ANALYSIS There is no hardship to justify the requested parking variance for a proposed Mixed use development; however the Planning, Building and Zoning Department recognize% the need for residential development in this particular area of the City especially since -it is near a major employment center and a metrorail station. In addition, the proposed development is adjacent to the SD-10 Jackson Memorial Overlay District which permits up .to a M% reduction (644 reduction' requested) in required parking for nonresidential uses due to the district's proximity to the Metrorail system; it should also be noted that the Zoning Ordinance contains a provision for an additional 50% reduction (44% reduction requested) in the number of required parking spaces for affordable housing units (by -Special Exception, with conditions), and the application which was presented for the proposed development contends that 89% of the proposed residential units will be affordable. GOTi:i 0 The Civic Center Plaza (the "Project") is a rental apartment = complex which will include a limited commercial usage, and will be developed by Civic Center Associates# Ltd., the general partner of which is AMC/Tacolcy, comprised of Tacolcy Civic Center, 2ne. and AMC Associates, Ltd. The Project will consist of 189 one, two and - three bedroom units, and first floor commercial space designed to allow for installing a banking service center. The Project is 89* dedicated to low income housing. Low income housing has long been critically needed in Miami r especially in the urea near the Jackson Memorial 8ospital Complex. This need has been exacerbated given the recent destruction of South Plorida housing by Rurricane Andrew. Special circumstances surround this Project given its — dedication to provide low income housing. Because of the demographics of the projected tenants, the proposed =!,?�,,, garkiiiq spaces are sufficient to $set the off-street parking needs mf the Project. This assessment is- based on the parking requirem ots of similar low-income housing prig jects in Miami, which ANave qu= historically required fewer parking spaces than are reired.y-der —_ the respective ordinance. The unusual proximity of vesidengial access to the metro-mover/metro-rail system will furthdr decoase the tenants' need for automobiles, inducing reliance on p%*lic transit and attracting tenants without cars, further reducing parking space requirements. Recent surveys undertaken by the developer indicate that many employees of the neighboring Jackson Memorial Hospital co$ptex can be expected to be tenants, and will = not need any vehicle to commute to work. In addition, public off- street parking facilities with a capacity of over 1500 spaces exist — within one block of the Project, capable of handlinq any conceivable temporary over -demand. - t�i�aes.a.w - - 93- 26$#3 t _ The project is located near Allapattah and Overtown, two economically disadvantaged areas of Niami. it's location has been designated a "Target Area" by the city of Miami, providing for development incentives. such as a reduction of impact fees for projects built in the "depressed" areas so designated. Miami has long had a need for additional affordable urban housing in general, and the need is particularly acute in and around economically _ disadvantaged arias such as where the Project is to be located. _ When completed, the Project will provide an affordable, decent, and attractive housing opportunity for the low-income residents in those areas, filling a vital public need. The location is also adjacent to the Jackson Memorial Rospiital complex, a development :one designed by ordinance to attract users of the nearby Metro -Rail system. Thus, the location is one that will inherently attract tenants who are users of public transportation and who will be less likelp to own or use autamobiles, and accordingly will need less off-street parking. —t - �s MEAW s-66.2= z A review of the public records reveals similar low-income housing projects operating under the same off-street parking —j requirement ratio (1-4) have been granted similar off-street In other Edison9TerraceseProject by Sd soni onsTerraces, Ltd .at So*Fr exehe 67S N.W. TS6 Street.) The off-street parking requirements imposed by the ordinance are unnecessary given the low incomes housing characteristic of the Project. The demographic characteristics of low income neighborhoods in urban Miami indicate fewer cars per family than the ordinance presumes. Additionally, the close proximity to mass - transit access will attract tenants without cars. The planned _ supply of AL� spaces will be sufficient to meet the Project's needs. Therefore, the parking ratio requirements of G/t (R-4) would unnecessarily restrict development of a critically needed resource; quality affordable housing. The hardship imposed -on this petitioner by the literal application of the ordinance is also undue. The literal interpretation of the off-street parking requirements would probably render this Project, and many if not all similar low- income housing projects, financially infeasible in this district by requiring unnecessary parking be developed. 93- 268.3 No special privilege will be conferred on petitioner by grantinq this variance, since petitioner will still be fulfilling the ordinances intent by supplying sufficient off;street parking qiven the nature of the development project. By doing so the project will be in conformance with its neighboring developments, and will not impact th® common off-street pairkinq resources to any significant extent. Granting the variance will be consistent with the treatment afforded similar low-income housing projects within Miami.( liar example: see The Edison Terraces Project by Edison Terraces, Ltd. at 673 W.w. The expected tenant usage of the metro -rail is in consistent with the intent behind the adjacent Jackson Memorial Hospital Complex; which is designed by ordinance to attract users of the metro -rail. Additionally, the Project as a whole will conform with the surrounding developments, which include other high-rise apartment buildings and parking facilities.
