCATE SAID FUNDS AND TO ENTER INTO
AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH AGENCIES FOR THE PROVISION OF
SERVICES TO PERSONS WITH AIDS, SUBJECT TO
CITY COMMISSION APPROVAL AND APPLICABLE CITY
CODE PROVISIONS.
WHEREAS, the Housing Opportunities For Persons With AIDS
(HOPWA) Program was oreated under the AIDS Housing Opportunity
Aot, and revised under the Housing and Community Development Aot
of 1992; and
WHEREAS, the United States Department of Housing and Urban
Development (HUD) published its Notioe of Funding Availability
for the HOPWA Program, for fisoal year 1993, in the Federal
Register on Deoember 28, 1992; and
WHEREAS, the interim rule (24 CFR Part 574.100 Subpart B)
stipulates that the most populous unit of general looal
government in an Eligible Metropolitan Statistioal Area (EMSA),

formula allocation grant; and
WHEREAS, in the Dade County, Hialeah, Miami, and Miami Beach
BMSA, Miami is the most populous city, and thereby the designated
applicant for the 1093 HOPWA applioation for our BMSA; and
WHEREAS, the Department of Development and Housing
Conservation, on behalf of the City of Miami and our EMSA, and in
conjunction with representatives of Dade County and the oities of
Hialeah, and Miami Beach, with additional input from the Miami
Coalition for the Homeless, South Florida AIDS Network, Inc.,
Cure AIDS Now, Ina., and the Dade Partnership for Community and -
Eoonomio Development, worked together in preparation of the HOPWA
applioation for fiscal year 1993 funding; and
WHEREAS, the consensus opinion of the aforementioned
organizations during the preparation of the application was to
use the funding in euoess of the 1992 HOPWA amount, after
allowing for administrative costs of the funds, for permanent
housing for persons with AIDS, allowing for acquisition,
rehabilitation, and/or construction of housing facilities; and
WHEREAS, the consensus opinion of the aforementioned
organizations during the preparation of the application was to
continue the fisoal year 1992 funding for Dade County's
Department of Human Resources - Office of Community Services for
the provision of short-term emergency housing and finanoial
assistanoe, plus administration thereof, as allowed by the new
interim rule, in the combined amount of $811,060 for 1993; and
WHEREAS, the oonsenaus opinion of the aforementioned
organizations during the preparation of the applioation was to
sol.ioit applioations for the following: supportive eevvioec
aoquisition, rehabilitation, and new oonstruotion of permanent
housing, housing information and referral servioes, fair housing
oounselling, homeless shelter in-servioe eduoation, resouros
identifioation and development/planning and 000rdination, and
housing teohnioal assistance; and
WHEREAS, on April 19, 1993, the City of Miami reoeived HUD's
funding approval of the HOPWA application and the related HOPWA
agreement whioh, upon exeoution by both the City and MM, will
enable HUD to obligate the $4,697,000 formula allocation amount;
and
WHEREAS, it is neoessary for the City Manager to aooept the
$4,897,000 HOPWA Grant and exeoute agreements for the
implementation and administration of the HOPWA Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The reoitals and findings oontained in the
Preamble of this Resolution are hereby adopted by referenoe
thereto and inoorporated herein as if fully set forth in this
Seotion.
Seotion 2. The City Manager is hereby authorized to
aooept a HOPWA Program Grant in the amount of $4,697,000 from HUD
and to exeoute the neoessary oontraots and agreements, in
substantially the attaohed form, for implementation of said
Program, subjeot to applioable City Code provisions.

Seotion S. The City Manager is hereby authorizedl' to
allooate said funds and to enter into agreements, in a form
aooeptable to the City Attorney, with agenoies for the provision
of servioes to persons with AIDS, subjeot to City Commission
approval and applioable City Code provisions.
Seotion 4. This Resolution shall beoome effective
immediately upon its adoption.

