HomeMy WebLinkAboutR-93-0226J-93-219 3/30/93 RESOLUTION NO. 9 3- 226 A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT(S), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI, AND SEVERAL LOCAL Wi,11CIPALITIES, SPECIFICALLY, THE CITIES OF CORAL GABLES, HIALEAH, AND MIAMI BEACH, FOR THE PURPOSE OF SETTING FORTH THE PARTIES RESPONSIBILITIES IN CONNECTION WITH THE DEVELOPMENT AND SUPPORT OF A LOCAL URBAN SEARCH AND RESCUE TASK FORCE SPONSORED BY THE CITY OF MIAMI FIRE DEPARTMENT, CONTINGENT UPON FUNDING FOR SAID PROJECT BEING SECURED IN THE FORM OF GRANTS AND REIMBURSEMENTS FROM STATE AND FEDERAL SOURCES. WHEREAS, the Robert T. Stafford Disaster Relief and Emergency Assistance Act (Publics Law 93-288, as amended) (the "Stafford Act") provides the authority for the Federal government to respond to disasters and emergencies in order to provide assistance to save lives and protect public health, safety, and property; and WHEREAS, the Federal Response Plan (for Public Law 93-288, as amended) (the "Plan") addresses the consequences of any disaster or emergency situation in which there is a need for Federal response assistance under the authorities of the Stafford Act; and WHEREAS, in accordance with the Plan, the Federal Emergency Management Agency (PEMA) has created a nationwide network of ATTACHMENT ta) CONTAINED cm !-on JUMMG or APR 15 IM ", 93- 226 ` AI�I E, VI Urban Search and Resoue (USYR) Task Forces strategically located throughout the united States; and WHEREAS, the soope of USNR activities in response to a oatastrophio disaster includes locating, extricating and providing for the immediate medical treatment of victims trapped in collapsed structures; and WHEREAS, the National USUR Response System will assist and provide support to local fire departments which sponsor USYR activities and assume responsibility for developing and training a Task Force capable of being deployed within six hours in response to a catastrophic disaster; and WHEREAS, the City of Miami Fire Department is willing to undertake the role of sponsoring organization for purposes of ?' developing an USUR Task Force in Dade County with the participation of members from the Fire Departments from the Cities of Coral Gables, Miami Beach, and Hialeah; and e. WHEREAS, funding for the training of personnel and purchase s of US&R equipment is anticipated in the form of a grant from the 7: State of Florida; and t. WHEREAS, any and all expenses incurred by the US&R Task x Force mobilized at the request of FEMA in response to an event y requiring said assistance are fully reimbursable by F$MA; and WHEREAS, the City of Miami will enter into a Memorandum of Agreement with FENA and the State of Florida whereby the City will assume the responsibility as administrating agency of the US&R Task Force in Dade County; and 93 226 -2- WHEREAS, it is also necessary for the City of Miami to enter into a Memorandum of Agreement with each of the cities which will participate in the USUR Task Force; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized" to execute a Memorandum of Agreement(s), in substantially the attached form, between the City of Miami and several local participating municipalities, specifically, the Cities of Coral Gables, Hialeah, and Miami Beach, for the purpose of setting forth the parties responsibilities in oonnection with the development and support of a local Urban Search and Rescue Task Force sponsored by the City of Miami Fire Department, contingent upon funding for said project being secured in the form of grants and reimbursements from State and Federal souroes. The herein authorization is further subject to oomplianoe with all requirements that may be imposed by the City Attorney. including but not limited to those prescribed by applicable City Charter and Code provisions. -3- 93- 226; Seotion 3. MAYOR MEMORANDUM OF AGREEMENT Fit PARi*ICIPATtV ORIMNIZNIONS This Agreement entered into this day of , 19 , by and between the City of Miami, a municipal corporation of the State of Florida, (the City), and r (the Participating Organization). This Agreement delineate responsibilities and procedures for Urban Search and Rescue (US&R) activities under the authority of "The Robert T. Stafford Disaster Relief and Hmargency Act," Public Law 93-288, as amended, 42 U.S.C. S51211 et s . and relevant state authorities, or when otherwise properly directed. This Agreemmt, (the,mv) contains all the relevant text of a similar MCA entered into between FFMPL, the State, and the City. It is included herein so that the Participating Organization is aware of the obligations each party has to each other that my impact the Participating Organization. II. S10911 