HomeMy WebLinkAboutR-93-0213J-93-39 (b) 1/7/93 RESOLUTION NO 9 `i - 213 A RESOLUTION AFFIRMING THE DECISION OF THE ZONING BOARD AND DENYING THE VARIANCE FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 6, SECTION 602, SD-2 COCONUT GROVE CENTRAL COMMERCIAL DISTRICT, TO WAIVE TEN (10) OF TEN (10) REQUIRED PARKING SPACES FOR THE EXISTING RESTAURANT (JOHNNY ROCKETS), FOR THE PROPERTY LOCATED AT 3036 GRAND AVENUE, MIAMI, FLORIDA, ALSO DESCRIBED AS LOTS 5 AND 8, CHARLES JOHN PEACOCK, INCLUDING TRACT MARKED ALBERT V. PEACOCIK, AS RECORDED IN PLAT BOOK 6 AT PAGE 32 OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA; ZONED SD-2, COCONUT GROVE CENTRAL COMMERCIAL DISTRICT. WHEREAS, the Miami Zoning Board at its November 23, 1992, Item No. 3, duly adopted meeting of Resolution No. ZB--117-92 by a four to four (4-4) vote, constituting a denial of the variance as hereinafter set forth; and WHEREAS, the applicant has taken an appeal to the City Commission from the denial of the variance; and WHEREAS, the City Commission after careful consideration of this matter finds that no peculiar circumstances exist which impair the owner's right to some reasonable use of the property, and finds no other basis upon wick to grant the variance; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Ordinance No. 11000, as amended, the Zoning Ordinance of the City' of Miami, Florida, Article 6, Section 602, SD-2 Coconut Grove Central Commercial District, to waive ten (10) of ten (10) required parking spaces for the existing restaurant (Johnny Rockets), for the property located at 3036 Grand Avenue, Miami', Florida, also described as Lots 5 and 8, Charles John Peacock, including tract marked Albert V. ANALYSIS Then is no hardship to ,justify the requested variance to waive the ten (10) required parking spaces for a restaurant in the Central Grove Commercial District. No special conditions and circumstances exist which ari pmliar to the building and land involved ` which an not applicable to other buildings and land in the same zoning district. Granting the variance will confer on the petitioner a special privilege that is denied by this toning ordinance to other buildings and land in the sane zoning district. The grant of this variance would not be in harmony with the general intent and purpose of this zoning ordinance and will be injurious to the district and detrimental to the public welfare, particularly in light of the recent parking study which demonstrated a substantial parking deficit in the Central Grove Commercial District.
