Home My WebLink AboutR-93-0052J-93-45 1/12/93 RESOLUTION NO. 93 — 52 A RESOLUTION OF THE MIAMI CITY COMMISSION ' URGING TER FLORIDA STATE LEGISLATURE TO SUPPORT THE ADOPTION OF "A MUNICIPAL CLERKS' CAPITAL EQUIPMENT MODERNIZATION TRUST FUND" (PROPOSED AS SECTION 119.0310, FLORIDA STATUTES), SPONSORED BY SENATOR FRED DUDLEY s AND REPRESENTATIVE JOHN COSGROVE; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS =' RESOLUTION TO THE OFFICIALS DESIGNATED HEREIN. =x WHEREAS, the City Clerk is the primary designated custodian of municipal records and, in said capacity, is responsible for providing the direction in terms of records management to all reoord-keeping units within the municipal government; and i 9 WHEREAS, as local government has grown in responsibility and importance, so has the role of the municipal clerk, who is charged with providing a direct link between past, present and future through the preservation of municipal records and is responsible for seeking better and more efficient ways to perform ��- his/her responsibilities in today's challenging technological world; and WHEREAS, Chapter 119, Florida Statutes, Public Records, w defines "public records" in terms of physical characteristics and legal and/or official documentation relationships, and also defines "agency" by an inclusive listing of state, local and special governmental officials in organizational units, subject to the laws and regulations pertaining to public) records; and CITY COM MSSION MEETING Or, JAN 14 S93 R.,oluU N 9To 52 �. WHEREAS, Chapter 287, Florida Statutes, Florida Archives and Historical Act, allows the municipalities to establish and coordinate standard procedures and techniques for efficient and economical reoord-keeping of systems which indirectly and ultimately will impact in a positive manner on the ecological and environmental programs; and WHEREAS, in 1987, Chapter 28.24(18)(d), Florida Statutes, mandated that an additional service charge be paid to the Clerk of the Circuit Court to be deposited in. a Public Records Modernization Trust Fund for each instrument recorded in the Official records of the County, said fund being held in trust by the County Clerk and used exclusively for equipment, personnel training, and technical assistance in modernizing the official reoord-keeping system; and WHEREAS, no municipality has, to this date, received a proportionate share of said additional County service charge, despite payment of the said charge for recording of documents and instruments having been made by a great number of residents of the different municipalities located in said counties; and WHEREAS, municipal clerks are required to: (a) handle an inordinate amount of public requests, as well as (b) address the continuing challenge of identifying funding for the necessary modernization of equipment, personnel training and technical assistance so necessary in furtherance of the clerk's many functions; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA.- 93- a2 -2- 1 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Miami City Commission hereby urges the Florida State Legislature to support the adoption of "A Municipal Clerk's Capital Equipment Modernization Trust Fund" (proposed as Section 119.0310, Florida Statutes), sponsored by Senator Fred Dudley and Representative John Cosgrove. Section 3. The City Clerk is hereby directed to transmit a copy of this Resolution to Governor Lawton Chiles, Lieutenant Governor Buddy McKay, Senate President Ander Crenshaw, Speaker of the House Bolley Johnson, and all the members of the Dade Delegation. Section 4. This Resolution shall become effective immediately upon its adoption.
