ORDINANCE NO. 11097
AN ORDINANCE AMENDING CHAPTER 620
SECTION 62-52 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, TO PROVIDE THAT
MEMBERS OF THE PLANNING ADVISORY BOARD SHALL
BE ALLOWED SIX (6) ABSENCES PER CALENDAR YEAR
INSTEAD OF FIVE (5); CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning Advisory Board at its meeting of
June 9, 1993, by a vote of nine to zero (9-0) adopted Resolution
PAB 23-93 increasing the allowed absences for members of that
board from five (5) to six (6) per calendar year; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
the City Code of the City of Miami, as amended, as hereinafter
set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
preamble to this Ordinance are hereby adopted by reference hereto
and incorporated herein as if fully set forth in this section.
Section 2. Section 62-52 of the Code of the City of Miami,
Florida, as amended, is hereby amended in the following

APPOINTMENT OF MEMBERS AND ALTERNATE
MEMBERS OF THE PLANNING ADVISORY BOARD AND
ZONING BOARD
Sec. 62-52. Removal.
(a) Members and alternate members of the planning
advisory board and of the zoning board may be removed
for cause by the city commission upon the votes of not
less than three (3) members of the commission, upon
written charges and public hearing, if the member or
alternate member affected requests such public hearing.
(b) There is hereby established a point system. Each
member or alternate member of the planning advisory
board and the zoning board who arrives after the
beginning of the first agenda item or leaves before the
termination of the last agenda item, at a regularly
scheduled meeting of the board shall receive two (2)
points. Any member or alternate member of the planning
advisory board or zoning board who accumulates more
than fifteen (15) points in one (1) calendar year shall
automatically be removed and the position declared
vacant.
(c) Notwithstanding (b) above, any member or alternate
member of the plainitzig advtsory board ar zoning board
who is absent, for whatever reason, from more than five
(5) meetings in one (1) calendar year shall
automatically be removed and the position declared
vacant. Notwithstanding (b) above. any member or
alternate member of the planning advisory board who is
absent. for whatever reason. from more than six (6)
meetings in one (1) calendar year shall automatically
be removed and the position declared vacant

Section 3. All ordinances or parts of Ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 4. This Ordinance shall become effective 30 days
after final reading thereof.

ENCLOSURES:
It is respectfully recommended that the City Commission
adopt an amendment to the City Code Chapter 62, Zoning and
Planning, regarding the number of meetings required annually of
members of the Planning Advisory Board, per the attached
ordinance.
BACKGROUND
Pursuant to Planning Advisory Board Resolution 21-93, the
attached amendment revises the number of meetings required
annually of Planning Advisory Board members. Over the past
several years, due to the decreasing number of items brought
before the Planning Advisory Board, it has become more reasonable
to combine the two monthly Board meetings into one. The City
Code presently requires removal of board members absent from five
(5) or more board meetings per year. In light of the compressed
meeting schedule of the Planning Advisory Board, it now appears
logical to increase the maximum number of missed meetings for
that board to six (6) per year.

PETITION Consideration of amending Chapter 62, Section 62-52 of the Code of the City

Advisory Board shall be allowed six (6) absences instead of five (5).

BACKGROUND AND At its meeting of May 12th, 1993, the Planning Advisory Board adopted
