SD-21 SILVER BLUFF COMMERCIAL OVERLAY DISTRICT; CLARIFYING REQUIREMENTS FOR REQUIRED AND SHARED OFFSTREET PARKING SPACES; ADDING A PROVISION THAT PROHIBITS VARIANCES FOR THE REDUCTION OF REQUIRED PARKING; AND ADDING PROVISIONS ESTABLISHING A PROCEDURE WHICH WILL ALLOW THE PAYMENT OF A FEE IN LIEU OF PROVIDING REQUIRED OFFSTREET PARKING FOR NONRESIDENTIAL USES IN SD-21; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of July 14, 1993, Item No. 1, following an advertised hearing adopted Resolution No. PAB 24-93 by a vote of nine to zero (9-0), RECOMMENDING APPROVAL of amending Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW THEREFORE, BE IT.ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 11102 Section 2. LEGAL DESCRIPTION The area of Silver Bluff generally bounded by both sides of S.W. 28 Lane, S.W. 27 Street, S.W. 24 Avenue, the Metrorail right-of-way, and S.W. 27 Avenue, more particularly described as all of Block 52 and Lots 26 through 39 of Block 42 of SILVER BLUFF ESTATES SECTION C as recorded in the P.R.D.C. PETITION Consideration of amending Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami by amending Article 6 Special Districts to add a new Section 621. SD-21 Silver Bluff Commercial Overlay District, to clarify requirements for required and shared offstreet parking spaces; to add a provision that prohibits variances for the reduction of required parking, and to add provisions establishing a procedure to allow the payment of a fee in lieu of providing required offstreet parking for nonresidential uses in the SD-21 Overlay District. PLANNING RECOMMENDATION Approval. BACKGROUND This Ordinance amends the Zoning Ordinance to create the overlay district necessary to implement that recommendation. This is a companion item to a required Zoning Atlas and City Code amendment. ANALYSIS The industrially zoned area between S.W. 28 Lane and the Metrorail right-of-way, from S.W. 24 Avenue to S.W. 27 Avenue, is in transition from a small warehouse and light industrial area to a specialized retail district. Most of the establishments cannot meet all of the offstreet parking requirements for retail use. In October, 1991, the Zoning Board considered a recommendation that the Department of Offstreet Parking (DOSP), subject to Dade County approval, develop an offstreet parking lot under the Metrorail guideway to provide necessary parking to serve the area; businesses which are unable to satisfy their parking requirements will, under the proposal, be granted a waiver upon payment of a fee to be placed in a parking improvement trust fund, the proceeds of which would be used to reimburse DOSP for the new parking lot.
