RESOLUTION NO. 9 3 - 144
A RESOLUTION REQUESTING METROPOLITAN DADE
COUNTY, THROUGH ITS DEPARTMENT OF
ENVIRONMENTAL RESOURCES MANAGEMENT (DERM), ON
BEHALF OF THE CITY OF MIAMI, TO CONTRACT FOR
PACKAGING, TRANSPORTATION AND DISPOSAL OF 31
DRUMS OF STABILIZED PESTICIDES AND OTHER
RELATED MATERIALS, CURRENTLY STORED AT THE
BOBBY MADURO BASEBALL STADIUM, MIAMI,
FLORIDA, AT A COST NOT TO EXCEED $20,800.00,
WITH FUNDS THEREFOR BEING AVAILABLE FROM
SPECIAL PROGRAMS AND ACCOUNTS, ACCOUNT
NO. 921002-340 TO REIMBURSE DERM; FURTHER,
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the Department of Parks and Recreation, during the
course of routine maintenance at all City parks and facilities
uses various pesticides and other related materials; and
WHEREAS, if said pesticides and/or related materials were to
leak and contaminate the soil and environment, it oould result in
an unsafe condition and the levying of fines by the Dade County
Environmental Resource Management Office (DERM); and
WHEREAS, various pesticides stored at the Bobby Maduro
Baseball Stadium have begun to oorrode their storage vessels and
could cause a contamination of the atmosphere and ground of the
surrounding areas; and
WHEREAS, the City of Miami Department of Fire, Rescue and
Inspection Services and DERM, recommend that said materials be

properly packaged and disposed of by a qualified and experienced
firm; and
WHEREAS, Metropolitan Dade County through DERM is hereby
requested to enter into the necessary agreements on behalf of the
City to a000mplish suoh disposal; and
WHEREAS, the City Manager is hereby authorized to execute
all necessary doouments to a000mpltsh said disposal; and
WHEREAS, DERM has agreed to oontract for the required
disposal servloes, and to supervise said disposal; and
WHEREAS, funds in the amount not to exceed $20,500.00 are
available in ,Special Projects and Accounts, Account
No. 921002-340 for said purposes; and
WHEREAS, said funds shall be used to reimburse DERM upon
completion and acoeptanoe of the disposal work and presentation
of invoices for said work;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Metropolitan Dade County, through its
Department of Environmental Resources Management (DERM), is
hereby requested on behalf of the City of Miami, to contract for
the packaging, transportation and disposal of 31 drums of
stabilized pesticides and other related materials currently
stored at Bobby Maduro Baseball Stadium, Miami, Florida, at a

available from Speoial Projeots and A000unts, A000nnt
No. 921002-340 .
Seotion 3. The City Manager is hereby authorized`/ to
exeoute all the neoessary documents, in a form aooeptable to the
City Attorney to a000mplish said disposal.
Seotion 4. This Resolution shall beoome effeotive
immediately upon its adoption.

ENCLOSURES:
It is recommended that a resolution be approved requesting
Metropolitan Dade County through its Department of Environmental
Resource Management (DERM), on behalf of the City of Miami, to
contract for the packaging, transportation and disposal of 31
drums of pesticides and other related materials being stored at
Bobby Maduro Baseball Stadium. The funds are available from
Special Projects and Accounts No. 912002/340.
For several years the Department of Parks and Recreation have
stored unused pesticides and other related materials, used for
routine maintenance at Bobby Maduro Baseball Stadium. Because of
the corrosive nature of the material stored, corrosion has begun
in the storage vessels. DERM has found the unstable nature of the
pesticides and brought it to our attention. If they are not
removed and disposed of, they can become a contaminate and would
have to be removed under emergency conditions. This being the
case, places the City in the position of being fined, not to
mention contaminating the atmosphere and the ground.
These pesticides must be packaged, transported and disposed of by
a professional firm specializing in this type of activity. An
estimate to complete this task is not to exceed $20,500.00
dollars.

Funds are available to cover the coat for removal and disposal
- of 31 drums of pesticides and other related materials stored at
Bobby Maduro Baseball Stadium. The cost of this project is
$20,500.00. The funds are available from Special Projects and
Accounts No. -4i-2002,340.
