A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT THE REPAIR OF DAMAGES CAUSED BY HURRICANE ANDREW TO THE FIRE TRAINING CENTER LOCATED AT 3426 JEFFERSON STREET, MIAMI, FLORIDA, IS AN EMERGENCY; RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S ACTION IN SOLICITING FOR DESIGN -BUILD PROJECT PROPOSALS AS PROVIDED FOR IN FLORIDA STATE STATUTES 287.055; ACCEPTING THE BID OF MET-MAXWELL, J.V., IN THE PROPOSED AMOUNT NOT TO EXCEED $219,708.68, TOTAL BID OF THE PROPOSAL FOR THE DESIGN -BUILD FIRE TRAINING CENTER PROJECT H-1030, WITH MONIES THEREFOR TO BE REIMBURSED FROM PENDING INSURANCE CLAIMS AND F.E.M.A. UNDER PROJECT NO. 313752 AND TO BE ALLOCATED FROM THE GENERAL FUNDS OF THE MIAMI FIRE DEPARTMENT, IN THE AMOUNT OF $219,708.68 TO COVER THE CONTRACT COST PLUS ANY ACTUAL REIMBURSABLE CITY EXPENSES; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM. WHEREAS, the City of Miami, and its environs were victimized by a devastating natural disaster on August 24, 1992; and WHEREAS, under the post-hurrioane circumstances, the workload of projects has increased tremendously and the Department of Public Works will be unable to reasonably complete all projects in the needed time with the personnel in existence; and WHEREAS, it is in the best interest and general welfare of the citizens of the City of Miami to facilitate reconstruction of City facilities which were damaged and/or destroyed due to the passage of Hurricane Andrew; and CZ COMISSION MEETMG OF MAR 2 5 1993 93 plewl"Tab WHEREAS, the. purpose of the "design -build" contract is to expedite the project by giving a criteria package from which the project will be developed, and allowing the design -builder to present a competitive complete proposal for the design and construction of a public project; and WHEREAS, the City Manager has determined that the repair of damages caused by Hurricane Andrew to the Fire Training Center located at 3426 Jefferson Street, Miami, Florida, is an emergency; and WHEREAS, due to said emergency, the City Manager determined that soliciting for proposals for Design -Build Projects, as provided for by Florida State Statutes 287.055 was in order; and. WHEREAS, the City Manager authorized the issuance of said proposals even though the City of Miami had not officially adopted certain provisions of said State Statute; and WHEREAS, the City Commission at its meeting of March 25, 1993, adopted an emergency ordinance which adopted the Design -- Build Projeot provisions of Florida State Statutes 287.055; and WHEREAS, sealed bids were received on February 26, 1993, for the DESIGN -BUILD FIRE TRAINING CENTER PROJECT, H-1030; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend that the bid from Met -Maxwell T.V. be accepted are the lowest responsible and responsive bid; and WHEREAS, the monies shall be reimbursed to the City by pending insurance claims and F.E.H.A. under Project No. 313752 and allocated from the General Funds of the Miami Fire Department; - 93200 -2- NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITE' OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's finding that the repair of damages caused by Hurricane Andrew to the Fire Training Center located at 3426 Jefferson Street, Miami, Florida, is an emergency is hereby ratified, approved and confirmed. Further, the City Manager's action in soliciting for Design -Build Project proposals as provided for in Florida State Statutes 287.088 is hereby ratified, approved and confirmed. Section 3. The February 26, 1993 bid of Met -Maxwell., J.V., in the proposed amount not to exceed $219,708.68. for the project entitled DESIGN -BUILD FIRE TRAINING CENTER PROJECT H-1030, for the total bid of the proposal, based on lump sum and unit prices is hereby accepted at the price stated therein to make repairs to the training center located at 3426 Jefferson Street, Miami, Florida. Section 4. The total construction cost of $219,708.68 plus any actual City expenses will be reimbursed to the City by pending insurance claims and F.E.H.A. under Project No. 313782 and shall also be hereby allocated from the General Funds of the Miami Fire Department. 93- 200 -3- 0 Section S .
