HomeMy WebLinkAboutR-93-0178.1-93-143 02/12/93 RESOLUTION NO. 9 3 17 8 A RESOLUTION APPROVING THE FINDINGS OF THE CONSULTANT SELECTION COMMITTEE AS TO THE MOST QUALIFIED TEAMS, IN RANK ORDER, TO PROVIDE PROFESSIONAL SERVICES FOR THE DESIGN, PREPARATION OF CONSTRUCTION DOCUMENTS AND CONSTRUCTION ADMINISTRATION INCLUDING THE PREPARATION OF AN OPERATIONAL PROGRAM AND A MANAGEMENT PLAN FOR THE TOWER THEATER RENOVATION PROJECT; AUTHORIZING THE CITY MANAGER TO UNDERTAKE NEGOTIATIONS WITH THE MOST QUALIFIED TEAMS, IN RANK ORDER, UNTIL HE ARRIVES AT AN AGREEMENT WHICH IS FAIR, COMPETITIVE AND REASONABLE, AND DIRECTING THE CITY MANAGER TO PRESENT THE NEGOTIATED AGREEMENT TO THE CITY COMMISSION FOR THEIR RATIFICATION AND APPROVAL. WHEREAS, the City of Miami pursuant to Resolution No. 92-575 adopted September 24, 1992, designated as a Category B Project, the acquisition of planning and design services including preparation of construction documents, and construction administration for the Tower Theater Renovation Project; and WHEREAS, Resolution No. 92-575, appointed Herbert J. Bailey, Assistant City Manager, as Chairman of the Competitive Selection Committee and appointed a Certification Committee of not less than three professionals in the fields of endeavor or practices involved, to review the qualifications and related CIT! CC MMOSION riNG or MAR 1 1 M3 fi"Olu" Ift 93- 178 Information provided by those responding to the City's Request. for Proposals for Professional Services; and WHEREAS, the City of Miami issued a Request for Qualifications (RFQ) for professional architectural, engineering and cinema design /operation/management consultant services on November S, 1992; and WHEREAS, the Certification Committee along with the Competitive Selection Committee evaluated the proposals received January 8, 1993, in response to the City's Request for Qualifications, and selected in rank order, the three teams most qualified to provide the required professional services for this project; and WHEREAS, the selection procedures were performed in accordance with the Competitive Negotiation Act as defined in F.S. Section 287.055, and City of Miami Ordinance 9572, codified as Section 18.52.3 of the Code of the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. - 2 93- 178 Section 2. The City Commission hereby authorizes the City Manager to negotiate an agreement on behalf of the City of Miami with the Team ranked first as set forth in Section 2 herein. In the event that the City *tanager cannot negotiate an agreement which, in his opinion, is fair, competitive and reasonable with the Team ranked first, then he is hereby authorized to terminate -4- 93-- 178 such negotiation and to proceed to negotiate with the second most s� qualified Team. Tn the event that he fails to negotiate a satisfactory agreement with the second Team, then he is authorized to undertake negotiations with the third most qualified Team. Section 4. The City Manager is hereby directed to present the negotiated agreement to the City Commission at its earliest scheduled meeting for their ratification and approval. Section 5. Odio City Manager r� SUBJECT : Authorization to Negotiate Agreement/ Tower Theater REFERENCES: Renovation For March 11, 1993 ENCLOSURES :Commission Meeting It is respectfully recommended that the City Commission adopt the attached Resolution, approving the findings of the Competitive Selection Committee as to the most qualified Teams, in rank order, to provide professional services for the planning, design, preparation of construction documents and construction administration of the Tower Theater Renovation project; authorizing the City Manager to undertake negotiations with the most qualified Teams, in rank order, until he arrives at an agreement- which is fair, competitive and reasonable and directing the City Manager to present the negotiated agreement to the City Commission for their ratification and approval. *.(01110 The Department of Development and Housing Conservation, Development Division, recommends that the City Commission authorize the City Manager to undertake negotiations to arrive at an agreement for professional architectural, engineering, cinema design/operations/management consultant services for the Tower Theater. located at 1508 S.W. 8 Street in Little Havana, Miami, Florida. On September 24, 1992 by Resolution No. 92-575, the City Commission designated as a Category B Project, the acquisition of planning and, design services including preparation of construction documents for the Tower. Theater Renovation project. In accordance with the Competitive Negotiation Act as defined in F.S. Section 287.055, and City of Miami Ordinance 9572 which appears as Section 18.52.3 of the Code of the City of Miami, the consultant selection process was carried out as outlined in the attached reports of the proceedings of the Certification and Selection Committee meetings. 