ORDINANCE NO. 11104
AN ORDINANCE AMENDING CHAPTER 35 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "MOTOR VEHICLES AND TRAFFIC", BY
ADDING A NEW ARTICLE IX ENTITLED "SILVER
BLUFF COMMERCIAL PARKING IMPROVEMENT TRUST
FUND"; DESCRIBING THE PURPOSES FOR WHICH SUCH
FUND IS ESTABLISHED, THE REQUIREMENTS FOR
FEES TO BE PAID IN LIEU OF REQUIRED PARKING,
THE MANNER IN WHICH FUNDS ARE DEPOSITED TO
THE FUND, AND THE RESTRICTIONS ON HOW FUNDS
MAY BE SPENT; MORE PARTICULARLY BY ADDING NEW
SECTIONS 35-196 AND 35-197; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Silver Bluff commercial neighborhood of the
City of Miami has enjoyed a resurgence of non -industrial business
activity in the area; and
WHEREAS, the available supply of onsite parking spaces in
close proximity to the center of activities is not sufficient to
meet requirements and an onsite parking deficiency is now
commonplace; and
WHEREAS, the City Commission desires to make possible the
creation of new offstreet parking spaces, as well as provide for
greater utilization of existing nearby spaces; and
WHEREAS, the City Commission finds that the establishment of
a trust fund to receive and expend funds to create and improve
offstreet parking facilities serving the Silver Bluff Commercial
Overlay District is in the best interest of the citizens of the
City of Miami; and

WHEREAS, the Miami Planning Advisory Board, at its meeting
of July 14, 1993, Item No. 3, following an advertised hearing
adopted Resolution No. PAB 26-93 by a vote of nine to zero (9-0),
RECOMMENDING APPROVAL of amending the City Code as hereinafter
set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
the Code of the City of Miami, Florida, as amended, as
hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 2. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 1. New Article IX, entitled "Motor Vehicles and
Traffic", is hereby added to the City Code of the City of Miami,
Florida, as amended, as follows:
"CHAPTER 35
Motor Vehicles and Traffic

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

REQUEST/LOCATION An amendment to Chapter 35 of the City Code to establish the "Silver Bluff
Commercial Parking Improvement Trust Fund".
LEGAL DE'_,DIPTION
PETITION Consideration of amending Chapter 35 of the City Code of the City of Miami,
Florida, entitled "Motor Vehicles and Traffic" by adding a new Article Ix
entitled "Silver Bluff Commercial Parking Improvement Trust Fund", describing
the purposes for which such fund is established, the requirements for fees to
be paid in lieu of required parking, the manner in which funds are deposited
to the fund, and the restrictions on how the funds may be spent.
PLANNING
RECOMMENDATION Approval.
BACKGROUND This Ordinance amends the City Code to create the necessary trust fund to implement
that recommendation. This is a companion item to a required Zoning Ordinance text
and atlas amendment.
ANALYSIS The industrially zoned area between S.W. 28 Lane and the Metrorail right-of-way,
from S.W. 24 Avenue to S.W. 27 Avenue, is in transition from a small warehouse and
light industrial area to a specialized retail district. Most of the establishments
cannot meet the offstreet parking requirements for retail use. In October, 1991,
the Zoning Board considered a recommendation that the Department of Offstreet
Parking (DOSP), subject to Dade County approval, develop an offstreet parking lot
under the Metrorail guideway to provide necessary parking to serve the area.
Businesses that are unable to satisfy parking requirements, would, under this
proposal, be granted a waiver upon payment of a fee to be placed in a parking
improvement trust fund, the proceeds of which would be used to reimburse DOSP for
the new parking lot.
PLANNING ADVISORY BOARD At its meeting of July 14, 1993, the PAS adopted Resolution PAB 26-93,
by a vote of 9 to 0, recommending approval of the above item.

the City Clerk, 3500 Pan American Drive, Miami, Florida, Monday
through Friday, excluding holidays, between the hours of 8:00 a.m.
