ORDINANCE NO. 11103
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY ADDING A NEW SPECIAL OVERLAY
DISTRICT, ENTITLED "SD-21 SILVER BLUFF
COMMERCIAL OVERLAY DISTRICT", FOR THE
PROPERTIES GENERALLY BOUNDED BY BOTH SIDES OF
SOUTHWEST 28TH LANE, SOUTHWEST 27TH STREET,
SOUTHWEST 24TH AVENUE, THE METRORAIL RIGHT-
OF-WAY, AND SOUTHWEST 27TH AVENUE, MIAMI,
FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN);
AND BY MAKING ALL THE NECESSARY CHANGES ON
PAGE NO. 43 OF SAID ZONING ATLAS; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of July 14, 1993, Item No. 2, following an advertised public
hearing adopted Resolution No. PAB 25-93 by a vote of nine to
zero (9-0), RECOMMENDING APPROVAL of an amendment of the Zoning
Atlas of Ordinance No. 11000 as hereinafter set forth: and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The Zoning Atlas of Ordinance No. 11000, the
Zoning Ordinance of the City of Miami, Florida, is hereby amended
by adding a new special zoning overlay district, entitled "SD-21
Silver Bluff Commercial Overlay District", for those properties
legally described as all of Block 52 and Lots 26 through 39 of
Block 42 of SILVER BLUFF ESTATES SECTION C, as recorded in the
Public Records of Dade County, Miami, Florida.
Section 2. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami Comprehensive
Neighborhood Plan because it is simply adding an
overlay to the district regarding parking requirements
and is not altering the underlying district's uses or
intensity;
(b) is not contrary to the established land use pattern
because no changes in allowed land uses are being
proposed;
(c) will not create an isolated district unrelated to
adjacent and nearby districts because it is in fact
being created to address a particular need within the
district in which it is being established;
(d) it is not out of scale with the needs of the
neighborhood or the City because as stated above, it is
in fact being created to address a particular need
within the district in which it is being established;
(e) will not materially alter the population density
pattern or increase or overtax the load on public

facilities such as schools, utilities, streets, etc.
because it is not altering the density of the
underlying district;
(f) is necessary due to change or changing conditions
within the district regarding parking specifically;
(g) will not adversely influence living conditions in the
neighborhood because it is unrelated to any nearby
residential area and solely being created to address
commercial parking problems;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety but will
in fact alleviate a current parking and traffic
problem;
(i) will not create a drainage problem because it is not
altering the underlying district;
(j) will not seriously reduce light and air adjacent area
because it is not altering the underlying district;
(k) will not adversely affect property values in the
adjacent area because no changes in allowed land uses
or densities are being proposed;
(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations, but will in fact improve upon
existing parking problems which will benefit the area;
(m) will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare because the proposed changes and

benefits will be offered to all current commercial
establishments with parking problems.
Section 3. Page No. 43, made a part of Ordinance
No. 11000 by reference and description in Article 6, Section 621
of said Ordinance, is hereby amended to reflect the changes made
necessary by these amendments.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

PETITION Consideration of amending the Official Zoning Atlas of Zoning Ordinance
11000, as amended, the zoning ordinance of the City of Miami by adding a new
special zoning overlay district entitled SO-21 Silver Bluff Commercial
Overlay District to the area generally bounded by both sides of S.W. 28 Lane,
S.W. 27 Street, S.W. 24 Avenue, the Metrorail right-of-way and S.W. 27
Avenue, more particularly described herein.

BACKGROUND AND The requested Zoning Atlas amendment is a companion item to a text change to Zoning
ANALYSIS Ordinance 11000 which establishes a new zoning overlay district entitled SD-21
Silver Bluff Commercial Overlay District and is necessary in order to implement the
text changes proposed. (See fact sheet on companion item).
PLANNING ADVISORY BOARD At its meeting of July 14, 1993, the PAB adopted Resolution PAB 25-93,
by a vote of 9 to 0, reca-- ing approval of the above iten.

PROVIDING DEFINITIONS FOR "MINOR AND MAJOR
AUTOMOTIVE REPAIR", "PRINTING", "USED CAR SALES"
AND "PRE -OWNED CAR SALES"; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
Said ordinances may be Inspected by the public at the Office of
the City Clerk, 3500 Pan American Drive, Miami, Florida, Monday
through Friday, excluding holidays, between the hours of 8:00 am.
and 5:00 p.m.