PROGRJU4 ABSTRACT
The Rouging Opportunities for Persons With AIDS (HOPWA) Program
for the geographical area of Dade County will be a comprehensive x

effort on the part of the entitlement jurisdictions of Dade -
,a,
County and cities of Hialeah, Miami and Miami Beach to provide a
matrix of services to persons with AIDS or related diseases.
It is anticipated that approximately 45 units of SRO housing will
be developed* including acquisition of the land. Additionally,
approximately 4 community residences which would accommodate
about 6 persons in each are slated for acquisition and
rehabilitation/conversion. Technical assistance in establishing
the community residences will be included in the Program along
with the necessary planning and predevelopment activities.
Short term rent, mortgage, and utility payments will be made to
prevent homelessness of eligible tenants and mortgagors.
Supportive services both associated and not associated with

housing, will be provided. These services will include the broad

range of assistance needed to stabilize clients, i.e., case
management, medical, home, health, food services, psychosocial
counseling and transportation. k

Housing information/referral, fair housing counseling, in—service
education and resource identification, development/planning and
coordination will be integral components of the program.

PROOPAM PLAN
i. An estimate of the number and characteristics of eligible
persons who will be served by the proposed activities and a
description of hoer their eligibility for participation in
the program Will be determined;
According to a recent needs assessment of housing and AIDS
conducted by the Miami Coalition for the Homeless (No Where
to Go - Housing for Persons with HIV/AIDS in Dade County.
1992), over 1100 persons with AIDS - reported cases - have
become homeless or are in imminent' danger of becomming
homeless in Dade County. Estimates place the number of ttIV+
cases at 40,000 in the county. Up to 1,700 homeless persons
are now HIV+, with an unknown number suffering from AIDS.
Providers estimate that 481 of their AIDS/HIV clients have
unmet housing needs. Based on these figures, between 1200
and 2400 persons with HIV/AIDS will need housing services to

prevent homelessness over the coming year.
Proposed activities will provide 4,000 units of housing
information and referral services, both through direct phone {

contact and via participating provider agencies.

Short-term rent, Mortgage and utility payments, will be
provided to 326 persons. Temporary shelter will be provided
for 368 persons, Approximately 70 homeless male persons
with HIV/AIDS will receive shelter services. Acquisition, -
rehabilitation/conversion of community residences will
provide housing for 24 individuals. Acquisition and new
construction of an SRO facility will accommodate 45
individuals.
r' A total of 438 persons with HIV/AIDS will receive housing or -
shelter and 4P00 persons will receive housing
i,xformation/referral and counseling services.
In addition, up to 1,200 persons. (100 per month) will
receive assistance for transportation to supportive
services, and a total of 100 persons will each receive
personal incidentals funding related to their housing of. up
to $100.
Eligible participants will be individuals with HIV/AIDS or
related diseases and their families who are at or below 801
of the median income and are at risk of becomming homeless.
Priority will be based on need, on a first -come, first
served basis. Eligibility for housing assistance or
participation in housing programs will be determined via
utilization of a standardized housing intake form. r

PROORM PLAN
The urgent housing and supportive service needs of eligible
persons not currently being addressed by available public
and private resources and how the proposed activities to be
carried out with HOPWA assistance will address these needs;
also include a description of the public and private
resources that are expected to be made available in
connection with the proposed ROPWA-supported activites.
City applicants must also describe how the proposed
activities will address the needs within the EMSA in which
the city is located, including areas not within the
jurisdiction of the city;
The HIV Services Planning Council, a partner in the planning,
process, reports that more than $17 million public dollars
are allocated each year on care and supportive services for
persons with HIV/AIDS and that• some of these funds can be
targeted to provide for the supportive service needs of
those participating in housing projects associated_ with the
HOPWA Program Plan.
Therefore, as discussed in EXHIBIT 2 No. 1, development and
funding for all types of housing and housing assistance are
a priority need for persons with HIV/AIDS in Dade County.

