A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S ACTION IN EXTENDING THE CONTRACT WITH FLORIDA EQUIPMENT AND PARTS IN THE AMOUNT OF $438,640.00, FOR AN ADDITIONAL PERIOD OF THREE MONTHS FOR THE LEASING OF FOUR BULLDOZERS, INCLUDING OPERATORS, MAINTENANCE, INSURANCE AND FUEL, FOR HURRICANE DEBRIS REMOVAL; ALLOCATING FUNDS THEREFOR FROM F.E.M.A. DSR #89807. WHEREAS, on September 10, 1992, the City Commission adopted Resolution No. 92-551, waiving formal oompetitive bids for the acquisition of servioes, equipment, goods and/or materials as required in the aftermath of Hurricane Andrew; and WHEREAS, said Resolution allowed the City Manager to proceed to make necessary purohases without express City Commission approval, for contracts or awards that do not exoeed $160,000.00; and WHEREAS, it was determined that heavy equipment was needed to assist with the hurricane debris removal process; and WHEREAS, the Department of General Services Administration and Solid Waste issued Informal Bid No. HAO05 to provide said services; and WHEREAS, Florida Equipment and Parts was awarded the bid for the leasing of four bulldozers including operators, maintenance, Insurance and fuel to assist with the hurrioane debris removal process for a period of one month in the amount of $136,180.00; cm COM SMON MEETING OF FEB 0 9 t"3 Rawlutlon Na 93- 92 .40 WHEREAS, it was necessary to extend the oontraot for three additional months in order to continue with the hurricane debris = process for an additional amount of $438,640.00; and WHEREAS, funds for said service are available from F.E.M.A. DSR #89807; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adapted by reference _- thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's action in extending the contract with Florida Equipment and Parts in the amount of $438,540.00, for an additional period of three months for the leasing of four bulldozers, including operators, maintenance, insurance and fuel, for hurricane debris removal is hereby ratified, approved and confirmed, with funds therefor hereby allocated from F.E.M.A. DSR 489807. City Mana ENCLOSURES :Proposed Resolution It is respectfully recommended that the City Commission pass the attached Resolution ratifying the extension of the Contract with Florida Equipment and Parts, a Hispanic/Dade County vendor located at 10890 NW So. River Drive, Miami, Florida 33178 for the leasing of four (4) Bulldozers with operators, maintenance, insurance and fuel in order to continue the hurricane debris removal process at a proposed amount of $438,540.00. The Department of General Services Administration and Solid Waste let out Informal Bid No. HAO05 for the above service in accordance with Resolution No. 92-551. As a result of the bid evaluation, award was made to Florida Equipment and Parts in the amount of $136,180.00 for a period of one (1) month. It is necessary to extend this contract in the amount of $438,540.00 for an additional period of three (3) months in order to continue the hurricane debris removal process. Funds for said service are available under F.E.M.A. DSR No. 89807. Cesar H. Cad REFERENCES: City Manage ENCLOSURES On August 24, 1992, the City of Miami suffered the wrath of a devastating hurricane, Hurricane Andrew. In order to eliminate immediate threats to the life, health and safety of residents and employees, and eliminate immediate threats to undamaged property, as well as ensure economic recovery to the City and the community, I have made a written finding of a valid public emergency. Based on this finding, formal competitive sealed bid and selection procedures will be waived for the procurement of services, equipment, goods and/or materials that may be required to provide immediate burden relief and disaster assistance for the City and the community for the purpose of providing for the health, safety and welfare of its citizens and employees. In addition, the City's insurance will not cover any loss of business resulting from delays in the normal procurement procedures; therefore, it is necessary to waive formal competitive bid and selection procedures and utilize the informal bid process instead. 93- 92