The provisions of this M]A apply only to US&R Task Force activities performed at the request of the Federal government according to the Federal Response Pi.an ( for Public Law 93--288, as amended),, which may be provided at the option of the City, the State, and the Participating Organization and in conjunction with, or in preparation of, a Presidential declaration of a disaster or emergency and upon activation as outlined below in section V. PROCSDUIIms. Details concerning specific working relationships on various projects may be ap "ided to this HDA as they are developed. III. IEFINMON A. Activations the formal request by FEKk to a Sponsoring Jurisdiction, via procedures outlined in section V. PROCEDURES, to mobilize and respond utilizing their Task Force. The Task Force is to arrive at a designated point -of -departure within six hours of being activated. B. Alerts the formal notification by FENA to a Sponsoring Jurisdiction, via procedures outlined in section V. PROC=RE.S, that an event has occurred or is projected to occur, and that the Task Fame might be activated. Sponsoring Jurisdictions, placed on alert by FM, should initiate activities which enhance their capability to respond to a pending activation. c:. Associate Director: the Associate Director for the State and Local Programs and Support Directorate, FEbR. D. of Defense (DOD): the DOD, to include the military and civilian vamporsa'its. DOD is the primary agent for coordinating US&R efforts under Emergency Support Function (ESF) #91 US&R, of the Federal Response Plan. IN k. E. Dirwtort Agency. the Director of the Federal Emergency Management F. Disaster Assistance aVlvyee (DAE)! a temporary Federal employee, hired under the provisions of titre Robert T. Stafford Disaster Relief Act. G. Disaster Medical Assistance Tenn (DMAT)t a functional unit activated under the NCM which provides austere medical care in a disaster area or medical services at transfer points and reception sites associated with patient evacuation. H. Elmery Oa Information and Coordination Center (EICC) t a control center located within FEMA headquarters in Washington, DC, which provide inter -agency coordination of assistance to emergency or disaster areas. I. Emergency Support Function (ESP): anr*Lxes to the Federal Response Plan, numbered 1 through 12, that defines functional areas of responsibility, describes organizational strictures, and provides specific assignments to federal agencies and departments to facilitate a coordinated Federal delivery of disaster response assistance to supplement State and local emergency response effort. J. Federal Response Plan: the Federal Response Plan (for Public Law 93-288, as amended), establishes the basis for the provision of Federal assistance to a State and its affected local W"ernments impacted by a catastrophic or significant disaster or emergency which results in a requirement for Federal response assistance. The Plan outlines the planning assumptions, policies, concept of operations, organizational structures and specific assignments of responsibility to the 27 Federal agencies and its, grouped into Emergency Support Functions (ESF), who will provide coordinated response assistance to supplement State and local response efforts. K. FEMk: the Federal O r sneY Menac not Agency.. L. Hurd Match: . mW a process of matching a Sponsoring Jurisdiction s cash expenditure with a cash r+einbwsement at a pacedeteantirn�ed ratio. M. Incident commander: the individual in charge of coordinating response activities within a disaster site. Under normal circumstances this individual will be an emergency manager from the local cats, mity responsible for incident activities including the development and implementation of strategic decisions, and who approves the request and allocation of resources. 93- 226 N. National Disaster Medical System (I): a cooperative effort of the Department of Health and Hunan Services (HHS),t of Defense (DOD) of Veteran Affairs (VA), FENA, and State and local govenstients and the private sector designed to care for a large nisiber of casualties resulting from either a domestic disaster or an overseas war. The Public Health Service (M) heads the program. O. National Emergency Coordinating Center (NEOC): a twenty four (24) hour primary notification center located in Berryville, VA. pfi P. Participating organization: a public, private, or individual entity who has entered into an agreement with the Sponsoring Jurisdiction to provide support (personnel, equipment, services or funding) for the establishment of an US&R Task Force. Q. Soft Match: FEWs process of matching any type of expenditure by Sponsoring Jurisdiction with a cash