HomeMy WebLinkAboutR-93-0061J--93-121 1/28/93 RESOLUTION NO. 9 61 A RESOLUTION APPROVING THE ALLOCATION OF FUNDS FOR THE PURPOSE OF RELOCATING HOMELESS PERSONS NOW RESIDING IN AND AROUND BICENTENNIAL PARR DURING THE PERIOD FROM FEBRUARY 6, 1993 THROUGH FEBRUARY 21, 1993, SAID ALLOCATION CONDITIONED UPON AN EQUAL MATCH (50%-80%) TO BE PROVIDED BY THE PROMOTER OF THE MIAMI GRAND PRIX, MIAMI MOTOR SPORTS, INC., WITH THE CITY'S CONTRIBUTION NOT TO EXCEED $25,000; FURTHER INSTRUCTING THE ADMINISTRATION, BY AND THROUGH THE CITY'S HOMELESS COORDINATOR, TO MAKE ALL NECESSARY ARRANGEMENTS TO FACILITATE THOSE HOMELESS PERSONS BEING SHELTERED AT EXISTING FACILITIES AND TO PROVIDE FOR THE CARE AND CUSTODY OF SAID HOMELESS PERSONS PROPERTY AS REQUIRED UNDER THE COURT ORDER, ENTERED NOVEMBER 16, 1992 IN MICHAEL PO'TTINGER. ET AL.. PLAINTIFF VS. CITY OF MIAMI. DEFENDANT, CASE NO. 88-2406-CIV-ATKINS, BROUGHT IN THE UNITED STATES DISTRICT COURT, SOUTHERN DISTRICT OF FLORIDA, MIAMI DIVISION. WHEREAS, the Miami City Commission acknowledges that an emergency condition, in regard to homelessness, exists within the City of Miami; and WHEREAS, an Order entered November 16, 1992 in xi=ha l PottiWer. et ai, _ Plaintiff vs . City of Miami. Defendant, Case No. 88-2406-Civ-ATKINS, brought in the United States District Court, Southern District of Florida, Miami Division, which Order Is entitled "Findings of Fact and Conclusions of Law and Order on Plaintiffs' Request for Deolaratory and Injunctive Relief", states in applicable part that Bioentennial Park is to be CITT COMSSTON NZETING OF JAN 2 8 V93 t"utke t" 93-- 61 oonsidered a "safe zone" for the homeless pending the establishment of one or more other "safe zone" lo0ations by the City of Miami; and WHEREAS, the City of Miami is oontraotually obligated to Miami Motor Sports, Ino., the promoter of the Miami Grand Prix, to deliver Bioentennial Park for the purposes of oonduoting the raoe, whioh is to be held on Saturday, February 20, 1993 and Sunday, February 21, 1993; and WHEREAS, it is neoessary that the park aotually be olosed and fenoed off from publio usage due to preparations needed prior to the raoe and the storage of valuable equipment on the premises for the period beginning Friday, February 8, 1993 at 6v00 P.M. and oontinuing through Sunday night, February 21, 1993; and . WHEREAS, notwithstanding the faot that the Order entered in the above -mentioned oase, dated November 16, 1992, entitled, "Findings of Faot and Conolusions of Law and Order on Plaintiffs' Request for Deolaratory and Injunotive Relief" is presently on ' appeal and the City of Miami has moved for a stay of the Y provisions of that Order while on appeal, whioh matter has not been ruled upon by the Court to date; and —J WHEREAS, there are approximately 80 to 100 homeless persons residing in and around Bioentennial Park at the present time who �__9 must be removed therefrom, in order to faoilitate the 4; preparations of said race; and WHEREAS, :funds are required for the purpose of relooating said homeless: persons; and 93- 61 -2- 11 I] WHEREAS, the Miami City Commission is willing to allocate said funds conditioned upon an equal match (50%-50%) to be provided by the promoter of the Miami Grand Prix, Miami Motor Sports, Ina., with the City's contribution not to exceed $25,000; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Miami City Commission hereby approves the allocation of funds for the purpose of relocating homeless persons residing in and around Bicentennial Park for the period from February 5, 1993 through February 21, 1993. The herein allocation is condition upon an equal match (50%-50%) to be provided by the promoter of the Miami Grand Prix, Miami Motor Sports, Inc., with the City's contribution not to exceed $25,000. Section 3. The administration, by and through the City's homeless coordinator, is hereby instructed to make all necessary arrangements to facilitate those homeless persons being sheltered at existing facilities and to also provide for the care and custody of said homeless persons' property as is required under the Court's Order, entered November 18, 1992 in HIsgu.Rl -3- 9 3 - 61 Pi�, apt s .s Plaints . vr�a.
