HomeMy WebLinkAboutR-93-0123J--93-55 2/17/93 RESOLUTION NO. 93 e 123 A RESOLUTION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE REVOCABLE PERMIT DATED MARCH 2, 1987, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND SOUTHWEST SOCIAL SERVICES PROGRAM, INC., FOR THE PURPOSE OF CLARIFYING THE DESCRIPTION OF THE PREMISES UTILIZED BY SAID CORPORATION AT A PORTION OF FLAGAMI PARK, AS SET FORTH IN SECTION 1 OF SAID REVOCABLE PERMIT, AND ALLOWING FOR THE UTILIZATION OF ADDITIONAL SPACE AT FLAGAMI PARK BY SOUTHWEST SOCIAL SERVICES PROGRAM, INC., SUBJECT TO CERTAIN CONDITIONS. WHEREAS, on March 2, 1987, the City of Miami issued a Revocable Permit to Southwest Social Services Program, Inc., a Florida not for profit corporation, authorizing said corporation to enter upon and use an area of approximately five thousand four hundred fifty-five (5,455) square feet in the northeasterly portion of Flagami Park, for the purpose of serving meals to and providing educational and recreational activities for the elderly; and WHEREAS, Southwest Social Services, Program, Inc. requires additional space for the purpose of expanding the aforementioned activities and is in the process of obtaining government funds in an amount sufficient to undertake said expansion; CITr COMMIMCH DFEE?1NO OF ATTACHMENT () FE9 2 5 4993 CONTAINED a"WvemxO. 93- 123 rdv. The City Manager is hereby authorizedIJ to execute an Amendment to the Revocable Permit dated March 2, 1987, in substantially the attached form, between the City of Miami and �= Southwest Social Services Program, Inc. for the purpose of " clarifying the description of the premises utilized by said Corporation at a portion of Flagami Park, as set forth in Section 1 of said Revocable Permit to reflect that the five thousand four hundred fifty-five (5,4E55) square feet referenced in said section describes gross building area and the actual site area consists of sixteen thousand, seven hundred ninety-two point twenty seven (16,792.27) square feet and further allowing Southwest Social Services Program, Inc. to utilize an additional area consisting of approximately three thousand five hundred eighty one (3,581) square feet of site area and a structure situated therein subject to said Corporation obtaining funds in 1/ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. -2- an amount sufficient to undertake certain expansion and renovation of the facility located at said area. - Section 3. WITNBSSETH: WHEREAS, CITY on March 2, 1987 issued a Revocable Permit, ("REVOCABLE PERMIT"), for a twenty-year period commencing on the 12 day of January, 1987, authorizing PERMITTEE to enter upon and use an area of approximately five thousand four hundred fifty- five (5,455) square feet in the northeasterly portion of F1agami Park, for the purpose of serving meals to and providing educational and recreational activities for the elderly; and WHEREAS, Section 1 of the REVOCABLE PERMIT is hereby clarified as follows: Section 1 of the REVOCABLE PERMIT is hereby clarified in that the five thousand four hundred fifty-five (5,455) square feet referenced in said section describes gross building area and the actual site area consists of sixteen thousand seven hundred ninety-two point twenty seven (16,792.27) square feet; and WHEREAS, PERMITTEE, requires additional space for the purpose of expanding the aforementioned activities and has applied for funds available from the federal government for said purpose; 93- 123 NOW, THEREFORE, the REVOCABLE PENT issued to PERMITTEE is hereby amended as followst 1. All the foregoing recitals are incorporated into these covenants as if fully setforth herein. 2. Subject to the condition precedent setforth in Section 3 hereof, PERMITTEE is authorized to use an additional area consisting of approximately three thousand five hundred eighty one (3,581) square feet of site area and a structure situated therein, designated Parcel A, plus an additional 346.1 square feet of site area, designated Parcel B. Parcel A and Parcel B ("the ADDITIONAL PROPERTY") are described in Exhibit "A", which is attached hereto and made a part hereof. 3. This amendment to the REVOCABLE PERMIT shall become effective only upon PERMITTEE receiving funds sufficient to successfully undertake and complete construction of the improvements to the ADDITIONAL, PROPERTY. 4. PERMITTEE hereby acknowledges and agrees that the terms and conditions of the REVOCABLE PERMIT hereafter shall cover the ADDITIONAL PROPERTY as if it had been included in the Premises at the time the REVOCABLE PERMIT was initially issued and reference to the Premises or demised premises, as originally described in Exhibit "1" of the REVOCABLE PERMIT, shall be deemed to refer to and include the ADDITIONAL PROPERTY described in Exhibit "A". Od City Manage ENCLOSUPEsPor City Commission Meeting of 2/25/93 It is respectfully recommended that the City Commission adopt a Resolution, with attachment, authorizing the City Manager to enter into an Amendment to the Revocable Permit issued to Southwest Social Services Program, Inc., located in Flagami Park, 25 Tamiami Boulevard, Miami Florida, clarifying the description of the premises and allowing the inclusion of additional space which will be contingent upon the Permittee's receipt of sufficient financing to complete improvements to the additional property. The Southwest Social Services Program, Inc. (SSSP) has occupied space in the northeasterly portion of Flagami Park under a Revocable Permit effective January 12, 1987 through January 11, 2007 at an annual $1.00 fee. The facility, named Badia Senior Center, and constructed by SSSP, is utilized for the purpose of serving meals and providing educational and recreational activities for the elderly. The Revocable Permit describes the premises as 5,455 square feet, however this reflects gross building area and the actual site area consists of 16,792 square feet. The services provided by this nonprofit agency are designed to provide senior citizens, particularly those in greatest social or economic need, with nutritionally sound meals and other related services such as social group services, arts, crafts, counseling, information and referral, in addition to promoting better health through improved nutrition. These services help reduce the isolation of old age and provide a link to other social and rehabilitative services. The three centers operated by Southwest Social Services Program provide nutritional and supportive services to 11725 residents of the city of Miami, the Flagami area, Westchester and South Dade. Congregate meals, home delivered meals, transportation and supportive services are distributed to clients on a waiting list and the agency distributes on a monthly basis 700 packages of Red Cross Emergency Food. 93- 123 3-1 Honorable Mayor and Members of The City Commission Page 2 The site operated by Southwest Social Services Program is seriously overcrowded while the waiting list, currently over 250, continues to grow. The agency has maximized its crowded space, however the ever increasing number of individuals seeking services has led to conditions which do not adequately permit staff to serve the elderly. The senior center's recreational activities particularly require additional space. A City -owned abandoned building on the south portion of Flagami Park of approximately 3,581 square feet of site area is available. This abandoned building was utilized for a number of years by the Parks Department Programs for the Handicapped, however, it was abandoned due to the structural deterioration of the building. When last staffed by the Handicapped Division, there were numerous problems including termite infestation, serious roof leaks and continuous vandalism. SSSP has requested permission to amend its Revocable Permit to include the abandoned structure which will then be remodeled with available federal funds, at no cost to the City. Furthermore, SSSP will make the recreation building available for other community functions and meetings and will maintain the building at its own cost. Since use of an existing vacant structure for a recreational building does not constitute a change in the character of the park, a Special Permit will not be required. However, all necessary building permits will be applied for by Southwest Social Services Program, Inc. It is recommended that the City Manager be authorized to enter into an Amendment to the Revocable Permit dated March 21 1987 between the City and Southwest Social Services Program, Inc., _ clarifying the description of the premises and allowing the inclusion of additional space contingent upon Permittee's receipt of sufficient renovation financing.