reimbursement at a predetermined ratio. R. Sponsoring Jurisdiction: the City of Miami,. a municipal corporation of the State of Florida; a public entity providing official sanction to a FM -endorsed US&R Task Force. The City of Miami Fire Departirent will be the administrating agency of the US&R Task Force for the City S. State: the State of Florida. The Division of Energency Management will be the administrating agency of the US&R Task Force for the State. T. Task Force: a tactical component of the Federal Response Plan,, WI-wr, ESF #9 - Uzi= Search and Pascua,, composed of 56 persons divided into functional elements of search,, rescue,, medical,, technical support, and management (refer to the FEK& US&R Response System Manual) . U. Task Forms Raeder: a Sponsoring Jurisdiction's responsible for team training, equipment, mobilization and tactical direction of the Task Force. v. Urban Search and Rescue (US&R): the term used to define the strategy,, tactics and operations for locating, providing madtical stabilization and treatment, and extrication of entrapped victims encountered in natural and man-made disasters. IV. A. PEM agLves to: 1. Provide coordination, when between the City, the local public agency in who's jurisdiction the CiWs Task Force has been sent, the State, and other relevant governmental and private parties. �k- 93- 226 �'N 2. Provide limited funding and technical support for equipment and training specifically aimed at preparing the City's Task Force to be a fully operational Task Force as described in F'EMA's US&R Response System Manual (the US&R Manual). FEKK will also provide assistance to the City in obtaining supplies and equipment from Federal and donor sources for training and use in disaster situations. 3. Provide full reimbursement of all costs incurred by the Task Force, its Participating Organizations, and its Task Force members as outlined in section VI. FINAWIM AGRM40M. 4. Implement F Ws alert and activation procedure by contacting the City wherever called upon to do so by FEMA. 3. Provide limited funding, administrative, and technical support for equipment, training, and staffing specifically aimed at preparing the Task Force to be a fully operational Task Force, as described in the US&R Manual. 4. Provide document control at the State office ensuring that all reports are directed to their respective FEMh Regional. Point of Contact. C. Under "may Support Functim #9" of the Piederal Response Plan, DOD aces to: 1. Provide all transportation of the Task Force between point-of- 1 5 1 -P. disaster sites and return to point -of -departure. 2. Provide logistical, maintenance, and other support to deployed US&R Task Pbrees. 3. Coordinate the replacement and/or rehabilitation of e)Vended, damaged, lost, or destroyed Task Force equipment and supplies used in the course of operations. D. "s City egress to: 1. Provide an administrating agency, which will be the City of Miami Fire Department, auth rilzed to carry out the herein agreed upon responsibilities of the City. 2. Recruit and organize an US&R Task Force, filling the positions to the best of their ability according to the criteria and guidelines described in the US&R Marwal. 93- 226 3. Register and qualify all medical personnel on the Task Force through The U.S. Public Health Services (the "PHS"), as a specialized CHAT. The City will enter into a separate MOt; with the PHS, the terms of which will be appended to this Met mdmn as "Attachment B" when ccnpleted. 4. Provide training, with limited support and guidance from the State and FEMA, to Task Force members. Training will be consistent with the objectives of developing, upgrading, and renewing skills as needed to meet and maintain qualifications for the particular positions on the Task Force according to the criteria and guidelines described in the US&R Manual. 5. Maintain twenty four (24) hour Task Force alert capabilities, including a 24-hour phone number and point -of -contact or duty officer available at all times. 6. Develop, implement, and practice a Task Force personnel call - out and equipment mobilization procedure with the objective of being fully mobilized at a pre -designated point -of -departure within six hairs from time of activation as outlined in section V. PURES. 7. Provide administrative, financial, and personnel managanent as they relate to the Task Force. All original paperwork will be filed with the City with copies, as outlined in section VIII. FZPMM RDQUIRE OM, sent via the State to FM, Federal Response Division, SL-M-FR-OP, Attn.: US&R. B. Develop, maintain and provide accountability for US&R-specific equipment purchased with matching funds from Fes. 9. Provide personnel and equipment for US&R-related training exercises, as agreed upon with FEMN and the State, subject to availability of such Task Force personnel and equipment which will be based upon State and local requirements and priorities at the time such personnel and equipment are needed. Requests for City participation in sanctioned training will be provided to the City in writing. 