ORDINANCE NO.
AN ORDINANCE AMENDING SECTIONS 12-3 AND 31-35
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TO CONFORM WITH FLORIDA STATUTES
849.15 - 849.23, AND TO REQUIRE A SWORN
AFFIDAVIT FROM OWNERS OF AMUSEMENT VENDING
MACHINES TO THE EFFECT THAT SUCH MACHINES ARE
NOT UNLAWFUL IN ACCORDANCE WITH SAID
STATUTES; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, Florida Statutes 849.15 - 849.23 prohibit the use
of slot machines or gambling devices; and
WHEREAS, certain amusement vending machines fall under the
prohibition of the Florida Statutes; and
WHEREAS, the Police Department has recommended that the City
Code be amended to conform with the State Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Sections 12-3 and 31-35 of the Code of the
City of Miami, Florida, as amended, are hereby amended in the
following particulars:1

Underscored and/or figures shall be added. The remaining
provisions are now in effect and remain unchanged. Asterisks
indicate omitted and unchanged material.

"Sec. 12-3. Machines not to be used for gambling.
No ooin-operated machine shall be used for
or as a game of chance. Amusement and
operated by ingertion of- coin. slug or DaDer ourreno
Sec. 31-35. Established.
The assessments of occupational licenses taxes are
hereby fixed as follows:

Coin -operated machines.
Every person selling, leasing, renting,
distributing, servicing, operating or placing in
operation any machine as described below:
(a) Amusement vending machines are machines,
contrivances, or devices for amusement or score,
set in motion or made to function by insertion of
coin, slug or paper currency and whether or not a
charge is made for play. The owners or operators
of these machines must furnish annually with the
license application pictures of the machines and a
sworn affidavit stating that they know the
provisions of Florida Statutes 849,15 and 849.16
and that the licenses being applied are for
machines which are not unlawful as defined in such
statutes.
(1) Radio, television, and other

Section 2. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. This Ordinance shall become effective 30 days
after final reading and adoption thereof.

It is respectfully recommended that the attached ordinance be
adopted amending sections 12-3 and 31-35 of the Code of the City
of Miami, Florida, as amended, to conform with Florida Statutes
849.15 - 849.23, and to require a sworn affidavit from owners of
amusement vending machines to the effect that such machines are
not unlawful in accordance with such statutes; containing a
repealer provision and a severability clause.
The Police Department has recommended that the City Code be made
to conform with the prohibitions of illegal gambling devices as
setforth in Florida Statutes 549.15 - 849.23.
The attached resolution prepared by the Finance Department amends
section 12-3 of the City of Miami Code which prohibits gambling
or game of chance machines and imposes a $500 fine to violators.
The amendment to section 31-35 of the City Code establishes the
requirement of an affidavit to be provided by owners and
operators of amusement vending machines, prior to renewing an
occupational license, to the effect that such equipment is not
illegal as defined in the Florida Statutes.