The Miami Coalition for the Homeless eonAO-d an iftformal
survey of AIDS- and homeless service providers to determine
their perspectives in the development of a program plan.
The program plan presented in this application reflects the
results of needs identified by this group. The plan
involves significant housing information/referral, fair
housing counseling, technical assistance and .resource
.. development and planning and coordination activities during
the second year, in order to develop a collaborative and
effective infrastructure for an emerging long-term plan.
During the first year of HOPWA, the focus was on resource
development, information/referral, short-term housing
assistance to prevent homelessness, with some development of
facilities to provide housing and services. The majority of
supportive services are provided via existing AIDS and
homeless service provider networks. The second year's main
focus is permanent housing.
Providers have identified families with children as a
priority target group for housing programs. in addition,
fair housing issues are considered a priority, as providers
report a high level of housing discrimination against
persons with HIV/AIDS. Many homeless shelter and housing
programs are not prepared to deal with the special needs of
persons with HIV/AIDS utilizing their services. HOPWA funds

will be utilized to address fair housing issues and the need
for in-service programs for homeless service providers.
Thus, the program plan aims to address immediate homeless
prevention needs, coordination and resource development
activities, issues which impact on the effectiveness of
services and programs, the need for the development of
longer -term housing programs, and permanent housing.
The program will attempt to attract matching dollars for
housing programs from private, general public, corporate and
foundation sources.
The Eligible Metropolitan Statistical Areas of Dade County
and the cities of Hialeah and Miami Beach have each and
individually had the opportunity for direct input into the
planning process and formulation for this Program Plan and
have been supplied with the information and data gathered as
a result of this process in order to assure that it
addresses the needs within their individual jurisdictions.

EMSAs will be subject to that particular jurisdiction's Y
approval prior to awarding funds to the project sponsor.

group working on this application decided that the following

network) of informing eligible persons of the housing
assistance and services available and for selecting
participants for the program;
A broad range of outreach activites will be undertaken via
the collaborative of networks between lead agencies (Metro -
Dade HIV Services Planning Council, South Florida AIDS
Network, Health Crisis Network, Miami Coalition for the
Homeless) and service provider agencies. A formal outreach
plan will be developed and implemented by the agency
selected through an application process for housing

Placement into short or long term supportive housing will be
on a first -come, first -served basis for eligible clients of
participating agencies. During this first year, specific
housing projects may or may not be targeted to a specific
sub -group of the eligible population.

6. The procedures that have been, or will be, taken to ensure
coordination of HOPWA assistance With State and local
government agencies responsible for providing services to
persons with AIDS or related diseases and their families,
including, where applicable, coordination with agencies
administering assistance provided under the Ryan White
Comprehensive AIDS Resources Emergency Act of 1990. Also
describe how community -based nonprofit organizations
experienced in caring for persons with AIDS and
organizations which represent persons with AIDS have been
consulted and involved in the application planning process.
In addition, city applicants must describe their
coordination efforts with other units of general local
government located within the EMSA to address needs within
that EKSA.
The Metro -Davie HIV Services Planning Council (Ryan White
Title I); South Florida AIDS Consortia (Ryan White Title
II); Economic Opportunity Family Health Center, Public
Health Trust, and University of Miami School of Medicine
(Ryan White Title III); and the South Florida AIDS Network

(State General Revenue) As well as inAidual service
provider agencies have determined that housing is an urgent
unmet need in this community. They are committed to provide
integration and coordination of services. Clients eligible
for HOPWA program activities would also be eligible for
services funded by these care providers.

