A RESOLUTION AMENDING SECTION 2 OF RESOLUTION NO. 93-197, ADOPTED MARCH 28, 1993, THEREBY EXTENDING THE AUTHORIZATION FOR THE FIFTEEN PERCENT (18%) TEMPORARY RATE REDUCTION IN DOCKAGE FEES AT DINNER KEY MARINA TO INCLUDE _ ALL BOAT SLIPS THAT ARE WITHOUT UTILITY SERVICES DURING THE PERIOD OF HURRICANE DAMAGE REPAIRS FOR A PERIOD OF TIME NOT TO EXCEED SIX (8) MONTHS, SUBJECT TO THE CITY BRING ADEQUATELY PROTECTED AGAINST LIABILITY AND DAMAGES. WHEREAS, Dinner Key Marina suffered extensive damage from Hurricane Andrew and has lost considerable revenues for the past seven (7) months; and — WHEREAS, structural repairs are being done in phases under supervision of the Public Works Department and a separate contract has been awarded for specialized renovations to marina utility services; and WHEREAS, Section 83-88 of the City Code provides that the City Manager may establish dockage fee rates based on considerations which include operating expenses, such as utilities; and WHEREAS, since newly repaired slips at Dinner Key Marina will be temporarily without utility service, the Administration, after notification to the City Commission, had instituted a rate CITY CSION MWING OF = APR 15 1993 93- 266 reduction of 18% in the dockage fees due to said lack of utilities; and WHEREAS, subsequent to the City Manager's notice and action, the City Commission has directed that said rate reduction be limited to only those slips used by commercial vessels and that said reduction apply for a period of time not to exceed four (4) months; and WHEREAS, the Public Works and Parks and Recreation Departments anticipate that additional piers will be functional but without utility service in the coming months; and WHEREAS, it is reoommended that these slips also be made available for berthing at a 15% discount in dookage fees; and WHEREAS, said rate reduotion shall have temporary duration for a period of time not to exoeed six (8) months, and shall oease immediately upon restoration of utility services to said slips; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. -2- A 13 Section 2. Section 2 of Resolution No. 90-197, adopted Maroh 28, 1993, is hereby amended in the following particulars1/: "Seotion 2. The City Manager's action in authorizing a fifteen percent (15%) temporary rate reduction in the dockage fees at Dinner Key Marina, as deemed applicable for speoified slips during the period of hurricane damage repairs, is hereby ratified, approved, and confirmed, as modified by the City Commission, providing that said rate reduction shall hereby be limited to vessels docked at commeroFtat a]..1. slips which are without utility seryioes and shall be applioable for a period of time not to exceed four--(4'3 sig (8) months." Section 3. Said authorization is hereby subjeot to and contingent upon the provision that the City be adequately protected against liability and damages. Section 4. This Resolution shall become effective immediately upon its adoption.