10. Employ its best efforts to pursue funding for Task Force equipment and training. However, the City shall not incur arm liability for failure to secure funding for this project. 11. Maintain Task Force equipment in a state of readiness and available for use by a Participating Organization on an emergency basis, as agreed upon, and spelled out in the Task Force Standard Operating Procedures. 93- 226 OON 001 "a Participating agrees to (fill in the i;gm pr JAfim blanks and circle all item that apply): 1. Participate in the development of the US&R Task Force by providing one or more of the following: a. Representation on one or more of the following committees b. One or more of the following US&R-related training resources: - instructors: - training props and materials; - facilities (training tower, classroom, meeting room; drill grounds;) -other 2. Place on loan US&R-related equipment and/or supplies,, as described in the US&R Manual, for the development of a standing US&R Equipment Cache. Loaned equipment and supplies shall be listed and identified on forms provided by the City. 3. Provide funds in the amount of to be matched by FEW for the purchase of US&R-related equipment needed by the Task Force for the development of a standing US&R Equipment Cache as described in the US&R Manual. 4. Provide US&R-related equipment and/or supplies, as described in the US&R mmwal, for mobilization and response within six hours to a FEMA and/or State activation. Provided equipuent, and supplies shall be listed and identified on fame provided by the City. 5. recruit and assist in staffing Task Force positions (at a ratio of 3tl), according to criteria and guidelines described in the US&R Manual. Provide and update the names and, personal , 1 _ , -2 information of participating personnel on forms provided by the City. 6. Register and qualify, through the PM as specialized MW all participating medical personnel provided to the Task Force. This includes a separate MW with the PHS. A 7. Provide arid/or make personnel available as manpower permits for US&R-related training which is contiguous with the objectives of dwm1cpin4,, upgrading,, and renewing skills as needed to maintain qualifications for the particular — positions on the Task Force according to the criteria and guidelines described in the US&R Manual. Provide administrative, financial, personnel nmnag=nent as they relate to the participating organizations Task Force Persomml and equipment. Develop, maintain, and provide accountability for US&R specific equipment purchased with matching funds from Fri through the City. 12. Provide the agreed upon persomel and equipment for USSR related training exercises, subject to the availability of such Task Ponce personnel and equipment which will be based upon local rents and priorities at the time such personnel and equipment are needed. In the event the four organizations agree in writing to dissolve and disband the US&R Task Force, the Task Force eTapnent will be appraised within 60 days, by a mutually agreed upon appraiser, and a collar value shall be placed on each individual piece of equipment. 4. A. Alert & ACUVatim 1. upon request from state governments for Federal disaster assistance, or detaim3.nation by FEM that pro -positioning US&R Task Farces is Mx1ent, FEM shall request the activation of forces necessary to respond to the emergerry or disaster situation. Alert notifications can be initiated 'Migard-rfitly by EM. 2. Alert and/or Activation notices shall be camumicated by the EIOC or NEW r through the qPr— State Smirgency Mar>u-ecnera 1, Office, to the City a pre -designated twenty fotw (24) hour emergency point -of -contact. 3. Upon notification fray the State of the Task activation, the City shall inform the State within a reasonable time whether or not they will be responding to the request,, and if responding they shall activate their Task 1111orce VIA th eir pre -establis hed and ppracticed persamnel call - out and eWipnnt mobilization kLWTRWi.W a 7- 1. The City shall mobilize and deploy their Task Foroe persorml and eqiipmft to the pre -designated point -of -departure for pickup by = aircraft within six hours of official activation. 