93- 178 Honorable Mayor and Members of the City Commission Page two In summary eight (8) proposals were submitted of which sJ.x (6) were certified by the Certification Committee. The Competitive Selection Committee decided to short-list four ( 4 ) and proceeded to hear presentations and interview the four teams. A summary of the proceedings of this meeting is found below. Eight (0) proposals were received on January 8, 1993 at the City Clerk's office. of the eight (8) proposals reviewed by the Committee two (2) were not certified for the following reasons: (Please refer to the attached list• for the identification of the Team per letter designation). 1. Team A- This submission was substantially incomplete in that the proposed team did not favorably demonstrate its capability and adequacy of personnel with respect to the cinema operation and management expertise required for this project. 2. Team E- This submission was substantially incomplete in that the proposed team did not favorably demonstrate its capability and adequacy of personnel with respect to the cinema operation and management expertise required for this project. Several proposals failed to submit current proof of incorporation as required in the RFQ. However, the Committee decided to waive these irregularities and contact by phone the Corporate Division of the State of Flo"rida and several other states. A summary of the proceedings of this meeting is as follows: 1. A list of the certified proposals including the names of all team members and their respective proposals was provided to the Committee. 2. The scope of the project and.the RFP document were discussed to ensure a common level of understanding of the project. 3. The Committee began its evaluation of each certified proposal by discussing the expertise and benefits of each proposal. 4. after summarizing the committee members individual rank for each team, the Selection Committee members discussed and voted unanimously to "short-list" for presentations and interview the four (4) top ranked proposals (see attached list). The Committee determined the schedule for presentations to be held January 29,1993 at the times specified in the attached document. When this exercise was completed, the meeting was adjourned. The four short-listed teams were invited to make presentations. Team D (Zyscovich, Inc.) declined because of a change in the composition of its team. A summary of the proceedings of this meeting is as follows: 1. The project, date and committee members were introduced for the record, followed by general announcements regarding the "Government in the Sunshine Law". 2. Staff informed the Committee of the Consultant Selection Schedule, noting that on March 11, 1993, the City Commission will be asked to authorize the City Manager to enter into contract negotiations commencing with the #1 ranked proposer. 3. The evaluation criteria, scoring, ranking as established in the RFP was discussed and accepted by the Committee. 4. Three teams (H, G, and B) made their presentations as scheduled by the Committee. At the beginning of each presentation session, the Chairperson advised each Team of the presentation requirements per the RFP. S. In between presentations and at the conclusion of all presentations, the Committee discussed the merits of the Teams and their range of expertise and experience. b. Once the presentations were concluded, staff recommendations related to Minority and Women Business Participation scoring, points deducted for previous' work with the City and points deducted for the Prime consultant offices not located within the City of Miami, were incorporated into the Presentation Evaluation forms. 7. The Committee completed its individual scoring and ranking on individual evaluation forms which were signed and dated. The ranking of each Team was announced publicly by each Committee member and recorded in the Ranking Summary form by staff. Each Team's new total score was then ranked based on the lowest score receiving a rank of #1, the next highest score a rank of #2; and the next highest score, the rank of #3. (see attached Ranking Summary form.) 9. The results, which were accepted by the Committee as its recommendation to the City Manager, are as follows: Rank Team 1 Bermello, Ajamil & Partners,Inc.
