A RESOLUTION, WITH ATTACHMENTS, RECONFIRMING
RESOLUTION NOS. 89-548 AND 91-468, WHICH
ESTABLISHED THE FLAGLER/CORE AREA SECURITY
DISTRICT SPECIAL IMPROVEMENT DISTRICT AND THE
FLAGLER%CORE AREA SECURITY DISTRICT SPECIAL
IMPROVEMENT DISTRICT EXPANSION DISTRICT,
RESPECTIVELY, AND DETERMINING THAT SECURITY
AND SIMILAR SERVICES, AS DECLARED BY
RESOLUTION NOS. 89-820 AND 91-670,
RESPECTIVELY, AND SUBSEQUENTLY EXTENDED
THROUGH MARCH 7TH, 1993, BE ONCE AGAIN
COLLECTIVELY EXTENDED THROUGH MARCH 7TH,
1994, FOR A PERIOD OF ONE YEAR; ELIMINATING
STREET MAINTENANCE AS AN ASSESSED ITEM;
ESTABLISHING AND LEVYING SPECIAL ASSESSMENTS
AGAINST PROPERTIES IN SAID DISTRICTS
BENEFITING BY THE PROVISION OF SAID SERVICE
FOR SAID ONE YEAR PERIOD, IN ACCORDANCE WITH
THE FINAL ASSESSMENT ROLL TO BE FILED WITH
THE CITY CLERK; AND AUTHORIZING THE CONTINUED
USE OF AN ARMED PRIVATE SECURITY SERVICE TO
PROVIDE THE SUBJECT SERVICE.
WHEREAS, Chapter 170, Florida Statutes (Supp. 1992),
authorizes the levy and collection of special assessments against
property benefited for the purpose of stabilizing and improving
Retail business districts, Wholesale business districts,
Nationally recognized historic districts, or any combination of
such districts, through promotion, management, marketing and
other similar services in business districts of a municipality;
and
WHEREAS, on June 7, 1989, Pursuant to Resolution
No. 89-546, the City Commission declared the Flagler/Core Area

Security District ("District") to be a Special Improvement
District for the provision of the above specified services in
accordance with applicable provisions of Chapter 170, Florida
Statutes, as amended; and
WHEREAS, a preliminary assessment roll was filed with the
Office of the City Clerk indicating the area to be improved, the
property to be assessed and the amount to be assessed against
each parcel of property to be benefited, as required in Chapter
170 of the Florida Statutes; and r
WHEREAS, on July 13, 1989, pursuant to Resolution
No. 89-651, the City Commission scheduled and thereafter held a
public hearing on September 14, 1989, to hear testimony from all
affected property owners and any other .interested persons
regarding the propriety, advisability and cost of making
improvements in the Flagler/Core Area Security District; and
WHEREAS, all affected property owners had received
appropriate notice of said public hearing as prescribed by
Chapter 170, Florida Statutes; and
WHEREAS, all complaints, comments and objections by
interested persons and affected property owners were received at
said hearing and thereafter treated on the basis of justice and
right as reflected herein in regard to the improvements and the
assessments; and
WHEREAS, on April 11, 1991, pursuant to Resolution
No. 91-292, the City Commission, after a public hearing,
extended the term of the Flagler/Core .Area Security District for
an additional year; and

WHEREAS, all affected property owners had received
appropriate notice of the above mentioned public hearing and were
given an opportunity to present testimony on the subject
extension; and
WHEREAS, on April 30, 1992, pursuant to Resolution
No. 92-249, the City Commission after a public hearing, extended
the term of the Flagler/Core Area Security District for an
additional ninety (90) days to allow for additional property
owners' input regarding the subject program; and
WHEREAS, subsequent to said Resolution No. 92-249, the
affected property owners, along with the Downtown Development
Authority and the Downtown Miami Business Association, thereafter
held three open meetings to discuss various security concerns and
alternatives; and
WHEREAS, at the last of said meetings a vote was taken,
among the affected property owners, in favor of continuing the
Flagler/Core Area Special Assessment District through
March 7, 1993, continuing the City of Miami Police Ranger
Program, subject to issuance of a Request for Proposals find
contracting for armed private security services for the
Flagler/Care Area Special Improvement District and the Expansion
District; and
WHEREAS, On July 9, 1992, the City Commission adopted
Resolution No. 92-473 again extending the District for a period
of one hundred nine -two days (through March 7, 1993) and
extending the Ranger Program through September 30, 1992, at which
time it would be replaced by an armed private security service;
and