2. Upon arrival at the mobilization center, DOD will provida an on -ground briefing, maps, food and housing (as nKmsary), and other item essential to the immediate deployment and operation of the Task Force. DOD will supply a Liaison officer and a radio operator to each Task Pbrce deployed to a disaster site. 93- 226' aj { C. 3. DOD shall provide transportation to and from the mibilization center and the disaster site. 4. The USER Task Force will operate within the guidelines and constraints outlined in the US&R Manual. 5. Upon carpletion of the US&R. mission, the Task Force shall be redeployed to their original point -of -departure by DOD. 1. Under Emergency Support Function (ESP) #9 - Urban Search and Rescm, of the Federal Response Plan, DOD has the overall w agatent responsibilities of the Task Forces fran their activation to arrival at a declared disaster area, and from deactivation until their return to their original point -of - departure. 2. Tactical employment of US&R Task Forces will be passed fran DOD to the local or on -site Incident Commander within the disaster area. A. Future funding for training and equipment will be allocated as deteunined by FFNh. B. From the time of activation by F'EMK until the Task Force is returned to a state of readiness within the City, the City and its Participating Organizations shall be fully compensated in accordance with the current employee pay schedules, benefits, and policies set forth by the City and its Participating Organizations and/or state, as deteYmfrred by the -parties, and agreed to by the Federal goverment. (See attachment "A" for current hourly rates of Task Force personnel pay schedules and benefits.) C. Any le expense incurred by the City and the Participating Organizations in filling a Task Farce number's position while the Task Force member has been activated, will be paid for by FEM. FEMA will reimburse the Particpating Organization (through the Sponsoring Jurisdiction) and the Spansoring Jurisdiction, the nonttal and usual rates of pay and buck fill costs (ewludi.ng personnel costs associated with the members of the medical teats) accrued as a result of activation of the Task Force by FEM. FEMPi will not pay personnel costs above the n owl and usual rate for that position. It is expressly agreed and by PM, the State, and the City that such personnel costs reasonably include differential overtime oar pensati:on if the organization is required to pay such carpensation costs in filling positions deemed critical for public safety and well being. 93- 226 y`F D. Any reasonable expense incurred by the City and its Participating Organizations for the purpose of mobilizing the Task force in response to a Federal activation and/or alert and demobilizing (returning the Task Force to a state of readiness within the City) shall be paid for by PM. E. Medical Tim personnel shall be registered as a Disaster Medical Assistance Te m members under the guidelines of the M "National Disaster Medical System." (See attachment W - PHS M7U). All medical temp personnel, including employees of the Sponsoring Jurisdiction, are subject to the pay schedule and Federal benefits established through the National Disaster Medical System. MIA continues to work with the PHS to establish more equitable pay schedules for medical team personnel. F. Task Force members shall be reimbursed for travel and per diem costs in accordance with Federal travel regulations, unless otherwise authorized. G. Task Force members shall be reimbursed for reasonable personal costs of operations and maintenance incurred in conjunction with disaster operations. H. Task Force organizational materials, equipment, and supplies consumed while providing requested assistance shall be reimbursed to the City on a replacement basis. Replacement and/or rehabilitation requests shall be submitted to DOD prior to demobilization. I. Rehabilitation or replacement costs of non -expendable operational equipment will be reimbursed if the piece of equipment was used at a disaster site or on disaster exercises, as authorized by FEMR. FEMPi will consider on a case -by- ass, basis -the replacement, of lost or stolen equipment, provided the equipment was not lost or stolen as a result of negligence on the part of the Task Force or its personnel. J. No Task Force or any individual Task Force menbdr shall be reimbursed by hM for costs incurred by activaUm s outside the scope of this MDA. K. The City shall act as central agent for the submission of all reimbIraearsnt claims to FEKh via the State, and the disbursdment of all compensations from PM regarding all PM - Task Farce Activities. 