RESOLUTION No. 93 51 -
A RESOLUTION RATIFYING AND APPROVING THE _
ACTION TAKEN BY THE CITY MANAGER IN EXTENDING
THE REQUEST FOR PROPOSALS SUBMISSION DEADLINE
FOR THE UNIFIED DEVELOPMENT OF A CITY -OWNED —
WATERFRONT PROPERTY LOCATED AT 2840 SOUTH
BAYSHORE DRIVE, MIAMI, FLORIDA, FROM
JANUARY 13, 1993 TO FEBRUARY 16, 1993 AT
2:00 P.M.
WHEREAS, City of Miami. Charter Section 29-A(o) allows for
"Unified Development Projeots" where an interest in real property
is owned or is to be acquired by the City and is to be used for
development of improvements; and
WHEREAS, the City Commission, pursuant to Resolution
No. 92-488, authorized the City Manager to issue a Unified
Development Projeot ("UDP") Request for Proposals ("RFP")
document for the property located at 2640 South Bayshore Drive,
Miami, Florida; and
WHEREAS, said RFP was issued on August 7. 1992, as
prescribed by Resolution No. 92-488; and
WHEREAS, said RFP Submission Deadline was set for
November 13, 1992; and
WHEREAS, on Ootober 8, 1992, pursuant to Notion 92-658, the
City Commission directed the City Manager to extend the RFP

Submission Deadline from November 13, 1992 to January 13, 1993;
and
WHEREAS, on October 22, 1992, pursuant to Resolution
No. 92-690, the City Commission amended the RFP to include
minority ownership as a requirement for prospective development
teams; and
WHEREAS, a prospective proposer has requested that the City
clarify whether the new minority ownership requirement applies to
the proposing entity or a component of the development team only;
and
WHEREAS, the olarifioation by the Administration to all
prospective proposers that the proposing entity must include
minority ownership could result in a delay for prospective
proposers; and
WHEREAS, there was no scheduled meeting of the City
Commission before the RFP Submission Deadline;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA
Section 1. The reoitals and findings oontained in the
Preamble to this Resolution are hereby adopted by referenoe
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby ratifies and
approves the action of the City Manager in extending the RFP
Submission Deadline for the Unified Development of the City -owned
waterfront property located at 2640 South Bayshore Drive, Miami,
Florida, from January 13, 1993 to February 16, 1993 at 2:00 P.M.

It is respectfully recommended that the City Commission adopt the
attached Resolution, ratifying and approving the action taken by
the City Manager in extending the Proposals Submission Deadline
for the Unified Development of the City -owned waterfront property
located .at 2640 South Bayshore Drive, from January 13, 1993 to
April 13, 1993, 2:00 PM.

The Department of Development and Housing Conservation recommends
that the City Commission adopt the attached Resolution to ratify
the action taken by the City Manager.
On October 22, 1992, by Resolution 92-690, the City Commission
amended the Request for Proposals document for the Unified Devel-
opment of the Dinner Key Boatyard & Marina to include minority
ownership as a requirement of development teams. Subsequently, a
prospective proposer has requested that the City clarify whether
the new minority ownership requirement applies to the proposing
entity or a component of the development team only.
The intent of the City Commission, based on Resolution 92-690, is
unclear and minutes of the Commission meeting appear inconclusive
to make nay determination. In order to avoid any confusion, the
Administration decided to extend the Proposal Submission Deadline
from January 13, 1993 to April 13, 1993 and seek approval of the
Commission at its next meeting on January 14, 1993.
