RESOLUTION NO. 9 3-
A RESOLUTION ALLOCATING FUNDS IN THE AMOUNT
OF $100,000 FROM THE LAW ENFORCEMENT TRUST
FUND, PROJECT NO. 890001, INDEX
CODE 029002-247, SUCH FUNDS HAVING BEEN
APPROVED BY THE CHIEF OF POLICE, FOR THE
PURPOSE OF RELOCATING AND ASSISTING HOMELESS
PERSONS RESIDING IN THE AREA UNDER I--395,
ALSO KNOWN AS THE "MUD FLATS"; SAID
ALLOCATION CONTINGENT UPON FUNDS IN THE
AMOUNT OF $100,000 EACH FROM THE STATE OF
FLORIDA AND METROPOLITAN DADE COUNTY BEING
PLACED IN AN ACCOUNT PRIOR TO THE THE CITY OF
MIAMI'S ALLOCATION FOR SAID PURPOSE.
WHEREAS, the City Commission acknowledges that emergency
measures need to be taken to address the homeless problem in the
City of Miami, especially with regard to those homeless
individuals who presently reside in and around the area located
under I-395, also known as the "Mud Flats"; and
WHEREAS, the City Commission previously authorized the
allocation of funds to assist the homeless through a variety of
programs, including the Community homeless Assistance Plan which
was implemented by City Ordinance No. 10914 and supplemented by
Ordinance No. 10944; and
WHEREAS, the State of Florida and Metropolitan Dade County
have expressed an interest in earmarking certain funds to provide

assistanoe in the form of subsistence, housing and counseling to
those individuals residing in the "Mud Flats" area; and

WHEREAS, the "Mud Plate" area is especially a health related
oonoern due to the presenoe of rodent and inseot infestations,
the nature of the looale, and the absenoe of running water,
bathroom faoilities, and garbage oolleotion faoilities in the
area; and
WHEREAS, Chapter 932.704(3)(a), Florida Statutes, as
amended, authorizes the expenditure of forfeiture prooeeds for
psi
Law Enforoement and Anti -Drug Eduoation Programs, not considered
normal operating expenses; and

WHEREAS, the area under the "Mud Flats" has been

speoifioally identified as an area where persons addioted to
drugs reside in squalor as described hereinabove; and
WHEREAS, the Chief of Polioe has reoommended adoption of

this Resolution and has determined that the expenditure proposed
complies with Chapter 932.704, Florida Statutes, as amended; and

WHEREAS, funds to cover the oontribution are available in
the City of Miami Law Enforcement Trust Fund, Project No. 890001,
Index Code 029002-247;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
a Section 1. The recitals and findings oontained in the
Preamble to this Resolution are hereby adopted by reference
= thereto and inoorporated herein as if fully set forth in this =
Section.
Section 2. Funds in the amount of $100,000 are hereby

allocated from the Law Enforcement Trust Fund, Project
No. 690001, Index Code 029002-247, such funds having been

approved by the Chief of Police, for the purpose of relocating
and assisting homeless persons residing in the area under I-393,
also known as the "Mud Flats".
Section 3. The allocation of said funds is contingent
upon funds in the amount of $100,000 each from the State of
Florida and Metropolitan Dade County being placed in an account
prior to the City of Miami's allocation.
Section 4. This Resolution shall become effective
immediately upon its adoption.

Miami, I am scheduling for discussion an itemconcerning remedies being explored regarding the recent decision in Pottinger vs. the
City of Miami and other matters pertaining to the homeless.
