HomeMy WebLinkAboutR-93-0045J-93-18 12/3/92 RESOLUTION NO. 9 45 A RESOLUTION BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY .ADVERTISED PUBLIC HEARING, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE PURCHASE OF A CRASH KIT: FOR THE UNINTERRUPTED POWER SUPPLY (UPS) SYSTEM OF THE FIRE DEPARTMENT'S COMMUNICATIONS CENTER FROM ELGAR CORPORATIONITHE SOLE SOURCE VENDOR FOR THIS EQUIPMENT AT A PROPOSED COST OF $14,000; ALLOCATING FUNDS THEREFOR FOR THIS PURCHASE FROM THE ENHANCED 9-1-1 PROJECT 506001, INDEX CODE NO. 420604-840; AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THIS EQUIPMENT. WHEREAS, in order to comply with National Fire Protection Standard 1221 which states that complete, ready -to -use spare units and spare parts shall be available in reserve for continuous operation of Communications Centers (Sections 2- 1.6.4.2 and 2-1.13.2.5); and — WHEREAS, the Department of Fire's Communications Center is in need of a "crash kit" for its Uninterrupted Power Supply (UPS) consisting of spare boards, diodes, rectifiers, fuses and capacitors; and WHEREAS, the UPS System actually failed last year due to a shorted capacitor on one of the six boards and was inoperable for four days until a new board could be flown in from the manufacturer in California; and 9 'M WHEREAS, the "Crash Kit" is manufactured and distributed solely by Elgar Corporation; and WHEREAS, the Chief Procurement Officer has adopted the finding that Elgar Corporation is the sole source to provide this equipment; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the finding of the City Manager; and WHEREAS, the Department of Fire, Rescue and Inspection Services needs to purchase the "Crash Kit" for prompt repair of their Uninterrupted Power Supply (UPS) System should it become inoperable, in compliance with National. Fire Protection Standard 1221 (Sections 2-1.6.4.2 and 2-1.13.2.5); and WHEREAS, funds for this purchase are available from the Enhanced 9-1-1 Project 506001, Index Code No. 420604-840; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirement for competitive formal sealed bids be waived and that the purchase of the "Crash Kit"% for the Fire Department's UPS System from Elgar corporation, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. �.M 93- 45 a Section 2. By affirmative vote of 4/5ths of the Members of the City Commission, after a duly advertised public hearing, the requirement for competitive sealed bids for the purchase of a "Crash Kit" from E1gar Corporation, the sole source supplier for this item at a proposed total cost not to exceed $14,000.00, is hereby waived and the said purchase is hereby approved. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this equipment. Section 4. The "Crash Kit" consists of spare boards, diodes, rectifiers, fuses and capacitors. The Elgar UPS System in the Department of Fire Comminication Center failed last year due to a shorted capacitor on one of the six boards and was inoperable for four days until a new board could be flown in from the manufacturer in California. National Fire Protection Standard 1221 (S2-1.6.4.2 & S 2- 1.13.2.5) now states that complete, ready -to -use spare units and spare parts shall be available in reserve for continuous operation of Communication Centers. The "Crash Kit" is considered to be mobile equipment and can be utilized at any location where the UPS is located. After researching several manufacturers and distributors of UPS Systems, it was determined that the "Crash Kit" is proprietary to the Elgar Corporation, a non -minority vendor in San Diego, California. Elgar is also the sole authorized sales agent for this packaged set of equipment that consists of ready -to -use spare parts and tools needed to decrease downtime in the event of system failure. The total cost associated with this purchase is $14,000.00. Funds for this acquisition are available in the Enhanced 9-1-1 Project 506001 and the purchase has been approved by the Enhanced 9-1-1 Committee. Funding for this purchase must accomplished in the current fiscal year or subject to a loss of funds. Accordingly I, the Chief Procurement Officer, am recommending that the requirements for competitive bidding be waived and that the above findings be approved, that Elgar Corporation is the sale authorized sales agent of the "Crash Kit" needed to maintain continuous operation of the Elgar UPS 503-38-13 model currently being used in the Fire Department Communication nter.
