RESOLUTION NO. 9" - 1
A RESOLUTION ESTABLISHING A SIX-MONTH PERIOD
OF TIME, COMMENCING WITH THE ADOPTION OF THIS
RESOLUTION, IN WHICH SWORN POLICE PERSONNEL
MAY PURCHASE A SECOND ISSUED WEAPON, PROVIDED
THAT MORE THAN ONE WEAPON HAD BEEN ISSUED TO
SAID PERSONNEL AND THAT SUCH WEAPON IS
AVAILABLE, AT A PRICE WHICH IS EQUAL TO OR
GREATER THAN THE AMOUNT THAT WOULD BE
REASONABLY ANTICIPATED FROM THE SALE OF SUCH
WEAPON THROUGH PUBLIC AUCTION; FURTHER
RATIFYING, APPROVING, AND CONFIRMING ANY
ACTIONS TAKEN BY THE CITY MANAGER AUTHORIZING
THE PURCHASE OF SUCH WEAPONS BY SWORN POLICE
PERSONNEL FOR THE PERIOD OF TIME FROM THE
EXPIRATION OF RESOLUTION NO. 91-502 TO THE
ADOPTION OF THIS RESOLUTION.
WMEREAS, Resolution No. 91-502 amended Resolution No. 89-798
and allowed sworn police personnel to purchase, for a period of
one year, any second issued weapon issued to said personnel; and
WHEREAS, Resolution No. 91-502 expired on July 10, 1992;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. A six-month period of time is hereby
established, commencing with the adoption of this Resolution, in
which sworn police personnel may purchase a second issued weapon

at a price which is equal to or greater than the amount that
would be reasonably anticipated from the sale of such weapon
through public auction provided that more than one weapon has
been issued to said personnel.
Section 3. Any actions taken by the City Manager
authorizing the purchase of such weapons by sworn personnel for
the period of time from the expiration of Resolution No. 91-542
to the adoption of this Resolution are hereby ratified,
confirmed, and approved.
Section 4. This Resolution shall become. effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution, as amended, extending the time period in
which sworn personnel may purchase their second issued weapon for
a period not to exceed six months from the adoption of the
resolution.

Resolution No. 91-502, amended Resolution No. 89-798, and allowed
sworn personnel to purchase any second weapon issued to them for
a one year period from the adoption of the resolution.
Resolution No. 91-502 expired on July 10, 1992. The police
department would like to extend the time period for purchasing
the second issued weapon for six months from the adoption of this
resolution.
