SCHOOL, A SUBDIVISION IN THE CITY OF MIAMI,
SUBJECT TO ALL OF THE CONDITIONS OF THE PLAT AND
STREET COMMITTEE, AND ACCEPTING THE DEDICATIONS
SHOWN ON SAID PLAT; AUTHORIZING AND DIRECTING
THE CITY MANAGER AND CITY CLERK TO EXECUTE THE
PLAT; AND PROVIDING FOR THE RECORDATION OF SAID
PLAT IN THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA.
WHEREAS, the City Department of Public Works recommends the
acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The plat entitled Phyllis Ruth Miller Elementary
School, is a replat of Lots 77 and 78 of SECOND AMENDED PLAT OF
GRIFFING'S SUBDIVISION BISCAYNE HEIGHTS, according to the plat
thereof recorded in Plat Book 2 at Page 78 of the Public Records
of Dade County, Florida, LESS the North 25 feet of Lot 77.
AND
All that portion of the North One -Half (N1/2) of the NE 1/4 of
the NW 1/4 of the NE 1/4 of Section 7, Township 53 South, Range
42 East, Dade County, Florida, lying East of the East Boundary of
Block 5 of NORTH SHORE CREST, according to the plat thereof
recorded in Plat Book 17 at Page 42 of the Public Records of Dade

the plat together with the dedications to the perpetual use of
the public of all existing and future planting, trees and
shrubbery on said property, are also hereby accepted and
confirmed by the City of Miami, Florida,

Section 2. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.
Section 3. This Resolution shall become effective
immediately upon its adoption.

The City of Miami Plat and Street Committee, at Its meeting of
May 8, 1991, approved the above tentative plat subject to the
following revisions being made to the tentative plat, additional
Information being provided and/or variances being granted. Please
be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied.
A special exception will be required to address the
Issue of the preservation of trees on the site (Contact
Sarah Eaton, Planning, Building B Zoning Department at
579-8088).
- The number of tracts must be listed. (Contact Jo Reld,
Planning, Building 8 Zoning Department).
Dedication of the north 10 feet of the site will not be
required. The base building line is Incorrectly drawn.
N.E. 87 Street Is zoned 50 feet In width. (Contact
Len Heimers, Public Works Department).
Show City Limits line.
- Dedication will be required on N.E 8 Court and on N.E.
88 Street with 25-foot radll at corners. Show these
new plat boundaries as a heavy line.
State the assumed to which all bearings are referenced.
- Provide a numerical scale for main sketch. (Not just a
graphic scale).
- Provide name of owner on plat.
- A requirement under this plat will be to connect the
existing fire hydrant to the new 12-Inch water main at
west side of site. (Contact Lt. Robert Florello, Fire.

been correctly executed.

6. In accordance with the requirements of Chapter 54, of the
Code of The City of Miami, Florida, the Bond normally
required will be waived due to the fact this is a Dade
County School Board plat. The improvements required at the
property platted are listed as follows:

AGREEMENT FOR CONSTRUCTION OF CERTAIN IIIPROVBXBNTS
WHEREAS, THE SCHOOL BOARD OF DADE COUNTY. FLORIDA
(OWNER), concurrently with the delivery of this Agreement, has
applied to the THE CITY OF MUM, FLORIDA, (CITY) for the
acceptance and confirmation by the Commission of said City, of a
certain proposed plat of a subdivision to be known as
Phyllis Ruth Miller
Mementary 5chQal - located at ,R fO N.E. 87 S tra _t
a copy of which proposed plat is attached hereto and made a part
hereof as Exhibit "A".
WHEREAS, the execution of this Agreement by the OIiTMER does
not waive his immunity from taxes or special assessments; and
WHEREAS, this Agreement when executed will testify to the
OWNER'S intention to plat and install the required improvements
as set forth herein; and
WHEREAS, the completion of the improvements as set forth
herein will not be required prior to the acceptance of the plat
by the City Commission.
NOW, THEREFORE, the OWNER hereby covenants and agrees with
the City as follows:
1. within one (1) year from the effective date of the
acceptance and confirmation of said plat by the Commission of the
City of Miami, the OWNER will construct, or cause to have
constructed, at his own expense and in accordance with standard
specifications of the CITY, the following listed improvements,
all as shown on the Improvement Sketch, a copy of which is
attached hereto as Exhibit "B" and made a part hereof.

Although one (1) year is allowed for the completion of the
aforementioned improvements, it is not in the public interest
that such construction work should be prolonged to the extent
that it would have a disorganizing effect upon the neighborhood.
After the work is started, the DER hereby agrees to prosecute
said work progressively so as to complete it in a reasonable
length of time as determined by the City's Department of Public
Works.
2. The OWNER will fully and faithfully perform the work in
accordance with the terms of this Agreement and submit to the
City's Department of Public Works a letter from a Registered Land
Surveyor certifying that the Permanent Reference Monuments
indicated on the plat have been installed and properly placed.
IN WITNESS WHEREOF, the OWNER has authorized this Agreement

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt a
resolution accepting the plat Phyllis Ruth Miller Elementary
School, and approving recording the same in the Public Records of
Dade County, Florida.
BACKGROUND:
The Department of Public Works has reviewed this plat, and has
determined that it is now in order for acceptance by the City
Commission.
The proposed record plat entitled Phyllis Ruth Miller Elementary
School is a replat of Lots 77 and 78 of SECOND AMENDED PLAT OF
GRIFFING'S SUBDIVISION BISCAYNE HEIGHTS, according to the plat
thereof recorded in Plat Book 2 at Page 78 of the Public Records
of Dade County, Florida, LESS the North 25 feet of Lot 77.
AND
All that portion of the North One —Half (N1/2) of the NE 1/4 of
the NW 1/4 of the NE 1/4 of Section 7, Township 53 South, Range
42 East, Dade County, Florida, lying East of the East Boundary of
Block 5 of NORTH SHORE CREST, according to the plat thereof