Dade County and the cities of Hialeah and Miami Beach have
each and individually had the opportunity for direct input

HOUSING OPPORTUNITIES VOR PERSONS WITH AIDS
GRANT AGREEMENT
This Grant Agreement is made by and between the United States
Department of Housing and Urban Development (HUD) and the C
Miami, Florida (Grantee).
This Agreement will be governed by the following, as they from
time to time may be amended: AIDS Housing Opportunity Act,
42 USC Secs 12901 to 12912 (the Act) , the Housing Opportunities for
Persons with AIDS Program Interim Rule published December 28, 19921
at 57 PR 61736 (the Regulations); all of which are incorporated
herein as part of this Agreement.
The terms "Grant" or "Grant Funds" mean the funds provided
under this Agreement. The term "Application" means the application
submissions on the basis of which a Grant was approved by HUD,
including the certifications and assurances and any information or
documentation required to meet any grant award conditions.
"Project Sponsor" means any private nonprofit organization or
governmental agency that receives funds from the Grantee to carry
out eligible activities identified in the Application. The
Application is incorporated as part of this Agreement.
In reliance upon the Application, HUD agrees, upon execution
of this Grant Agreement, to provide Grant Funds to Grantee in the
amount of $4,697.000.
Grantee agrees to and will ensure that each Project Sponsor
agrees to:
(1) operate the program in accordance with the requirements
of the applicable HUD regulations;
(2) conduct an ongoing assessment of the housing assistance
and supportive services required by the participants in
the program;
(3) assure the adequate provision of supportive services to
the participants in the program; and
j (4) comply with such other terms and conditions, including
+ recordkeeping and reports (which must include racial and
ethnic data on participants) for program monitoring and
1 evaluation purposes, as HUD may establish for purposes of
carrying out the program in an effective and efficient
manner.

Grantee further agrees that it shall supply HUD with all
available, relevant information necessary for HUD to perform any
required environmental review pursuant to HUD regulations at
24 CPR Part 50 (as amended by the Regulations) for each property to
be acquired, rehabilitated, converted, leased, repaired or
constructed with Grant Funds; it shall carry out i6itigating
measures required by HUD or select alternate eligible property; and
it shall not acquire, rehabilitate, convert, lease, repair or
construct property, or commit HUD or local funds to such program
activities with respect to any such property, until it has received
notice from HUD that the environmental review is complete.
A default shall consist of any use of Grant Funds for a
purpose other than as authorized by this Agreement, noncompliance
with the Act or Regulations, any material breach of the Agreement,
failure to expend Grant Funds in a timely manner, or
misrepresentations in the Application submissions which, if known
by HUD, would have resulted in a Grant not being provided. Upon
due notice to the Grantee of the occurrence of any such default and
the provision of a reasonable opportunity to respond, HUD may take
one or more of the following actions:
(a) direct the Grantee to submit progress schedules for
completing approved activities;
(b) issue a letter of warning advising the Grantee of the
default, establishing a date by which corrective actions
must be completed and putting the Grantee on notice that
more serious actions will be taken if the default is not
corrected or is repeated;
(c) direct the Grantee to suspend, discontinue or not incur
costs for the affected activity;
(d) reduce or recapture the grant;
(e) direct the Grantee to reimburse the program accounts for
costs inappropriately charged to the program;
(f) other appropriate action including, but not limited to,
any remedial action legally available, such as
affirmative litigation seeking declaratory judgment,
specific performance, damages, temporary or permanent
injunctions and any other available remedies.
No delay or omissions by HUD in exercising any
available to it under the Agreement shall impair
remedy or constitute a waiver or acquiescence
default.

It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to accept a
grant in the amount of $4,697,000 from the U.S. Department of
Housing and Urban Development in connection with the
implementation and administration of the Housing Opportunities
for Persons With AIDS (HOPWA) Program. The attached resolution
further authorizes the City Manager to execute all the necessary
agreements and documents required in order to implement the
Program.

