WHEREAS, the Miami Zoning Board at its meeting of March 15,
1993, Item No. 3, duly adopted Resolution No. ZB-33-93 by a five
to four (8-4) vote, granting a Special Exception, subject to
Commission approval, as hereinafter set forth; and
WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, requires City Commission
approval of the special exception as hereinafter set forth; and

WHEREAS, the City Commission after oaareful oonsideratidn of
this matter deems it advisable and in the best interest of th8
general welfare of the City of Miami and its inhabitants to
approve the Speoial Exception and to affirm the deoision of the
Zoning Board;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA: —
Seotion 1. The reoitals and findings oontained in the
Preamble to this Resolution are hereby adopted by referenoe—
thereto and inoorporated herein as if fully set forth in this -
Seotion.
Seotion 2. The deoision of the Miami Zoning Board to -
grant a Speoial Bxoeption from Ordinanoe No. 11000, as amended,
the Zoning Ordinance of the City of Miami, Florida, Artiole 4,
Seotion 401, Sohedule of Distriot Regulations, G/I Government and
Institutional (SD-19 Designated F.A.R. Overlay Distriot)
Permitted Prinoipal Uses, to permit the oonstruotion of a nev -
prinoipal struoture containing mixed uses: 189 residential units,
occupying 178,394 square feet, and non-residential uses 000upying
11,480 square feet for a total of 189,874 square feet for the
property looated at 1099 Northwest 14th Street, Miami, Florida, _
also desoribed as Traot B. Bisoayne Civio Center Plaza, as _
reoorded in Plat Book 118, at Page 63, of the Publio Reoords of -
Dade County, Florida, zoned G/I Government and Institutional, $D =
19 Designated F.A.R. Overlay Distriot, said Speoial Exoeption
having a time limitation of twelve months in whioh a building
permit must be obtained and being subjeot to the oonditions of

the Planning Division of the Planning, Building and Zoning
Department, is hereby affirmed and the Speoial Rxoeption is
hereby granted.
Section 3. This Resolution shall become effective =
immediately upon its adoption. -

As you may recall, at the last meeting (April 15, 1993) during
discussion of agenda items PZ-3, PZ-4, PZ-5, and PZ-6, Mr. Martin
Fine addressed the Commission and after discussion on the issue,
with just one roll call, the Commission acceded to grant Mr.
Fine's request. It just so happens that two of such issues were
appeals, and upon contacting Irma Abeila, she stated her
interpretation to be as follows:

Continued to 3/15/93, applicant invoked the short board rule. Granted on 3/15/93, for 12
mo. in which a bldg. permit must be obtained and subject to conditions of the Planning
Division of the PBZ Dept. Resolution Z8 33-93 by a vote of 5-4. Four proponents were
present at the meeting.
The proposed mixed use development will provide needed residential units in an area of the
City where there is a high employment concentration as well as access to the Metrorail
system. The Planning, Building and Zoning Department recommends approval with the
condition that all other zoning requirements be complied with.

Per Section 1311 of Zoning Ordinance 11000, as amended, the Zoning Ordinance
of the City of Miami, this mmnralnd m requests a review by the City
Ccmmi.ssion, of the Zoning Board's decision which granted a Special Exception
to permit the construction of a raw principal structure containing mixed uses at 1099 N.W. 14 Street. Said Special Exception was granted by the Zoning
Board at its meeting of March 15, 1993, by a vote of five (5) to two (2);

The reason for the appeal is to give the City Commission the benefit of a
complete presentation on the entire proposed dmalvelopmettt at the above -
referenced location; two of the three Special Exceptions being sought required
City CmImission approval in any case, and the requested parking variance,
which was denied by the Zoning Board is hereby also being brought to the City
Commission.

Within the City generally. or within certain toning districts,
certain structures, uses. and/or occupancies Specified in this
ordinance are of a nature requiring special and intensive review
to determine whether or not they should be permitted in specific
locations, and it so. the special limitationn, conditions, and
