9 3 -- 91
A RESOLUTION RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S ACTION IN
MXTENDING THE CONTRACT WITH KOSTMAYER
CONSTRUCTION COMPANY, IN THE AMOUNT OF
$942,500.00, FAR AN ADDITIONAL 79 DAY PERIOD
FOR CONTROLLED AIR BURNING OF HMICANE
DEBRIS; ALLOCATING FUNDS THEREFOR FROM
F.E.M.A. DSR #93090.
WHEREAS, on September 10, 1992, the City Commission adopted
Resolution No. 92-881, waiving formal competitive bids for the
acquisition of services, equipment, goods and/or materials as
required in the aftermath of Hurricane Andrew; and
WHEREAS, the Department of General Services Administration
and Solid Waste has been using Kostmayer Construction Company for
the purpose of burning hurricane debris stored at Virginia Key:
and
WHEREAS, the original contract, in the amount of
$377,000.00, was ratified by the City Commission on November 12,
1992, pursuant to Resolution No. 92-734 covering the period of
September to November, and on December 10, 1992, pursuant to
Resolution No. 92-798, an extension was ratified covering the
period of November to December; and
WHEREAS, due to the amount of debris still left at Virginia
Key, it is necessary to extend said contract for an addition 79
day period ending February 28, 1993 at a proposed amount of
$942,500.00; and

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITE'
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the

: Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this

Section 2. The City manager's action in extending the
i

contract with Kostmayer Construction Company, in the amount of
$942,800.00, for an additional 79 day period for controlled air
burning of hurricane debris is hereby ratified, approved and
confirmed, with funds therefor hereby allocated from F.E.M.A.
DSR 493090.
Section 3. This Resolution shall become effective
{ immediately upon its adoption.

It is respectfully recommended that the City Commission pass the
attached Resolution ratifying the extension of the contract with
Kostmayer Construction Company, a non-minority/local vendor
located at 5554 NW Miami Court, Miami, Florida 33127 for
controlled air burning of hurricane debris for an additional
seventy-nine (79) day period covering December to February 28,
1993 at a proposed amount of $942,500.00.
The Department of General Services Administration and Solid Waste
Is using Kostmayer Construction Company for the operation of
three (3) air -controlled burn units at Virginia Key. The
original contract was ratified by the City Commission on November
12, 1992 by Resolution No. 92-734 in the amount of $377,000.00
for the period covering September to November, an extension was
ratified on December 20, 1992 by Resolution No. 92-798 in the
amount of $282,750.00 for the period. covering November to
December.
Due to the amount of debris still ].eft at Virginia Key, it is
necessary to extend this contract for an additional seventy-nine
(79) day period in the amount of $942,500.00. Funds for said
service are available under F.E.M.A. DSR No. 93090.

ENCLOSURES:
On August 24, 1992, the City of Miami suffered the wrath of a devastating
hurricane, Hurricane Andrew. In order to eliminate immediate threats to the
life, health and safety of residents and employees, and eliminate immediate
threats to undamaged property, as well as ensure economic recovery to the City
and the community, I have made a written finding of a valid public emergency.
Based on this finding, formal competitive seaied bid and selection procedures
will be waived for the procurement of services, equipment, goods and/or
materials that may be required to provide immediate burden relief and disaster
assistance for the City and the con unity for the purpose of providing for the
health, safety and welfare of its citizens and employees.
In addition, the City's insurance will not cover any loss of business
resulting from delays in the normal procurement procedures; therefore, it is
necessary to waive formal competitive bid and selection procedures and utilize
the informal bid process instead.