The Department of Development and Housing Conservation recommends
ratification of the attached resolution authorizing the City
Manager to accept a grant in the amount of $4,697,000 from the
U.S. Department of Housing and Urban Development in connection
with the implementation and administration of the Housing
Opportunities for Persons With AIDS (HOPWA) Program. The
attached resolution further authorizes the City Manager to
execute all the necessary agreements and documents required in
order to implement the Program.
On December 28, 1992, the U.S. Department of Housing and Urban
Development published its Notice of Funding Availability for the
Housing Opportunities for Persons With AIDS .(HOPWA) Program for
fiscal year 1993 in the Federal Register. The Housing
Opportunities for Persons With AIDS Program which was established
under the AIDS Housing Opportunity Act and revised under the
Housing and Community Development Act of 1992 through interim
rule (24 CFR Part 574.100 Subpart B) stipulates that the most
populous unit of general local government in an Eligible
Metropolitan Statistical Area, not including county government,
is' required to be the applicant for this formula allocation
grant. With the City of Miami being the most. populous,; city in
Dade County, the City was designated as the applicant:;for' the
1993 HOPWA funding application.

Subsequently, the Department of Development and Housing
Conservation, on behalf of the City of Miami, in conjunction with
representatives of Dade County and the cities of Hialeah and
Miami Beach worked together in preparing the HOPWA application.
Input was also provided by various organizations and social
service agencies such as the Miami Coalition for the Homeless,
South Florida AIDS Network, Inc., Cure AIDS Now Inc., and the
Dade Partnership for Community and Economic Development in
connection with the preparation of the HOPWA application for 1993
fiscal year funding.
On April 19, 1993, the City of Miami was notified that its HOPWA
application had been approved by U.S. HUD for funding in the
amount of $4,697,000 for the purpose of providing services to
persons with AIDS. The HOPWA funding is being recommended to be
used for the following eligible activities related to providing
services to persons with AIDS:
1. Acquisition, rehabilitation or new construction and
operation of housing facilities.
2. Short-term emergency housing.
3. Temporary shelter.
4. Housing financial assistance.
5. Supportive services.
6. Housing information/referral services.
7. Fair housing counseling.
8. Homeless shelter in-service education.
9. Housing technical assistance.
10. Resource identification and development/planning
coordination.
Adoption of the attached resolution authorizes the City Manager
to accept the $4,697,00 in HOPWA Program funding from the U.S.
Department of Housing and Urban Development and to,execute all
the necessary agreements and documents required in order to
implement and administer the Program.

I am pleased to inform you that your application, submitted in
response to our Announcement of Allocations dated
December 28, 1993, has received funding approval under the HOPWA
Program. This project will provide services to persons with AIDS.
I am sure you appreciate the need for prompt action in using these
funds to assist persons with AIDS.
Upon execution of the HOPWA Grant Agreement by you and HUD,
HUD will obligate funds in the amount of $4,697,000.
Enclosed are three copies of the HOPWA Grant Agreement that
constitutes the agreement between you and HUD. You must sign all
three copies and return them to this Office within two weeks of .
receipt of this letter. When they are executed, we will send you
a copy with original signatures for your files.
Also enclosed are forms you will need to complete and submit
in order to establish a Line of Credit for the HOPWA Program:
1. HUD-27054 1LOCCSV_oiceoonse Access Authorization) and
instructions. This form designates the persons who will be
authorized to draw down funds. Please have each authorized
person complete this form and submit it to the address listed
on the form. When the form is received, HUD will issue a
USERID and password that you will use to request funds.
2. The ,iSP_,1199A 1Diregt,�Deoogit sign-Vo Zorml and instructions.
This form designates the bank account into which HOPWA funds
will be deposited. Funds may be deposited into a new or
existing account. Please complete Part I and send the form to
,your financial institution to complete Part III. Please
instruct your financial institution to return the completed
form to the address in Part II.

It should be- noted that no funds may be disbursed or.'
committed, or expenses incurred to acquire, rehabilitate, convert
lease, repair, or construct property until BUD- has completed -an
environmental review on the sites that you plan to use to assist
persons with BIDS. Please supply this Office with information in
order for us to perform the environmental review. Instructions fore
the grantee's documentation and specific information to be
submitted to this Office have been provided as an enclosure to this
letter.
