AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10938, ADOPTED DECEMBER 5, 1991, AS AMENDED, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, AS IT PERTAINS TO SPECIFIED PROJECTS IN THE GENERAL GOVERNMENT, PARKS AND RECREATION, PUBLIC FACILITIES, TRANSPORTATION AND PHYSICAL ENVIRONMENT PROGRAM AREAS, BY REVISING PREVIOUSLY APPROVED APPROPRIATIONS TO SCHEDULED CAPITAL IMPROVEMENT PROJECTS AND BY ESTABLISHING NEW CAPITAL IMPROVEMENT PROJECTS BEGUN DURING FY'93, ALL IN THE AMOUNTS AND FROM THE SOURCES SPECIFIED HEREIN; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10938 on December 5, 1991, to establish appropriations for capital improvements, to continue previously approved capital improvement projects, and to establish new capital improvement projects to begin during FY192; and WHEREAS, the disruption in routine services provided by the City of Miami due to Hurricane Andrew delayed the adoption of a master Capital Improvement Appror.iations Ordinance for fiscal year 1992-93; and WHEREAS, subsequent to the adoption of the FY192 ordinance, the City has received additional monies from various sources for new and continued capital improvements in several program areas including General Government, Parks and Recreation, Public Facilities, Transportation and Physical Environment; and 11094 WHEREAS, the Administration has prepared this appropriations Ordinance to reflect these project funding modifications and to make said funds immediately available for the continuation of the specified projects; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby incorporated by reference thereto and adopted herein as if fully set forth in this Section. Section 2. Section 1 of Ordinance No. 10938, adopted December 5, 1991, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1991-92. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: Total Appropriations ($ x 000) A. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance'shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments and to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two (2) separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon its adoption.
