AN ORDINANCE AMENDING SECTION 2-75 OF THE CODE OF THE CITY OF MIAMI, AS AMENDED, THEREBY ASSESSING A LATE PAYMENT PENALTY FOR THE CERTIFICATE OF USE RENEWAL FEE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, Section 2-75 of the Miami City Code provides for the assessment of an annual fee for Certificates of Use; and WHEREAS, there is no provision for a financial penalty for late payment or non-payment of this fee; and WHEREAS, if applicable, all businesses in the City must have a valid Certificate of Use as required by Section 2-75 and Section 31-17(5); NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2-75 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: I/ "Sec. 2-75. Zoning certificate of use required; annual reinspection of buildings and premises; fees for inspections and issuance of certificates. Words and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. Ces io Cit ager ENCLOSURES: 0 It is respectfully recommended that the attached ordinance be adopted amending Section 2-75 of the City Code to assess a late payment penalty for the Certificate of Use renewal fee. Section 2-75 of the City Code provides for the assessment of an annual renewal fee for the Certificate of Use. However there is no financial penalty for not paying the fee. The code also requires that every business have a valid certificate of use, if applicable. (E.g. peddlers are not required to have nor are individual attorneys accountants employed in a firm). Therefore the penalty being proposed is the same as for an occupational license as follows: First month 10% Second month 5% Third month 5% Fourth month U Total 25% At these rates the 1993 billing would have generated S77.207 in penalty revenue as follows: Amount Penalty Date Outstanding Rate Penalty 1-31 $416,752 10% $41,675 2-28 397,493 5% 19,874 3-31 186,359 5% 9,318 4-30 126,809 5% 6,340 Total Penalty Assessed $77,207 (1) About 20,000 bills are sent on or about January First and the annual renewal fee is about $1.0 million.