93- 226 -r ow f- r s- _a L. All equipment purchased under this M3A will became the property _— of the City, unless it was received in the name of the Sponsoring Jurisdiction and Participating Organizations jointly. It will then be jointly o4ned and distributed if the Task Force is dissolved under the terns and conditions outlined in Section IV (F), hereof .Equipment purchased and supplied by -- a Participating Organization is the property of that organization on loan to the Task Force. The equipnent supplied by the Participating Organization may be withdrawn from use by _- the Task Force upon advance written notice. M. All financial camaitments made herein are made subject to the availability of funds and the continued mutual agreemaa�ts of _ the parties. - N. With the motion of medical temp persomel, those individuals who are not employees of the Sponsoring Jurisdiction will be either brought onto the Sponsoring Jurisdiction or the State's payrolls as contingent employees for purposes of consolidated billing. If the State or the Sponsoring Jurisdiction cannot _ accwplish this, FEMA will register these individuals as federal employees in conjunction with the National USM - Program. A. Under Section 305 of the Stafford Act, Task force members and their enploying agencies, performing a function under the authority of PL 93-288, as amended, are not liable for any claim based upon the erercise or peof or the failure to exercise or perform that function. B. Task Force members, to include the task force leaders, search, rescue and technical teams are considered Federal employees when activated. Task force members will rennin employed by their respective sponsoring or participating organization for salary and assessments of other benefits; but upon activation, they will became Federal employees for the tort liability purposes of the Federal Tort Claims Act. C. Task Force members engaged in activities outlined in terms of this K A will be afforded the same protection [under the Federal Tort claims act and the Federal Employees' Compensation Act (F .A) against per/xal liability, death, or injury as are regular Federal enp'iTyees for actions taken within the scope of their Federal employment. Federal benefit payments made in reference to this section will be paid to the City or its their participating personnel and their benef icto offset the li.ariies . atJxxw d to 93- 226 �Y— V1iI. RMKIRM M A. The City will submit quarterly financial statements and - activity reports to the State, to be forwarded to the FM Regional Off ice, then to FEMA Ii®adquarters, in accordance with instructions provided by the State. B. The City will submit in writing to the State all personnel changes as they relate to the composition of the Task Force. This includes information of personnel training and qualification upgrades. As new members are admitted to position on the Task Force the relevant portions of the qualifications list will also be submitted to the State. The State in turn will forward this information to the Ma Regional Office who will then forward the information to FM C. A copy of the PHS MOU will be submitted by the City via the State to PM,, Federal Response Division, SIr-OE-FIR-OP, Attn: US&R. D. verification of the Task Force member credentials, as they relate to the criteria outlined in the US&R manual, will be submitted by the City to FEMA via the State on an annual basis and at such other times as requested by FEMA. SUBJECT : Resolution Authorizing Execution of Agreements with Coral Gables, Miami Beach, Hialeah for the development REFERENCES : of a USAR Task Force ENCLOSURES: RrCOMMENDATION t It is respectfully recommended that the City Commission adapt the attached Resolution authorizing the City Manager to execute at a future date, separate Agreements between the City of Miami and Coral Gables; Miami Beach; and Hialeah for the purpose of developing a multi -jurisdictional Urban Search and Rescue (USAR) Task Force. RACKGROUN103 The recent major disaster in Dade County dramatically demonstrated the need for specialized Urban Search and Rescue capabilities in South Florida. With the potential for further catastrophic events, the Miami Fire Department is pursuing the development of an Urban Search and Rescue Task Force. To further this goal and enhance overall disaster preparedness in Dade County, the City of Miami, as a sponsoring organization is inviting the participation of Coral Gables, Miami Beach and Hialeah as participating organizations. This coalition will allow the formation of a Multi -Jurisdictional Task Force that will draw-� resources from a personnel pool of 1200 Firefighters.` The Agreements will provide the necessary guidelines to coordinate _. the Task Force and will become part of and an attachment to the �i agreement entered into between the City, the State and FEMA.
