3--93-46 (b) 1/12/93 RESOLUTION NO. 9 3 - 69 A RESOLUTION AFFIRMING THE DECISION OF THE ZONING BOARD AND DENYING THE VARIANCE FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 41 SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, C-1 RESTRICTED COMMERCIAL, CONDITIONAL PRINCIPAL USES, TO WAIVE THIRTY-SEVEN (37) OF ONE HUNDRED AND NINETY EIGHT (198) TOTAL PARKING SPACES REQUIRED FOR THE EXISTING SHOPPING CENTER AT THE LOCATION HEREINBELOW, AS A RESULT OF THE PROPOSED BAR AND POOL ROOM TO BE ALLOWED BY SPECIAL EXCEPTION FOR THE PROPERTY LOCATED AT 801 NORTHWEST 37TH AVENUE, MIAMI, FLORIDA, ALSO DESCRIBED AS NORTH 309.75' OF LOT 6 LESS NORTH 15' AND WEST 20' AND LOT 7 LESS NORTH 15', SOUTH 20' AND EAST 15.3' OF SOUTH 145', TROPICAL TRADES CO. STA A, AS RECORDED IN PLAT BOOK 4 AT PAGE 6 OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA; ZONED C-1 RESTRICTED COMMERCIAL. WHEREAS, the Miami Zoning Board at its meeting of December 7, 1992, Item No. 2, duly adopted Resolution No. ZB-124-92 by a eight to zero (8-0) vote, denying the variance as hereinafter set forth; and WHEREAS, the applicant has taken an appeal to the City Commission'from the denial of the variance; and WHEREAS, the City Commission after careful consideration of this matter finds that no peculiar circumstances exist which impair the owner's right to the some reasonable use of the property, and finds no other basis upon which to grant a variance; CITY COP9MSSION KEETING OF JAN 2 8 1993 desolation No. 93- 69 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Miami Zoning Board in this matter is affirmed and the request for a variance from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, C-1 Restricted Commercial, Conditional Principal Uses, to waive thirty-seven (37) of one hundred and ninety eight (198) total parking spaces required for the existing shopping center at the location hereinbelow, as a result of the proposed bar and pool room to be allowed by special exception for the property located at 801 Northwest 37th Avenue, Miami, Florida, also described as north 309.75, of Lot 6 less north 15' and west 20' and Lot 7 less north 151, south 20' and east 15.3' of south 1451 , TROPICAL TRADES CO.
