AN EMERGENCY ORDINANCE AMENDING CHAPTER 35 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "MXOR VEHICLES AND TRAFFIC" THEREBY AMENDING SECTION 35-193 OF ARTICLE VIII "COCONUT GROVE PARKING IMPROVIIMENI' TRUST FUND" TO PROVIDE FOR ONE YEAR TERMS OF OFFICE FOR ALL MEMBERS OF THE COCONUT GROVE PARKING ADVISORY COMMITTEE, COMMENCING WITH THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, Ordinance No. 11052, adopted March 25, 1993, provided that the nine (9) members of the Coconut Grove Parking Advisory Committee would serve three (3) year terms, provided that members first appointed would serve staggered terms ranging from three (3) years to one (1) year; and WHEREAS, at the City Commission meeting of July 8, 1993, Agenda Item 35, the Commission directed that legislation be prepared to amend all terms of office of the Committee members to one year; and WHEREAS, the emergency ordinance is necessary because the Coconut Grove Parking Improvement Trust Fund was established by Ordinance 11052, effective April 25, 1993; that funds will commence to flow to the trust fund based on invoices payable by July 25, 1993, and that the Coconut Grove Parking Advisory Committee was established to recommend on fund expenditures; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable in the best interest of the general welfare of the City of Miami and its inhabitants to amend the Code of the City of Miami, Florida, as amended, as hereinafter set forth; 11095 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 35 of the Code of the City of Miami, Florida, as amended, entitled "Motor Vehicles and Traffic", is hereby amended as follows:l/ "CHAPTER 35 Motor Vehicles and Traffic ARTICLE VIII COCONUT GROVE PARKING IMPROVEMENT TRUST FUND Sec. 35-193. A Coconut Grove Parking Advisory Committee of nine (9) members shall be established by the City Commission to advise and recommend appropriate expenditures from the Trust Fund to the Director of the Off -Street Parking Department. Appointments shall be made as follows: Four (4) Members recommended by the Coconut Grove Village Council; One ( 1) member recommended by the Of f-Street Parking Authority; and One (1) member appointed by the City Commission. The Director of the Off -Street Parking Department shall serve as an ex-officio 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Section 3. All ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. BACKGROUND On July 8, 1993, under discussion of Agenda Item 35, the Commission directed preparation of legislation that would amend the terms of office of Coconut Grove Parking Advisory Committee members to one year. The emergency ordinance is necessary because the Coconut Grove Parking Improvement Trust Fund was established by Ordinance No. 11052 effective April 25, 1993; funds will commence to accrue based on invoices payable July 25, 1993, and the Committee was established to recommend on fund expenditures. Appointments to the Committee are being confirmed in a companion item.