WHEREAS, on September 24, 1992, the city Commission,
pursuant to Resolution No. 92-576, ratified the use of an armed
private security service to provide security in the two subject
districts and funded said security provision through a special
assessment on the benefited properties; and
WHEREAS, on September 11, 1991, pursuant to Resolution
No. 91-670, the city Commission established the Flaglerfcore
Area Security District Special Improvement District Expansion
District ("Expansion District") and levied special assessments
against properties in said district benefited by the services
funded by the assessments; and
WHEREAS, the actual assessment and provision of services
pursuant to Resolution No. 91-670 were initiated for a one year
period which actually commenced on March 8, 1992; and
WHEREAS, on January 22, 1993, the Property owner's Advisory
Committee, consisting of representations of the affected property
owners, met and made the following recommendations: 1) extension
of the subject Districts and for an additional year
(March 81 1993 through March 7, 1994); 2) retention of
Wackenhut for District Security Services; 3) elimination of the
Maintenance Budget Line Item and application of said funds for
additional security services; and 4) maintenance of assessment
rates at the same levels as the previous year; and
WHEREAS, on February 3, 1993, after all property owners
within the district who are presently assessed for security and
maintenance services were notified of the Meeting along with the
recommendations of the Property ownersAdvisory Committee,. -a

general Property owners' Meeting was held by the Downtown
Development Authority to elicit comments from the affected
districts' property owners; and
WHEREAS, upon consideration of said recommendations, the
affected property owners present at said meeting voted and
unanimously approved the recommendations of the Property Owners'
Advisory Committee; and
WHEREAS, the Flagler/Core Area Security District and the
Flagler/Core Area Security District Special Improvement District
Expansion District have been deemed a successful element in the
ongoing effort to stabilize and improve the Flagler/Core Retail
area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDAt
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 89-548, which ordered the
creation of the Flagler/Core Security District Spacial
Improvement District and Resolution No. 91-468, which ordered the
creation of the Flagler/Core Area Security District Special
Improvement District Expansion District ("Expansion District"),
are hereby reconfirmed, and it is hereby determined that the
properties served by the provision of additional security and
other similar services, as declared by Resolutions Nos. 89-828
and 91-468, as amended and extended by subsequent resolutions

identified in the Preamble hereto, are benefited by the
stabilization and improvement resulting from implementation of
the subject districts. Consequently said security services shall
continue to be provided by the City of Miami in the Flagler/Core
Area Security District and the Expansion District for the time
period set forth below.
Section 3. The subject assessments shall be solely for
the purposes of providing for additional security and similar
services in the subject districts, but shall no longer be used
for supplemental street maintenance.
Section 4. This improvement shall consist of security
services and other similar services to be provided in and to The
Flagler/Core area business district and Expansion District. The
benefit, enhancements, and improvements to said districts are as
follows:
Security Services $347,256.63
City Administrative Fee $ 7,086.87

Total: $354,343.50
Section 5. This improvement shall be designated in all
proceedings, assessments and legislation as the Flagler/Core Area
Security District Special Improvement District and Expansion
District. The property upon which special assessments shall be
made in the amount of Three Hundred Fifty -Four Thousand Three
Hundred Forty -Three Dollars and Fifty Cents ($354,343.50),
representing one hundred percent (100%) of the total estimated
cost of said improvements based on property use, with special
assessments ranging from .175 mills to .928 mills of property
value, is hereby designated as follows:

