HomeMy WebLinkAboutR-93-0032J-92-30 $/12/92 0 RESOLUTION NO. 93- 32 11 A RESOLUTION APPOINTING AN INDIVIDUAL AS ONE OF THE CITY OF MIAMI'S REPRESENTATIVES TO THE METRO DADS COUNTY BI:CAYNE BAY SHORELINE DEVELOPMENT REVIEW COMMITTAE; AND DIRECTING THE CITY MANAGER TO INSTRUCT THE DIRECTOR OF THE BUILDING, PLANNING AND ZONING DEPARTMENT TO TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN NAMED AGENCIES. WHEREAS, Sections 33D-31 through 34 of the Code of Metropolitan Dade County established the Biscayne Bay Shoreline Development Review Committee ("Committee"); and WHEREAS, the Committee is comprised of five recognized professional architects, landscape architects or urban designers and two lay citizens appointed by the Board of County Commissioners for the purpose of reviewing and making recommendations on projects and plans proposed on the shoreline of Biscayne Bay and adjacent uplands, and extending generally inland to the first paralleling arterial roadway; and WHEREAS, Section 33D-33 of the Dade County Code allows the City of Miami to appoint two additional representatives, who are recognized professionally in the fields of architecture, landscape architecture and/or urban design, to be added to the Committee as full voting members when projects are proposed for real property lying within the boundaries of the City of Miami; and CITY COP39SSION MEETING OF JAN 1 4 1993 Resolution No. 93- 32 WHEREAS, by Resolution No. 92-113, February 13, 1992, the City Commission, appointed Daniel Perez-Zarraga, AIA, for a term of six years and reappointed dose Feito, FAIR, for a term of three years as additional City representatives to the Metro Dade County Biscayne Bay Shoreline Development Review Committee, and _ WHEREAS, Mr. Perez-Zarraga, by letter of April 24, 1992, deolined said appointment because of a conflict of interest _ 000asioned by his preexisting membership on a Dade County board; and WHEREAS, due to Mr. Perez-Zarraga's declination, the City Commission must appoint another individual for the subjeot position; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and inoorporated herein as if fully set forth in this Section. Seotion 2. Qladys Margarita Diaz a professional architect , is hereby appointed, for a term of six years, expiring February 13, 1998, as an additional City of Miami representative on the Metro Dade County Biscayne Bay Shoreline Development Review Committee, to serve in those instances in which plans and projeots involve real property lying within the boundaries of the City of Miami. Section 3. The City Manager is hereby directed to instruct the Director of the Building, Planning and Zoning - 2 - ME 93- 32 - n ARL Department to transmit copies of this Resolution to the County Manager, County Clerk, and the Chairman, Metro Dade County Biscayne Bay Shoreline Development Review Committee. Also enclosed is a copy of a memorandum from A. Quinn Jones III, City Attorney, dated October 22, 1991, outlining some guidelines to assist members of City Boards and Committees in complying with the Government in the Sunshine Law. Also enclosed, for informational purposes, 1s another memorandum from the City Attorney, dated October 22, 1991 on legal requirements concerning Conflict of Interest and Dual Office Holding circumstances which may prohibit your membership in said bodies. Resolution: Appointment of City Representative; Metro Dade County Shoreline Development Review Committee Agenda Item: City Commission Meeting of May 28, 1992 It is recommended that the Commission appoint a recognized professional architect, landscape architect or urban designer as an additional City of Miami representative to replace a previous appointment to the Metro Dade County Biscayne Bay Shoreline Development Review Committee, per the attached resolution. BACKGROUND By Resolution 92-113, February 13, 1992, the Commission appointed Daniel Perez-Zarraga, AIA, to a six year term and reappointed Jose Feito, FAIA, to a three year term as additional members on the Metro Dade County Biscayne Bay Shoreline Development Review Committee. By letter of April 24, 1992, (attached) Mr. Perez-Zarraga declined the appointment because of a conflict of interest; he cannot serve on two County boards simultaneously. Therefore, it is appropriate to vacate the previous appointment of Mr. Perez-Zarraga and appoint another professional. In 1985, per Section 33D-31 through 34 of the Metro Dade County Code, the Board of County Commissioners (BCC) established and appointed the Biscayne Bay Shoreline Development Review Committee, comprised of five professionals and two lay citizens. The purpose of the Committee is to review and make recommendations to municipalities on projects and plans proposed on the shoreline of Biscayne Bay and upland property extending generally to the first paralleling arterial roadway. The Committee can also, through an appeal procedure to the BCC, seek compliance with their recommendations. In addition to the standing Committee, shoreline municipalities may appoint two additional professional representatives, who are added to the composition of the committee, when projects are proposed which lie within the boundaries of the municipality. Previous City appointments made in 1985 were made collegially by the Commission and no terms of office were established (Resolution 85-789, July 18, 1985).
