A RESOLUTION RATIFYING, APPROVING AND
-
CONFIRMING THE CITY MANAGER'S ACTION, AS -
MODIFIED HEREIN, IN AUTHORIZING A FIFTEEN
PERCENT (15%) TEMPORARY RATE REDUCTION IN THE —_
DOCKAGE FEES AT DINNER KEY MARINA FOR
COMMERCIAL SLIPS DURING HURRICANE DAMAGE
REPAIRS FOR A PERIOD OF TIME NOT TO EXCEED -
FOUR (4 ) MONTHS.
WHEREAS, Dinner Key Marina suffered extensive damage from
Hurricane Andrew and has lost considerable revenues for the past

six (6) months; and
WHEREAS, structural repairs are being done in phases under
supervision of the Public Works Department and a separate
contract has been awarded for specialized renovations to marina
utility services; and

WHEREAS, the Administration has determined that a rate
reduction of 15% in the dockage fee is appropriate due to the

lack of utilities at these slips; and -
WHEREAS, as the City Commission was advised in a February 3,
1993 memorandum from the City Manager, slips at Pier 8 have been
made available for berthing at a 15% discount in the dockage fee;
and

WHEREAS, said rate reduction Will cease as utility services
are restored to individual slips and piers;
WHEREAS, subsequent to the City Manager's notice and action,
the City Commission has recommended that the rate reduction be
modified to apply only to slips used by commercial vessels which
are in compliance with the terms and conditions of their
respective dockage agreements, and that such reduction apply for
- a period of time not to exceed four (4) months;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager's action in authorizing a
fifteen percent (15%) temporary rate reduction in the dockage
fees at Dinner Key Marina, as deemed applicable for specified
slips during the period of hurricane damage repairs, is hereby
ratified, approved, and confirmed, as modified by the City
Commission, thereby providing that said rate reduction shall
hereby be limited to vessels docked at eommerolal slips and shall
be applicable for a period of time not to exceed four (4) months.
Section 2. This Resolution shall become effective
immediately upon its adoption.

Recommendation
It is respectfully recommended that the City Commission adopt the
attached resolution ratifying, approving and confirming the City
Manager's action in authorizing a 15% temporary rate reduction in
the dockage fees for Dinner Key Marina for specified slips during
the period of hurricane damage repairs.
Background
Dinner Key Marina, a division of the Parks and Recreation
Department, suffered extensive damage from Hurricane Andrew and a
corresponding loss of revenue for the past. six (6) months.
To expedite repairs and the resumption of operations, structural
renovations to this facility are being phased, and a separate
contract has been awarded for the specialized restoration of
utility services. Under Phase 1, Piers 1, 2, and 9 (the
commercial pier) were repaired with utility pedestals borrowed
from other piers in the marinas. These piers were reopened in
late December, 1992, and are currently at 100% occupancy and
generating revenue.
Phase Il has also been substantially completed and the boat slips
along the seawall (Pier 8) are considered to be in suitable
condition for the docking of boats which do not require water or
electrical service. As stated in the attached February 3, 1993
memorandum, in order to meet the public's demand for berthing
space and to generate additional revenue, the Administration has
made Pier 8 slips available for berthing at a 15% discount in
docking fees due to the absence of utility service. Similarly,
as additional piers are structurally repaired and become
available for docking, but are without utility services, the same
15% discount would apply.
When utility services are restored at individual piers, the
dockage discount for vessels at those piers will be discontinued
accordingly.

As I have already informed you, Piers 1, 2 and 9 1the commercial
pier) at Dinner Key Marina are fully operational and have been
reopened. Since their reopening in late December 1992, they have
been generating revenue and today are effectively at: 100%
occupancy.
The boat slips along the seawall (Pier S) are considered to be in
suitable condition for temporary .docking of boats which do not
require water or electrical service. In order to meet the
public's demand for berthing space and to generate additional
revenue, I propose to make Pier 8 slips available for temporary
berthing at a 15% discount in docking fees, i.e., from the
currently established non-lIveaboard rate of $.27 per foot per
(lay to $.23 per foot per day or effectively a .04 per foot per
day reduction. Similarly, if additional piers become available
for temporary docking, but are without utility services, vessel
owners agreeing to berth their vessels at those piers will also
be afforded a 15% discount in their dockage rates. once utility
services are restored and available to individual piers, the
dockage discount for vessels at those piers will be discontinued
accordingly.
Since the agenda for the next City Commission greeting of February
9, 1993 Is closed to new i tems, I am recommending that we
immediately implement this discount rate and then schedule this
item on the next available Commission Agenda for formal
ratification by the City Commission.
As such, if I do not hear any objections from your respective
offices by the close of business Thursday, February 4, 1993, I
will assume your initial approval of this action and immediately
implement the above mentioned discount rate for vessels berthed
at any piers lacking utility services.