8. Buildings intended predominantly for
office use, surface parking lots and
vacant land shall be assessed at .175
per $1,000 of assessed value;
b. All other buildings shall be assessed at
$.928 per $1,000 of assessed value.
Section 6. A final assessment roll shall be promptly
filed with the City Clerk's office in accordance with this
Resolution and the applicable provisions of Chapter 170, Florida
Statutes. Such assessments contained in said assessment roll are
hereby levied and stand confirmed and remain legal, valid and
binding special assessment liens upon properties against which
such, assessments are made, until paid. These assessments shall
be recorded in the "Improvement Lien Book" and the final
assessment roll shall list the lots and lands assessed and the
amount of benefit as to each such lot or land and the manner of
payment of such assessment to be paid by all lots and lands
adjoining and contiguous or bounding and abutting upon such
improvements or specially benefited thereby and further
designated by the assessment plat hereinafter provided for and
more particularly described on "Composite Exhibit A", attached
hereto.
Section 7. An additional one year extension (until
March 7, 1994) of the Flagler/Core Security District Special
Improvement District and the Flagler/Core Area Business District
Special Improvement District Expansion District and their
respective attendant Special Assessments is hereby declared.

Said extension shall be supplemental to that authorized by
Resolutions Nos. 89-828, 91-292, 92-248 and 92-473, and in
accordance with the final assessment roll to be filed forthwith
with the City Clerk.
Section 8. The final assessment roll, special
assessments levied therefrom, benefit period, and billing period
shall only be for a one year time period of March 8, 1993,
through March 7, 1994,
Section 9. Resolution Numbers 89-828, 89-548, 89-626,
91-292, 92-248, 92-473, 91-468 and 91-670 are hereby incorporated
herein by reference thereto, as if fully set forth herein.
Section 10. The continued use of an armed private
security service is hereby authorized to provide the security
services required pursuant to the subject special districts.
Section 11. This Resolution shall become effective
immediately upon its adoption.

Recommendation
It is respectfully requested that the City Commission approve
the attached Resolutions extending the Flagler/Core Area Security
District Special Improvement District Expansion District
(collectively referred to herein as "Districts") and the
Wackenhut Contract for Security Services for said Districts for a
period of one (1) year, and approving the sum of $347,256.00 to
pay for said provision of security services. The above contract
amount shall be fully funded by an assessment on benefited
properties.

On September 11, 1991, pursuant to Resolution No. 91-670, the
City Commission established the Flagler/Core Area Security
District Special Improvement District Expansion District
("Expansion District") and levied special assessments against
properties in said district benefited by the services funded by
the assessments, and the actual assessment and provision of
services pursuant to Resolution No. 91-670 were initiated for a
one year period which actually commenced on March 8, 1992.
On September 24, 1992, the City Commission adopted Resolution
No. 92-576 authorizing a contract for armed private security
services with the Wackenhut Corporation for the District for only
a five (5) month period, through March 7, 1993. As of March 7,
1993, the present Districts and contract for Wackenhut Security
Services will expire.
On January 22, 1993, .the Property Owners Advisory Committee met
and made the following recommendations: 1) extension of the
District for an additional year (March 8, 1993, through March 7,
1994); 2) retention of Wackenhut for District Security Services;
3) elimination of the Maintenance Budget Line Item and
previous year.
The Proposed Assessment Rates for properties within the District
are as follows: $.175/$1,000 of Assessed Valuation for surface
Parking Lots, vacant band and Office Building uses; and
5.928/$1,000 of Assessed Valuation for All Other Building uses.
The Total Proposed Assessment for the period in question (March
8, 1993-March 7, 1994) is approximately $354,344, which fully pay
for the proposed contract modification.
On February 3, 1993, a Property Owners Meeting was held to elicit
comments from District Property Owners. All property owners
within the Districts, presently being assessed for security and
maintenance services, were notified of the meeting along with the
recommendations of the Property Owners Advisory Committee. Upon
consideration of the recommendations the property owners present
voted and unanimously approved the recommendations of the
Property Owners Advisory Committee.
It is respectfully requested that the Miami City Commission
approve the attached, extending said Districts to March 7, 1994,
and the Wackenhut Contract for Security Services to March 7,
1994.
